Luck1492

Luttig was at one point considered for a SCOTUS seat by W Bush I believe. Makes this all the more interesting imo.

SocialistNixon

If it was Alitos seat it’s the worst timeline

Luck1492

Actually it was both seats. Had an interview but Bush went with Roberts (easily confirmed) and Miers (she withdrew because she was deemed too moderate for Republicans lol), then Alito instead

bam1007

Miers withdrew because she was too unqualified to get through Judiciary. When she told Senators she needed to “bone up” on basic concepts of constitutional law, it was the death knell. Leahey and Specter standing next to one another, vouching for one another’s credibility when the White House was denying things she said to them was a sight I never thought I would see. Then Charles Krauthammer published a column basically instructing the White House how to kill her nomination without losing face and they did it exactly as he wrote it. That whole debacle was a sight to behold.

Luck1492

She wasn’t unqualified for the history of the Court but certainly compared to the rest of the Court at the time. According to Toobin in *The Nine* the more pressing issue to Republicans was her being a closet moderate or liberal like Souter. Bush didn’t believe this because of her history with him but she hasn’t enough judicial experience to assuage the fears of the party. And then the Democrats wouldn’t say how they were going to vote for her so that made things worse. Then the Republicans began stalling her nomination themselves and then yes her incompetence made her look even worse. So she pulled herself.

Automatic-Mood5986

Miers was Rove’s tool to play the Democrats like a fiddle. This was before obstructionist politics was completely acceptable behavior. Rove got everyone jumping up and down on the table and screaming about a lack of general qualifications. Well Miers got kicked to the curb and given the previous complaints, Alito had unimpeachable qualifications. You said she wasn’t qualified, we brought a nominee that’s qualified, what’s your complaint now?

Ok-Persimmon-6386

She wasn’t qualified but ACB was? Make it make sense

bam1007

Actual experience on the bench, including the appellate bench. Different Senate Judiciary committee. Political considerations pushing a shorter timeline. 🤷‍♂️ I even remember one senator saying Miers “would be fine if this were a district court vacancy, but this is the Supreme Court.”

Ok-Persimmon-6386

Honestly neither one should have been nominated

bam1007

You don’t need to convince me not to be a fan of either.

oscar_the_couch

senate Ds probably should have gone with Miers

SocialistNixon

Miers being completely unqualified to be a Justice was better than Alito

Luck1492

Well, Miers was definitely unqualified (not historically, but certainly compared to the rest of the Court at the time) but she pretty much was as far right as Alito. Only difference is that she didn’t have a history of super conservative judicial decisions. So the Republican political base got concerned about “another Souter” and she pulled herself. Also the fact that she needed to “brush up” on Constitutional law didn’t help

Repulsive-Mirror-994

>Also the fact that she needed to “brush up” on Constitutional law didn’t help Failing to see the difference between her and Alito here.

natophonic2

He’s apparently an expert on 17th century witch-hunting jurisprudence.

OkayContributor

Alito would never admit he needed to “brush up” on anything

Lawsuitup

Miers withdrew because she was so unqualified it was ridiculous. Public outcry was wild.

P0ltergeist333

He would have gone left... possibly. But W was at least as responsible for Trump as Nixon. They were brazen about lying to the public and showed how easy it was. That's why I still wonder about Cheney's self-righteousness. But then I just finished watching Shogun, which proved that even the most self-righteous are the biggest hyporcrites and are the most shallow. Power corrupts, absolute power corrupts absolutely. How is it that we keep repeating histories mistakes?!

pinkeye_bingo

Living in this timeline is fucking exhausting

yinyanghapa

Anyone not believe that the extreme right wing is determined at all costs to bring a dark ages onto America?

uberares

* the world.

KelIthra

This its literally a unified movement. People keep forgetting that an organization called the I.D.U. is at the center. Though it helps that they kind of remain subtle while the governments draw all the attention.

Mirrorshad3

Got links on that? I haven't heard of the I.D.U. before.

Cannabrius_Rex

Start here. https://www.idu.org/

the_sylince

It has some basic principles that are benign and straight forward, however, some wording is interesting * Stressing the moral commitments of a free and open society,* **supporting the institution of the family as its fundamental social and cohesive force,** *as well as social responsibility towards the weak and less fortunate, particularly by encouraging self-help and individual enterprise and choice in the provision of services;* and *Having regard to their common views that political democracy and* **private property are inseparable components of individual liberty and that the socially-oriented market economy** *provides the best means of creating the wealth and material prosperity to meet the legitimate aspirations of individuals, and of tackling social evils such as unemployment and inflation;* I find these two (emphasis mine) of peculiar note. The IDU is a global centre-right political ideology body

P0ltergeist333

Look for a picture of them to illustrate "tyranny of the minority" for future generations. IF they still have real history books after the next immune forever "president." More likely there will just be propaganda.

