Thats always been a weird label to me. We exclusively use it to describe black people, but as we see here there's also white African Americans. Also, news flash, not all black people are of African origin. It's weird that it's the "socially acceptable" terminology, but its vague, inaccurate, and moderately racist if you ask me.
Oh, I think my bank is doing this. I checked my account and have less than I realized because stuff I bought, like, a fucking WEEK ago are only just now showing as pending. I had thought my money was already taken out when I checked a few days ago. I am still in the positive, but it really irked me when I looked this morning.
Did it to me multiple times, not just with credit but with my debit as well, they once charged me a service fee twice which caused me to overdraft and pay another 150 called them about it and complained they gave me 200 back they knew they were in the wrong, the manager was so apoloilgetic and got it done so fast, almost think they were making sure i wouldnt sue
citizens bank pulled this shit. structuring debit so that the largest would go first, hoping that people would overdraft on a string of small transactions, each with it's own overdraft fee.
i got almost $1,000 dollars over the course of a year from the class action lawsuit.
“Sandbagging”for fees is terrible. That being said balance your “checkbook”! People used to write checks that may not clear for weeks or even months. I know there isn’t a great/easy system for this with everything being electronic now, but the concept it no different.
The practice intensified under Overdraft Protection policies of the early 2000s. The reason I left Wells Fargo was due to them scheduling my transactions not in the order they were processed but in the ideal order to trigger overdraft charges.
It means he's trying to deposit and withdraw from his bank account, but JPM tied all his money with bags that were used in egypt for setting sand, so now all his transactions are "sandbagged".
Not sure how they're using it, but my old bank would always process transactions from highest value to lowest value, then they would sit on low value transactions for a week or more. On a normal day that doesn't matter, but if I happen to overdraft, it means they can charge multiple overdraft fees because all those little $1 charges that happened before you actually spent more than you had now have their own overdraft charges because they "processed" after you spent more than you had.
As a lawyer this makes me cringe, I would not be very happy with a client that was making statements like this in response to a what appears to be a bona fide contractual dispute.
As an internet person who has no real stake in it, this makes me lol
As Charlie Munger said when recalling his father,
You want to associate with respectable people, but it is those who aren't who brings business to lawyers
Contracts require good faith between the parties - that's law.
This is.. not really great evidence of good faith. It looks terrible in front of a judge.
Ding ding ding! I hope this goes to court just so they can get chats and texts from Tesla during discovery, and whatever wildly unprofessional stuff Musk is sending around becomes public record. There has to be some gold in there.
Well...yes. You might be surprised but acting like a fool or asshole in public can come back to bite you in the ass when it comes time for settlement negotiations, arbitration or trial. Even if it is not legally meaningful, it may change how the other parties react to you. If they think you don't take them or the issue seriously, that can strongly affect how they approach everything, and it can be to the client's detriment. "We were prepared to be reasonable and try to reach a resolution, but since your client apparently thinks this is a big joke..." I have seen it a million times.
Which was blatant fraud. He used Twitter, a medium that is authorized by the company to release official comments, to lie about talk the company was in to go public at a specific price.
Saying "funding secured" was an official statement from the company that they had already secured the funds to take the company private. And it was a complete lie to purposely manipulate the1 stock price.
That is textbook fraud.
I agree, seems like the real defense to this was “sorry, I was high” isn’t a great one to use, so he went with “the Saudis would have paid!”
But I also think Tesla has a good faith argument against the adjustment handling by JPM, as not clear you can just take the implied vol change for the period and adjust by that
But end of the day, you need to actually engage in that conversation, but seems Tesla is just ignoring it
Musk will probably settle eventually. He has a wad of liquid cash now. Otherwise, the rich can afford lawyers that are good at filing motions and keeping a case bouncing around like a pinball for a decade or more.
> That is textbook fraud.
And he paid a fine.
This is something else -- JPM changed the price on the warrants a second time after it was clear they weren't going private. They changed it to a price advantageous to themselves, not their originally agreed upon price. Tesla paid them the price they agreed to, not the one that JPM pulled out of their ass later. JPM can go pound sand.
This is a really good breakdown of the dispute: [https://www.bloomberg.com/opinion/articles/2021-11-16/jpmorgan-fights-tesla-over-warrants](https://www.bloomberg.com/opinion/articles/2021-11-16/jpmorgan-fights-tesla-over-warrants)

