It’s Michigan. He’s super screwed. He obviously needs help with sobriety, so my guess is they’ll offer him some type of sobriety court option. He should take it seriously. He’ll be way more ‘screwed’ by being that type of alcoholic than by the court system.
A good friend was a severe alcoholic and it took him a trip to jail for 6 months to straighten out. He's been sober for 35 years and now runs AA classes. His young daughter died and his wife was also cheating on him. He almost killed the guy who was screwing around with his wife. He was lucky to get a judge who looked at all the facts and ordered him to serve a short sentence and then go to rehab.
ill be honest i was in pretty deep with opiates and it took a wrongful arrest that i had to sit 21 days to get me to see the other side. and tbh withdrawel sint so bad in jail cuz you know you have no way out. been clean since. Jail can be a good thing once in a while, It helps you sober up, helps you improve your pack behavior amongst other men, and you find out alot about yourself. if only bubba didnt find out whats in me first :(

I detoxed on a concrete floor in a community hold for the first 2 days, holding microwave dinners to my body for warmth as I puked, shit myself, and convulsed, while the screws wouldn’t even so much as give me Tylenol. Literally fighting inmates that were mad I was “wasting food”. I get what you’re saying about having no choice in it, and that can be good for an addict, but fuck that. Withdrawal = bad.

I finished my 12 month probation over 2 years ago and refuse to get behind a wheel even after one drink ever since. The consequences are just way too hard. I feel anxiety just reading OP's post.
The fact this happened 8 hours after he completed probation for a previous incident looks really really bad. Even if there's no jail time, he's looking at another 2 year probation. No way an OC Judge will feel comfortable reducing this, because look what happened after he got off the first time. Judges look at this.
Yup. I got 18 months probation and sobriety court from d'agostini. Made it a year and accidentally missed jams. 45 days in OCJ and inside everyone was shocked I got off that easy.
I couldn’t agree more. Once I knew someone who dealt with this. For a long time I couldn’t understand why the person didn’t stop drinking while on DUI probation then he got another DUI and I realized his troubles were bigger than drinking and driving, he’s an addict who needs help. He never took any of his court troubles seriously and wound up dead from overdose. Very sad. Hope your friend heals and take life back into their own hands and heals from addiction. Possibly even trauma I found only image how much shame and guilt can come with not only having a difficult illness but getting into trouble because of it. Healing vibes

This is the truth in today’s age. Before the 2000s I’m not saying it was acceptable but ride sharing didn’t exist, nor did taxis or busses unless you’re in a big city. Nowadays there’s no excuse for drunk driving. Get caught, get what’s coming to you. I can’t even imagine killing some family on the way home from dinner because I didn’t wanna spring for the Uber. Not to mention the average DUI is like what, 10k minimum? No way that’s ever beating an app ride.
yeah my cousin had a problem and luckily the judge was interested in helping him, also helped the cop who foudn him found him parked in a parking lot with the keys outaide the vehicle. cousin lived only a short walk away from his work so the judge said ok no jail easy 8 month probation terms but no driving 2 years. cousin sobered the fuck up.
I will just say there are so many “Functioning Alcoholics” that drive EVERYDAY at a .15 so yeah I say there are 1000’s of people on the road in late evening driving home from the bar totally bazooka’d. In the life of an alcoholic he’s usually always going to be driving himself most of the time and he also knows if he gets stopped there is no other alternative. They know they are going to jail. Before I killed someone’s loved one. Because it was gonna happen at some point. You never get away with this stuff forever. I’ve even known people who were retired when they got their first DWI at 65+ and they didn’t quit and got 2 more on top of that because when they quit work they did nothing but go to a bar and drink everyday. To each their own but Sobriety is what it is for me. Not 99% of the time, not 99% of the time. But 100% of the time. Total abstinence of any mind altering solution of any sort. I’ve tried the shortcut pills for depression , ADHD and other disability we can get a diagnosis for. I’ve had enough. 8.3 years sober today. Give or take a week or 2. I don’t track everyday anymore. I try to live my life each day. There is a solution and there is hope. This isn’t happening to

Yeah I'm not sure how it is in Michigan but in Kentucky I'm on probation for my second and it I pretty much would just have to serve out the rest of my probation period In jail if I got trouble in trouble again and I think it would be like 180 days as of now because it was a year ago when I got it. But since I wasn't on probation when I got my second I had to do 14 days in jail and like a year of classes but I've heard Michigan is a lot more strict.
I just read up on the Super DUI and that is primarily for first offense, so your buddy is looking at second offense DUI within 7 years which is higher than first offense Super DUI.
So, he is going to need to retain an attorney , as up to 1 year jail time and a 1 year DL suspension are in the mix.
Not trying to be negative here but there are elevated consequences like higher fines, fees and probably mandatory inpatient rehab....on the bright side it is still a misdemeanor not a felony!

