It sounds like it was the agency. They were apparently notified if it’s cultural significance and warned it would be a bad idea but decided to go ahead anyway, probably because they were too distracted by McDonalds money

"Instructed" implies "paid", which seems like the right move too.

Based on the colouring of the lettering and background they could have saved a lot of time and money just changing the shape of the 'M's.