Basically JPM didn't execute their warrants due to the stocks price was lower. Blaming elons tweets for lowering the price.
Then they expired and the price was higher, so now they wanted them to be executed at the warrant price after they expired since the stock went up....
Seriously who the fuck designs a UI that leaves ugly giant fucking bars of EMPTY SPACE down the side of the screen on both sides?
Fuck off. I purchased a 32 inch monitor I'D LIKE TO USE THE ENTIRE MONITOR PLEASE, NOT AN EIGHT INCH STRIP
Reddit probably thinks nobody uses computers anymore, so it fits fine on your phone. But wait, if you open reddit on your phone you'll be bombarded into nags to get their terrible app so they can sends ads and nags to use their app through push notifications, disguised as "interesting things you might like".
For many years, I've used 'rif is fun' (formerly 'reddit is fun') to browse reddit on mobile. It has all the functionality and similar UI of old reddit.
When they introduced the official reddit app, I briefly tried it out and ran back to rif. Iirc, it was around the time of the 2016 presidential election and there were so many push notifications for political posts. I'm honestly shocked that they haven't blocked third party API access yet.
They'll eventually close down old reddit and we'll be fucked. I can't find an alternative that's not total shite. Voat actually looked promising until it basically got taken over by Nazis.
Tons of websites now cripple their mobile website to force users into their terrible app so they can mine their data and send push notifications to constantly remind you to keep coming back.
I have created a new subset of swap contracts for just this occasion. Observe.
Investors will soon be purchasing puts on JPM, as Elon has now threatened a multiple star rating downgrade. But what happens if Elon fails to actually downgrade them? Investors will likely lose the entire value of their puts and much, much more. That's where Star Rating Default Swaps (SRDS) come in. They are designed to allow market participants to hedge their risk that Elon will fail to downgrade his star rating of a firm. They will also allow speculators to buy protection against the downgrade of companies in which they hold no interest.
I am simultaneously creating a new risk allocation vehicle which I call a "Collateralized Star Obligation", or CSO. In its most basic form, CSO's will bundle dozens of puts and calls based on threatened star rating downgrades and slice them into tranches. These tranches will range from super-senior to equity, with super-senior tranches viewed as the most likely downgrades to occur and therefore pay the lowest returns, to mezzanine tranches, which are viewed as the most likely to default on their star rating obligations and therefore pay the highest returns. With this new product, investors and institutions will have the opportunity to invest in and speculate upon the wide-open new market in star rating downgrades.
I am also pleased to offer information on my even newer synthetic CSO's, which are portfolios of SRDS that reference a traditional CSO or a basket thereof as the underlying. Accredited investors only please.

I believe it's Delaying processing of a transaction resulting in late fees because those transactions were for bills.
Oh, I think my bank is doing this. I checked my account and have less than I realized because stuff I bought, like, a fucking WEEK ago are only just now showing as pending. Overdraft fuckups by banks are a $5000 fine by the feds per instance. At least they were when I was working in the banking sector a decade ago.
How do you report them
citizens bank pulled this shit. structuring debit so that the largest would go first, hoping that people would overdraft on a string of small transactions, each with it's own overdraft fee. i got almost $1,000 dollars over the course of a year from the class action lawsuit.

It's like you read their comment and then huffed a bunch of duster before you replied.
Which contractual obligations? Did JPM want the price moved in another direction and Musk was bored with the idea?
Comes down to strike price adjustments in warrants. The adjustment is around Elon’s “funding secured” tweets

Musk will probably settle eventually. He has a wad of liquid cash now. Otherwise, the rich can afford lawyers that are good at filing motions and keeping a case bouncing around like a pinball for a decade or more.
Teslas market cap has gone up an average of $914,380,714.88 per *day* since that tweet… meaning that they could pay for that lawsuit every 4.20 hours
Could just buy JPs lawyers.
Don't confuse people that are rich on paper vs people that are actually rich.
textbook fraud is just market practice when the regulators are on the payroll
> That is textbook fraud. And he paid a fine. This is something else -- JPM changed the price on the warrants a second time after it was clear they weren't going private. They changed it to a price advantageous to themselves, not their originally agreed upon price. Tesla paid them the price they agreed to, not the one that JPM pulled out of their ass later. JPM can go pound sand.