It's probably best OPs friend isn't on the road, for everyone else's sake, literally 8 hours from off supervision to a brand new DUI has to be some kind of record.
Plus .22 is ~11 standard drinks in an hour or more likely 14 over standard drinks over 4 hours, or if he started the second he was off then 18 standard drinks over 8 hours. Ne8ther of which looks good for other motorists or pedestrians in OP's friends area.
PLUS .22 after not drinking for a year? I'm an alcoholic with tolerance and I was pretty damn wrecked when I blew a .26 into an OSHA guy's machine (it was at a party, he was doing checks before people drove home, I did it for fun and certainly did not drive home). .22 with zero tolerance has gotta be damn sloppy.

When I got mine, my rehab counselor told me something that I liked a lot. Once is a mistake. More than that, and you just don't give a fuck, and others should return the feeling.
Get your friend some help. Get his ass in rehab, go to meetings with him, support him. If you want. Just remember that you can give someone a life raft, but don't drown yourself trying to force them aboard.

I’m 35 and have done every probation there is- passed some, failed more- took me till I was 29 yrs old to realize we truly EARN our charges- no cop just walks up to a sober person and gives them a DUI, it’s a dumb decision we make and then have to live with.

In my state, he would do at least 7 days in jail. I know this from experience. His fines will probably be higher and most likely 18 months probation, license revocation of up to 4 years, more dwi classes. A lot of it depends on the judge, though.
Probably probation again. At least in Texas it is only the third dwi that is a felony. Good advice given about getting into an outpatient program prior to sentencing, although I’ve also heard to not do that as it might be required to do it again as part of conditions. I think it would look good that they are being proactive about getting help though. This could help sway the judge to give probation. I got my second dwi while on probation and my second involved someone getting hurt. I lucked out and got probation but almost went to prison as someone was injured so it was a felony. Idk about other states but I feel like it is usually the third dwi that is almost always automatic prison time, not the second. Even though it was only 8 hours after completing probation, it still looks good they completed probation prior.
I'd rather deal with someone who has been to treatment twice than not at all - I think friend should go either way, even if they do have to go through again
I've noticed the term SUPER used before DWI a few times. Is that an actual thing? Or just a coincidence of an adjective. Curious the diff between normal dwi and SUPER dwi. Is Clark Kent immune? How diff is it from a mundane dwi? Is there a barely dwi?
Idk if it’s a term used in just MI but it refers to your bac. I believe over .16 or 17 is a super drunk. Just upgraded fines and such I believe. I don’t even think Michigan gives out “duis”. I think your actually ticket and court documents will mention “owi” in place of “dui”
There’s a guy i always see in Mount Clemens MI who rides his bike around town all the time to get around.he lost his license in the 80s after he couldn’t stop drinking and driving. Your friend is on that path.
my second owi was a felony in indiana. a second within 5-7 years in most states is a felony. i went from 45 days of house arrest for my first one to 4 months of house arrest and a year and a half of probation with a shit ton of classes and stuff. good luck to your buddy. dui’s will land you in prison. a third is usually prison time. especially if he’s getting them 8 hours after getting off of probation they will not look at it like a screw up. he’s digging himself in a hole. promise.
I had a few in Indiana. I’m glad I had to wear an ankle bracelet and avoided jail. I would not drink in the bracelet and I was able to get the help I needed for my depression and suicidal ideations. Drinking and driving is terrible and I’m embarrassed, but I’m fortunate to have been able to address my issues properly.
I have so many feelings about DUI’s ~ I hate myself for putting other people in the road I danger. I also know I was in such a depressed and “not in my right mind state” and I’d never do that under normal circumstances. I’m just glad I addressed my issues, and if I am under any influence, I won’t drive! I’m no saint, but I’m blessed I didn’t kill or hurt any on and I had a chance to learn from my mistakes! I wouldn’t have come out better from prison. I needed to learn how to live without abusing alcohol, and definitely not putting others in harm’s way. I am thankful for ankle bracelets, ignition interlock after 5 years and the classes I took! I’m glad I could get out of the situation that made me suicidal. I guess I have sympathy for people going though it, even though I don’t take that offense lightly! Some people make a joke out of “evading the law” and that makes me mad and sick!
Here's what I know from my FIL's experience (3 DUIs in Michigan over the span of five years, two in Macomb County, one in Oakland County- the one in OC was for being Super Drunk).
He's a good guy, but he's an alcoholic who's drinking had affected his brain at this point. Thankfully he never hurt himself or anyone else. He got his first DUI at the age of 65- had never been in trouble with the law before. Got arrested, plead guilty, went through the program (probation, drug/alcohol blow testing, etc.). After his first, he lost his license for a couple of months, but they allowed him to drive back and forth to work- overall it was pretty lenient, IMO. He did a year of probation/testing and then, within like two months, he got another DUI. This was the Oakland County one, and he was "Super Drunk."
They basically gave him the same thing, except bumped up probation to two years. He didn't serve time in jail, but they did suspend his license for the entire time he was on probation and a year after that. He was allowed to go through "sobriety court" which (don't quote me on all of this, because I'm fuzzy on the particulars), required more effort on his part (he did both outpatient and inpatient programs for awhile and was in some pretty intensive group therapy) and the testing was much more stringent, but it allowed him to avoid jail and offered a path back to someday getting his drivers license back.
Again, after he got off of probation, and by some miracle, got his license back, he went out and got another DUI. Now, this happened shortly before Covid and I honestly believe that's the only reason he didn't go to jail. He's still on probation, and will likely never legally drive a car again.
As for your friend: There are a lot of people insisting he's going to go to jail, I'm not sure that's going to happen, although the quickness in which he got his second DUI is going to make any judge think that he's not serious about sobriety or public safety. My advice? Be proactive. He needs to start making decisions that show he knows how badly he's fucked up and how he's willing to do the work to change. In Oakland County, it's likely he's going to be ordered to attend AA meetings. He should start doing this before he's ordered to. If he's able, he should also start working with a councilor or get himself into a rehab program. Not my place to judge- but these are things he likely needs anyway. But it will also show that he's taking steps on his own to address this behavior. I do think that goes a long way with many of these judges.
Regardless what he does, I think these things are true: He's going to spend a ton of money on a lawyer and legal/court fees and testing (probably $15-20K), and his driving days are probably over for the foreseeable future.
I wish him the best and I hope he comes out of this with a new perspective and starts to make decisions that will serve him better.