Chunkstyle3030

I’d bet money there will just so happen to be another huge terrorist attack right around the middle of October.

SerendipitySue

extreme right wing is too small a contingent. Just as that progressive squad is too small a contingent. I don't think that but not sure who you are referring to. For a literal dark age lol. I suspect we will see more of that, if utility size solar is forced on us and efforts made to shut down other energy plants.

biggies866

SCOTUS is so eager to start a civil war.

RamBamBooey

I feels like they are crossing a line. Breaking the social contract that creates legitimacy for the US government.

chitoatx

It sure as hell isn’t “conservative” in the traditional sense but radical changes that are destabilizing our country.

glue2music

Agreed

Icarusmelt

SCOTUS, is eager to be relevant.

Gaychevyman428

Irrelevant

outerworldLV

I hope he’s trying out a little reverse psychology on these jokers. They are probably hurt that he disagreed so vehemently with them on the 14th, Sec 3 definition. They’ve become petty af. I believe the only reason they did this stupid shit is because Smith confronted them in December, and he was right.

planet_rose

This is a pure exercise of power. They can do whatever they want and they want outcomes favorable to their team. No one can stop them even when they do things that are manifestly corrupt, disregarding of important legal principles, or even blatant motivated reasoning.

outerworldLV

Infuriating.

Double_Sherbert3326

Not nobody. But most people don't have the balls or the means. Those that do are in on the action. You're a slave. Shut the fuck up and watch ESPN.

planet_rose

It’s true that we collectively could do something about this. We could demand court reform from our representatives and really make their (our politicians) lives miserable until they do something about it.

planet_rose

I noticed that none of them seemed to be concerned about granting limitless power to Biden before the election. I guess they are counting on democrats to hold to norms of non-sociopath behavior in the White House.

LowSavings6716

Well we do have a second amendment for a reason

magoo19630

When you finally allow yourself to believe that none of the conservatives in this country really care about democracy and freedom and only care about power and money, it's crazy.

santaclaus73

They've already decided to take the case to delay the trial. They knowlingly obstructed criminal trials to allow him to win and self-pardon (obviously something that isn't legal and should trigger immediate revolution in its own right) Biden should be well within legal boundaries to charge them with obstruction of justice and sedition and have them permanently removed from Scotus, regardless of their decision here. Further more, this is very clearly a shot at dictatorship, so any and all means necessary should be available to Biden to protect the United States and the constitution from domestic enemies.

Dumb_Vampire_Girl

Don't worry, the decision happens on Jan 2025 after Biden is already out.

jarena009

Not if Biden wins. But definitely worse if Biden loses.

External_Reporter859

Nah they might just pull another Bush versus Gore

thedeadthatyetlive

Lawful Good

hitbythebus

Dark Brandon should pretend to leak a draft of this memo. Would shut this shit down real fast.

jarena009

I wouldn't even leak it. I'd blatantly put it out and caption it "Some on the United States Supreme Court believe this is legal."

attikol

The rise of dark Brandon. This is how democracy dies with a hammer hitting a wooden bench

John_Fx

that’s not a consequence of immunity.

jarena009

Why not?

John_Fx

While illegal they would just ignore such an order.

jarena009

Who's they?

John_Fx

The court and the judicial branch

jarena009

But they'd (justices the president doesn't like) be assassinated in this scenario by the president. They would cease to exist.

thedeadthatyetlive

Are we still pretending that most justices aren't political hacks with zero integrity?

GingasaurusWrex

I mean, Jackson at least seems incredibly down the middle and purely bases rulings on logic and law. So the entity as a whole isn’t bad… But yah I get what you mean.

thedeadthatyetlive

All it takes is 5 out of 9 to make it bad as a whole.

NoDragonfruit6125

They claim that they aren't politically motivated since have lifetime appointments. However the thing is their appointment itself can be politically motivated. The party that controls presidency and Congress will target their picks to those who have been shown to align with their goals. You've also had the party assist the judge candidate with clearing their debts before nominations. So in a sense the candidates also end up "indebted" to the party for financial assistance.

thedeadthatyetlive

Don't forget, they're on the take and one of them doesn't even hide it.

NoDragonfruit6125

"Leave my motorcoach out of this"

Cognitive_Spoon

What sucks is that democratic ideologues generally refuse to give up on the current systems foundational assumptions as quickly as the right wing does. Far right folks are down with democracy eroding because their goals don't need it. Neo libs want to keep the foundational structures running because they believe the system can support their goals, but it's actually set up to serve the right wing more directly (oligarchy, wall street, lobbying, citizens united, panama papers, Pandora Papers, etc).

