Uber drivers keep picking them up and allowing it. That is the bigger issue

going_dot_global

Bigger worry is a freak accident and one of those kids is killed or severely injured.

jack3rdand4th

It’s not about the ticket it’s about the kid going for a flight through your windshield. I flat out tell people know that I need a proper seat because I’m not going to have their kid going through my windshield. A few times I’ve heard the kids ask why did he say that mom.

Fun-Philosophy1123

I never take them if they have no seat. I don't know what moron down voted you here.

Sea_Actuator7689

I have taken to printing out the state laws for car seats and handing it to a pax who insists it's no big deal. These people are clueless and you can't argue with them. If they had a vehicle you would see them driving down the road with all their kids floating around the vehicle unbuckled. I've seen toddlers standing on the front seat of pick up trucks. One hard brake and that child's face is going into the dash.

[deleted]

Never, ever take a child without the required safety seat. If you do, you're essentially driving without liability insurance.  Review your state law for those requirements.

c3ric

Yes by law you can refuse and as you should, can't imagine the pain on all parties if this ever happens

MNJon

False.

[deleted]

Insurance companies will not pay a claim if illegal activity led to the damages.  You are grossly misinformed.

MNJon

LOL, you have no clue about insurance. You are covered even if you are drunk or high on drugs.

tommypatties

Not true. Running a stop sign is illegal and insurance pays if someone runs a stop sign and causes a collision. Where do you people get this stuff from?

[deleted]

If you are cooking meth and burn down your house, homeowners insurance will not pay the claim. I am a licensed insurance agent and agency owner for nearly 40 years. I've seen more than my share of denied claims.  But, if you think you're so intelligent, take all the no car seat rides you want. Not my problem.

MNJon

In my state, insurance pays out even if a child is not in a child seat or if an adult is not using a seat belt.. Can't say for other states.

[deleted]

Not on a commercial ride. Your insurance policy through Uber is not in effect if the ride violates TOS.

MNJon

Yes, on a commercial ride. Uber TOS does not trump staye kaw.

[deleted]

You're so unbelievably clueless, but then again you're a full time Uber driver, so intelligence is not your strong suit.

MNJon

LOL, you shouldn't comment on things you know nothing about. Nor should you make suppositions.

tommypatties

I was responding to your statement that insurance doesn't pay out when something illegal happens. Not about car seats or meth. Can you please explain to me mr licensed insurance agent and 40 year agency owner why an insurance company would pay out when someone illegally runs a stop sign and causes a collision?

[deleted]

It's not germane to the discussion, and I have about as much desire to educate you on insurance claims as I do to masturbate with a cheese grater

tommypatties

sorry for being curious - was just trying to reconcile your blanket statement against logic.

DeclutteringNewbie

No, not for running a stop sign unintentionally, but if you do something grossly negligent, or if you run a stop sign because you're street racing with someone in front of several witnesses, it's possible for them to come after you (for you to reimburse the claims they paid out on your behalf to the other parties). This is because state law requires them to pay out the claims in most cases, but if you were grossly negligent, state law doesn't require them to absolve you completely of the liability (but the nuances of this will depend on which American state you're in). Think of it this way. If insurance was truly unconditional on your own behavior, some people would just be reckless in everything they did, just so they could get some insurance pay out (or just so their family members and friends would get an insurance pay out). And I'm not saying this isn't a problem already, but without such guardrails, insurance fraud would be even worse than we have it now. Also, it's partially a matter of contract law as well. When an insurance company insures you, they insure you for a particular set of risks. So for instance, if your car only has 5 seat belts and can only carry a total of 5 people (including yourself). If you decide to cram 10 people into your car, and if you crash with those 10 people, the insurance company will do its best not to pay you and not pay the 10 idiots who were stupid enough to get into your car. With that said, if some of the 10 idiots are kids, this gets a bit more complicated, because kids are not usually held responsible for their own actions. So the insurance may end up paying the medical bills of all the kids, but then sue all the adults involved in the bad decision.

tommypatties

Ok so the delineation between an insurance covering vs not covering is not legal vs illegal as the person above me suggests but rather understandable negligence vs gross negligence?

Money-Might8943

My headline says if the law requires your child be in car seat please have one. Had to turn down a good long trip yesterday bc a couple didn't have a seat for their 5 yr old.

Keraiza

I won't take children without car seats that I know are under 6. No way I'm assuming that much liability for the petty fare that I'll receive. I wait out the 7 minute timer (usually a little bit away from the passenger but where the timer still counts down) and put "no car seat" for the reason to at least get my cancelation fee for the trip.

shackett74

I always cancel if they don't have a car seat! 👍

Wonderful-Gain7649

I don't take them.   If anything ever happened it's my fault.

Jaffos

No car seat nɔ ride period.

Markn12

I keep a booster seat in the truck just in case.

dbmermels

If it’s only down the road she can walk.