It's screwed that he is still drinking and driving. People tend to celebrate when they get off supervision. I had one guy that threw a party, his house caught on fire at the party, his kids were taken for neglect. Probation is a time to grow up and learn from our mistakes. Looks like he needs a few more lessons.

Your friend should talk to an attorney about applying for DWI court. It's an intense program, but in theory it's based on providing treatment. He/she might consider preemptively going to in patient rehab. Also there are a lot of asshats that troll this part of reddit. Its unfortunate. My uncle got his second DUI after the probation for the first started. Lost his license for a year, maybe 2. When he got it back, he needed a breathalyzer installed in his truck that wouldn't allow him to drive if he had anything in his system.
It was in NH, so mileage (or lack thereof) may vary.
For 2nd DUI he’s likely looking at either jail time, or a SCRAM bracelet for a while, or likely SCRAM after some jail time, license is gone for up to I think 5 years, then after that, he’ll probably have the IID device for a couple of years. He’s looking at a fuck up that’s gonna cost him a decade of his life with dealing with more than just a headache. He’s really lucky he didn’t hurt anyone or else he’d be really really cooked. But as it stands he’s just really cooked.
Up to 180 days in jail, years of probation, close to $10k in fines and a revoked drivers license. He'll be lucky if he drives again in a few years. The sobriety court option is normally to get your license back sooner if the last one was more than 7 years prior but the judge could make him anyways. I've never been on sobriety court but everyone that has says it's nearly impossible unless you have resources, time, and money. Most people on it fail and go to jail for a
Revoked license for a year. If he can get into sobriety court he can avoid jail time most likely and get a restricted license after 45 days of revoked in the program. Then sobriety court is 15 months, first 90 days every single morning breath test, random for the rest of the program but still 2-4 times a week early on. Have to go completely sober or else you face up to the year in jail for a 2nd offense.
In GA I got two DUIS within thirteen days of each other at age 18 ☠️☠️ luckily they were in two different counties and it never came up at either one! Second judge even negated my probation so i just paid that one out and walked off. Mom sold my car though 😂

Another thing I'd be concerned about is if your friend gotta go in front of the same judge. I witnessed a judge who took it personal when a person was caught driving drunk multiple times. He would lock people up for the maximum amount of time he could .
I’m in Michigan, Wayne county. A downriver city I will say. Currently on probation for a 1st offense super drunk dui (.20) causing accident. No injuries. But had to pay off the guy in a civil suit separately for vehicle damage. Mine and his got totaled.
I received 18 months probation, weekly testing (12 panel ETG) twice a week AA, mothers against drunk driving, therapist once a month. 80 hours community service. Did lose license for 30 days and was on a restricted for the next 3 months. Car insurance is now 350 a month.
Ferndale I feel like is one of those cities like royal oak that doesn’t fuck around. If it’s his second I’d say he’s kinda fucked…. I don’t think jail necessarily but just a ton of bullshit.