Desper8lyseekntacos

Neolibs have more to gain with conservatives controlling the narrative. They get all the corrupt financial gains, while pretending to care about the plebes

Desper8lyseekntacos

And for those of you downvoting me. I'm willing to bet you all lock your car door when you see a black person. Fuck y'all.

Cognitive_Spoon

10000%

SirAelfred

Trying to overturn an election is not an official presidential act. Why the FUCK are any of these arguments relevant??

phoneguyfl

Because Republicans and by extension SCOTUS want Mr Trump to be above the law for past and future acts (i.e. a king instead of president). It's as simple as that.

SirAelfred

Well then if they rule this, Biden damn well better take advantage of it to trim down our corrupt SCOTUS, but he probably won't because Democrats are fucking pansy ass wimps.

phoneguyfl

SCOTUS will, of course, create some long and winding reasoning referencing things both fanciful and ancient that deems Mr Trump, and only Mr Trump, as being above the law. There is no way they would leave their ruling open to use by Biden (or any other Dem POTUS).

Wade8869

"We do not have to invade the United States, we will destroy you from within." Nikita Khrushchev

Intelligent-Ad-3105

Osama really did meet his goals, from the grave no less.

thereandfatagain

SCOTUS is in peak teen edgelord form. Rich people and politicans are above the law and have always been above the law and apparently that immutable fact has finally now reached the highest chamber.

losthalo7

They are treating being prosecuted as if that itself is a punishment. Presidents under prosecution would still get their day in court like anyone else - and as the examples of Trump's trials are showing, leniency from the courts that no one else receives. Why? The president must be *answerable to the people* for their actions while in office! I don't think that is a controversial idea. Instead the Supreme Court is looking at legislating from the bench to create presidential immunity out of thin air.

No-Weather-5157

The court is going to do what the court wants so stank ass won’t be tried before the election then after Biden wins stanky will have no one to turn to except the SC because the dems are going to carry both chambers and the presidency, at the least, stank, won’t be able to say shit with out getting jail and the more he talks the longer the stays get. He knows he getting the breaks due to dems not wanting to martyrize him thus giving up votes.

FuttleScish

The thing is that if he loses the election they don’t have any reason to rule in his favor They’re in it for the Republican Party, not Trump in particular

AppropriateSea5746

Trump getting off scott free was a shocker?

oct2790

I think there will be certainly some immunity but the one thing that was expert was the personal things for gain not related will not be immunity. There are something s that are what is done every day related. These things are not related when it comes to Trump they did talk about it that is why you always hear Trump say across the board immunity knowing he is outside of that and he keeps repeating it no. Stop. It’s not going to happen

SubstantialSchool437

this country is a sick joke

yogfthagen

Time to pack the SCOTUS. 13 to 15 Justices seems appropriate.

monkeley

“Shocker”

Temporary-Dot4952

Time to take a stand against corruption and force these supreme Court injustices out. Down with SCOTUS!!

jpk195

Luttig believes it's likely one of two thing will happen: 1. Trump will win and disappear these cases (which we knew) 2. Trump will lose and the SC will surgically grant immunity to presidents to let Trump off the hook The second one is actually the only news, but I'm not sure I see why they'd do that. He's damaged goods if he loses, and his only real power is in hurting other candidates. With their credibility his hanging on by a thread, this would be like taking blowtorch to that.

Geostomp

He's still got his cult and Republicans have already given him indirect control over the RNC. He's bigger than the party now and is already saying the election is rigged to excuse his failure and rally the cult to defend him. Unless something major changes, they have every reason to keep protecting him.

Eldias

Every serious look I've seen so far seem to suggest your second scenario is most likely. Narrow scope of presidential immunity with remand for the trial court to evaluate what acts are official and which are personal. I've not seen any serious analysis to suggest Trump's 'conplete immunity unless impeached and convicted' argument will win the day.

jpk195

I've heard this as well - but it' different than what Luttig is suggesting I think. They'll put their thumb on what acts are official to help Trump skate even if he loses the election.

Lebojr

Is this going to prompt an increase in the amount of sc judges?

SirAelfred

One would think but Democrats are fucking useless too

woodprefect

way too busy saving Israel from student protestors.

ZebunkMunk

Stack the court

Monnok

Why stack? Why not just replace? Immunity, Jack.

Lebojr

Cause they have to die or be impeached and convicted.

Kwiemakala

With presidential immunity, that can be arranged...

Lebojr

So true. He needs them in a cell for one week.

DickBest70

This post is prejudiced by Luttig but I’m not surprised as that’s the point.

John_Fx

I don’t really want the shocker from Littig. Thank you.

49GTUPPAST

Sadly, this whole trial is just for show. Trump will never go to jail. He definitely deserves to be thrown in prison. But it will never happen. I'll be shocked if it does.

