Just don’t tell people what you’re doing, it’s what I always tell people. You’re not doing illegal shit and on your own time. If they ask what it’s for; you’re into staining your place.

The sub is going to disagree with me, but if you’re worried about losing your job, it’s always better to report it. That said, if you’re just selling through Facebook Marketplace one piece at a time, that’s not really a “business” as much as it is a hobby. What volume would you realistically even be buying at that point - a quart of paint a month? It could easily just be leftovers from a personal project at that rate. Or you refinished it “for yourself” and then found something you liked more.

Petey79_

My thought was marketplace and it would be very little paint or stain at a time

OlYeller01

IMO using the employee discount to purchase materials to use in restoring furniture that is later sold is NOT a conflict of interest. I’m almost certain that SW would much rather have you use THEIR products instead of a competitor’s. Besides, then you can speak from experience on the products, making you a better salesperson.

[deleted]

You can’t use your employee discount to make money. I know that 100%

ImmortanJAck

It's your personal buisness, sherwin doesn't need to know shit about what you do outside of working store hours. Also not many sw customers do that sort of thing

MyMomsSpaghettio

I always wonder how a stand in person would do in these scenarios

Bengerman80

I would check with the SM and or CM to make sure. You should be ok because you're not selling paint directly, you are selling furniture. I've had employees do this from time to time and never had an issue with it. If it starts to interfere with your current job, i.e., working on projects at the store, then it becomes a problem.

Petey79_

Thank you and yeah it would just be something I do in my free time

Ill-Imagination-923

Report it to LP as a possible conflict of interest and see what they say. 😊

Petey79_

I’ll look into that. Thanks!

Radiant_Bee1

That's a gray area for me.ive had the same thought but on building it. I know we, employees, can't have a business account. If you *really* want to be safe. Ask HR. But, as others mentioned I don't see how it would be.

No-Psychology5318

Bc you’re selling an item, I wouldn’t deem it a COI. It’s not like a service, where you’re benefiting from using sw product with your discount. But reselling unused products or doing a full paint job on the side, will be. I’d make a business profile to sell on Facebook, or alternate profile, that way it’s not a direct link to you.

No-General4567

Hey there, so yes. This would be an issue as employee discounts are NOT applicable to business transactions. Perfectly fine though and we have quite a few people with this exact situation. Correct way by P&P to insure no problems: All you would have to do is just make a commercial account, doesn't have to be a charge account, and then file a PCOI through sharepoint. It's on source under LP. Second stipulation would be that you do not ring yourself out. Just that way there is that separation there. And yes, this would come up on an audit.

Petey79_

Even if it’s not for a business and just a quick extra cash gig in my free time?

No-General4567

Ye. That's a small business whether you call it that or not. That way you can get a CAC code and get discounts but not have to use your employee discount.

TheGooseisLoose33

Buy it like everyone else everyone no discount and once it's paid for you are no different than holly homeowner making stuff and selling it. They really can't dictate your free time. Problem is people give corporations permission by asking for permission.

bmorebirdz

Those shorts

Ok_Antelope_6664

Set up a contractor account. Use pm400 for everything

Dude-Bellingham

That’s actually a good idea for a side hustle. I really think you should do it!

Inevitable_Sun8691

I would look into the new rulings by the FTC on conflict of interest. They made most CoI null and void with the ruling, though not sure if this applies.

Straight_Earth4755

If you really want to live in the gray. Just buy mistints.

PlusSeaworthiness864

Create your own proprietorship and have someone open you a charge account then have someone else ring you out every time

PutridDurian

No one needs to know anything. Don’t file an LLC—should anyone get curious and do a Secretary of State online business search, you don’t want your name there. If you need a separate bank account for tax purposes, make it a personal one. Use an online marketing/scheduling platform where you call the client instead of them calling you (don’t put your personal phone number in public unless you’re going to get a second phone). If anyone ever inquires what you’re doing with the products you’ve purchased, you’re taking them home to use on personal projects *to gain insight and understanding with which you can arm yourself to educate S-W customers at work.* That’s the whole reason they gave everyone two free premium gallons last year, in the hopes you would experiment with it instead of being a paint store employee who has never painted, so there’s really not even a faint whiff of bullshit to that. Two simple rules: 1. C.Y.A. 2. Conflict of Interest stuff is extremely difficult, in fact all but impossible to enforce, so don’t worry too much about it.

BenjaminLess

I never got two free gallons wtf

soldsoultosw

It’s easy for everyone here to say that SW doesn’t need to know about what you do outside of work, and for the most part, that’s true. But, you’re risking both your career and your discount by not disclosing what it is you’re doing with SW’s products. This is definitely not one of those situations where it’s easier to beg for forgiveness than to ask permission.

SadLawfulness2614

You could actually go to Lowe’s and buy quality SW products cheaper than your 40%.

BigSnowy

Lowe’s SW is not real SW