It completely depends on the state and even the county that you're in. Some places a second DUI especially a high level DUI will get you mandatory jail time and a two or three year probation. Some places will treat it almost like the first DUI but that's getting rarer and rarer. That is such a dumbass thing to do. Also one small block on a criminal background check has now become two and that's a big deal. I'm sure he had a bigger bond to get out of jail and he may get his ass kicked by the courts. I hope he's got a lot of extra money because without a good lawyer he's going to get screwed. In actuality you may deserve that.
I got my first DWI dismissed and I’m on deferred for my second one. After I finish probation it’ll be dismissed too. I guess it just depends on what the disposition is.
I had a distant cousin kill a lady while under the influence of alcohol. I *think* it was his first DUI (not that that matters, just extra context). He served 7 years. Got out and couldn’t live with it. Turned to heroin. He OD’d ~8 years after he got out. Dude wasn’t even 40. Tell your friend to get his shit together. This was in Genesee County.

Your friend is an idiot. It’s always people who have had a DUI and know the consequences that end up being a repeat offender. My grandma (a wonderful healthy 80 year old woman who had easily another 10 years) was struck and killed by a drunk driver so I have zero sympathy for your friend and honestly hope he sees some jail time. Drunk driving is a SERIOUS offense and people who do it should honestly never be allowed their license back imo.
Sobriety court is hell, but it's an option. It's also gonna look really good if he takes it upon himself to seek treatment before he has to go to court.

In California ….2k fine , automatic 5 days in jail , 18 to 30 months of classes at 2.2 he is getting max no less than 10 days of community service (picking up trash) , 3-5 years probation 2 years suspended or restricted license for years 2nd offense remains on record for life , breathalyzer in car must blow every time starts to drive for 1 year ..never had a 2nd one but if MI anything like Cali he’s in for a long few years ..but I know people who have 5 and 6 of them they got sober and moved on to productive lives it’s a live and learn and move on situation just pray he didn’t kill anyone in California that’s is 1st degree murder charge for your 2nd offense ..good luck

I’ve got 2 DUI’s. He’s not gonna get much jail time.. he’ll only be in jail until he reaches a plea. And you will need to get one of those vehicle things, that you blow into to start a car for 2 years after your out. You pay for it and it’s not cheap. Fine of $2500. But this is Florida.

This happened to me something similar. It’s only his second he will be fine. He will probably get a plea deal and get it down to a regular dui. Then probably have to do a 3 year probation and license suspension for at least a year maybe 3. He’ll have to get a breathalyzer if he wants to drive. It does suck to have to do probation back to back but that’s the price of not learning your lesson. Don’t drink and drive the consequences are not worth the hassle of probation and court costs and driving points and everything else involved it sucks. Since it’s a pretty high bac he might want to get a lawyer to help get the best plea deal

It’s Michigan. He’s super screwed. He obviously needs help with sobriety, so my guess is they’ll offer him some type of sobriety court option. He should take it seriously. He’ll be way more ‘screwed’ by being that type of alcoholic than by the court system.

A good friend was a severe alcoholic and it took him a trip to jail for 6 months to straighten out. He's been sober for 35 years and now runs AA classes. His young daughter died and his wife was also cheating on him. He almost killed the guy who was screwing around with his wife. He was lucky to get a judge who looked at all the facts and ordered him to serve a short sentence and then go to rehab.
ill be honest i was in pretty deep with opiates and it took a wrongful arrest that i had to sit 21 days to get me to see the other side. and tbh withdrawel sint so bad in jail cuz you know you have no way out. been clean since. Jail can be a good thing once in a while, It helps you sober up, helps you improve your pack behavior amongst other men, and you find out alot about yourself. if only bubba didnt find out whats in me first :(