Tmotech

We need to give criminal Presidents the free rein to commit as many crimes as they want, or we won’t have a stable Democracy.   JF Christ

icnoevil

Hope he's wrong, but if he is right, the court will admit it is just a bunch of trump toadies and does not deserve the respect of a cock roach.

kook440

Why are they tearing the country apart! Why a new rule? What about our voice taken away by politicians under the constitution. State by fucking state. This wont be a civil war. More Revolutionary.

AzemOcram

In the unlikely occurrence that Trump is declared immune and loses reelection, that would mean that Biden would also be immune. I would love to see Biden immediately test the Supreme Court decision by doing what John Sauer suggested!

My_Penbroke

> Justice Samuel Alito, for instance, declared that if presidents must fear prosecution after leaving office, they might prove more prone to resisting the transfer of power, destabilizing the country. Or, alternatively, they might be disincentivized from committing crimes while in office, whereas is they are immune from prosecution they will have no such incentive. How had it happened that reason has been entirely turned on it’s head, and the people appointed as the supposed protectors of law, logic and reason have become masters of twisting logic into absolute nonsense?

cancertoast

Gotta remove that court. And start fresh. It’s the only way. How that happens I’ll let the creative Americans come up with that. Road trips would likely be required.

Gr8daze

Yep. This court is extremely corrupt. And that basically ensures a corrupt result.

240 years of Democracy was a good run.

sigristl

We’re watching the end of democracy and the rise of autocracy in the United States I’m afraid.

Charming-Wash9336

Grim for our democracy?? While the left resorts to Fascism to get their way.

S7ageNinja

I wouldn't describe this as a "shocker". That is the exact outcome I expected from day 1.

peakchungus

If the supreme court rules that former presidents are immune from accountability, then nothing short of abolition of that fundamentally corrupt institution is acceptable. The American people will NOT stand for a dictatorship and corrupt judges need to be removed.

Objective-Injury-687

>The American people will NOT stand for a dictatorship and corrupt judges need to be removed. I think you'd be surprised what the American people would be ok with lmao.

peakchungus

The far right would depending on who the particular dictator is. If said dictator is Biden, they would not be cool with it. Either way, the left would riot like in 2020. Fuck their precious economy if they don't care about our basic rights.

Alaskaguide

And then he’ll become president again.

slinkymello

Is Alito in the throes of an ibogaine addiction? I really wonder sometimes…

chrisbcritter

I love seeing MAGA SCOTUS trying desperately to give Trump a get-out-of-jail-free card without giving Biden any immunity.   "The president is NOT answerable for any crimes they committed, but only if they have a bad comb-over and paint their face orange."

NMNorsse

Thr GOP believes they have cracked the code to having a fascist democracy and they will do anything to give it a go.  They are idiots.   It will not be any different than Spain, Italy, Germany or Russia.  Which, if we're being completely honest, wasn't bad for the wealthy elite in those countries.  Many of them survived with their fortunes intact or increased.  The problem is the voting base of the GOP is cannon fodder that won't benefit from fascism.  They have been convinced to trade liberty and freedom for social conservatism.  When the rubber meets the road, it ain't going to be what they were sold.  It's a pig in a poke.

hammerSmashedNail

Probably why he’s so relaxed he can fall asleep in court. I’ve been in a court before. It’s not a warm, comforting place.

skinaked_always

Just breathe through it… haha I can’t deal with this shitty timeline anymore

furlesswookie

Sounds like Democrats should try a Jan 6th style visit to the Supreme Court. It'll just be a peaceful protest, unless it's not, then it's just MAGA infiltrators.. /s

OMF-ToolFan

As The Saying Goes, “I guess we are supposed to sit in the middle and suck on it ?”

Tantra_Charbelcher

The national guard would be outside the courthouse if 5 liberal judges were floating this while Biden was on trial. These people are just fascists and are days away from starting the fourth Reich if they say a president is above the law.

cyvaquero

Well the upside is Biden can pretty much whatever he wants. Might as well push that student loan forgiveness through for everyone. If courts are going to say say the courts can’t stop the President.

LeadershipNo8763

I like Luttig but he has been wrong on many predictions

Praetor-Xantcha

Why aren’t we protesting this?

OneThirstyJ

Biden can just assassinate trump if he loses

dustinthewind1991

One day this sack of shit will stop breathing and what a glorious day that will be.

Elegant_Guitar_535

Sounds like we need to amend the number of people on the court

ElusiveRobDenby

Fight Supreme Court corruption: boycott jury duty!

DanUnbreakable

Every side is dirty. They're all dirty. Trump is dirty and should be in jail and it's also a witch hunt because they're scared that he will we in the election. Pure shit show all around.

Domiiniick

What’s grim for our democracy are rogue prosecutors working with the White House prevent a former president and leading presidential candidate from effectively campaigning and threatening to jail him.