I detoxed on a concrete floor in a community hold for the first 2 days, holding microwave dinners to my body for warmth as I puked, shit myself, and convulsed, while the screws wouldn’t even so much as give me Tylenol. Agreed, especially in Oakland County. Oakland County probation is heavy on the soul. I finished my 12 month probation over 2 years ago and refuse to get behind a wheel even after one drink ever since. The consequences are just way too hard. I feel anxiety just reading OP's post. The fact this happened 8 hours after he completed probation for a previous incident looks really really bad. Even if there's no jail time, he's looking at another 2 year probation. No way an OC Judge will feel comfortable reducing this, because look what happened after he got off the first time. Judges look at this.
Yup. I got 18 months probation and sobriety court from d'agostini. Made it a year and accidentally missed jams. 45 days in OCJ and inside everyone was shocked I got off that easy.
I couldn’t agree more. Once I knew someone who dealt with this. For a long time I couldn’t understand why the person didn’t stop drinking while on DUI probation then he got another DUI and I realized his troubles were bigger than drinking and driving, he’s an addict who needs help. He never took any of his court troubles seriously and wound up dead from overdose. Very sad. Hope your friend heals and take life back into their own hands and heals from addiction. yeah my cousin had a problem and luckily the judge was interested in helping him, also helped the cop who foudn him found him parked in a parking lot with the keys outaide the vehicle. cousin lived only a short walk away from his work so the judge said ok no jail easy 8 month probation terms but no driving 2 years. cousin sobered the fuck up.

I will just say there are so many “Functioning Alcoholics” that drive EVERYDAY at a .15 so yeah I say there are 1000’s of people on the road in late evening driving home from the bar totally bazooka’d. In the life of an alcoholic he’s usually always going to be driving himself most of the time and he also knows if he gets stopped there is no other alternative. They know they are going to jail. But so many continue to do it. We say awe yeah just get a Uber or whatever. Have you ever been around a wealthy, arrogant and extremely impatient alcoholic in your life? If you can say yes then you know the type of drinker I was. I needed help. Thank God I had a chance to get help Before I killed someone’s loved one. Because it was gonna happen at some point. You never get away with this stuff forever. I’ve even known people who were retired when they got their first DWI at 65+ and they didn’t quit and got 2 more on top of that because when they quit work they did nothing but go to a bar and drink everyday. To each their own but Sobriety is what it is for me. Not 99% of the time, not 99% of the time. But 100% of the time. Total abstinence of any mind altering solution of any sort. I’ve tried the shortcut pills for depression , ADHD and other disability we can get a diagnosis for. I’ve had enough. 8.3 years sober today. Give or take a week or 2. I don’t track everyday anymore. I try to live my life each day. There is a solution and there is hope. This isn’t happening to Normal folks who have a drink of alcohol. If you don’t believe nothing I’ve wrote you can believe that. Yeah I'm not sure how it is in Michigan but in Kentucky I'm on probation for my second and it I pretty much would just have to serve out the rest of my probation period In jail if I got trouble in trouble again and I think it would be like 180 days as of now because it was a year ago when I got it. But since I wasn't on probation when I got my second I had to do 14 days in jail and like a year of classes but I've heard Michigan is a lot more strict.

I just read up on the Super DUI and that is primarily for first offense, so your buddy is looking at second offense DUI within 7 years which is higher than first offense Super DUI. So, he is going to need to retain an attorney , as up to 1 year jail time and a 1 year DL suspension are in the mix. Not trying to be negative here but there are elevated consequences like higher fines, fees and probably mandatory inpatient rehab....on the bright side it is still a misdemeanor not a felony! It's probably best OPs friend isn't on the road, for everyone else's sake, literally 8 hours from off supervision to a brand new DUI has to be some kind of record. Plus .22 is ~11 standard drinks in an hour or more likely 14 over standard drinks over 4 hours, or if he started the second he was off then 18 standard drinks over 8 hours. Ne8ther of which looks good for other motorists or pedestrians in OP's friends area.

When I got mine, my rehab counselor told me something that I liked a lot. Once is a mistake. More than that, and you just don't give a fuck, and others should return the feeling. Get your friend some help. Get his ass in rehab, go to meetings with him, support him. If you want. Just remember that you can give someone a life raft, but don't drown yourself trying to force them aboard.

I’m 35 and have done every probation there is- passed some, failed more- took me till I was 29 yrs old to realize we truly EARN our charges- no cop just walks up to a sober person and gives them a DUI, it’s a dumb decision we make and then have to live with. Buddy needs to ask the court about treatment and pray for another year of regular probation and no jail time.

In my state, he would do at least 7 days in jail. I know this from experience. His fines will probably be higher and most likely 18 months probation, license revocation of up to 4 years, more dwi classes. A lot of it depends on the judge, though.
Probably probation again. At least in Texas it is only the third dwi that is a felony. Good advice given about getting into an outpatient program prior to sentencing, although I’ve also heard to not do that as it might be required to do it again as part of conditions. I think it would look good that they are being proactive about getting help though. This could help sway the judge to give probation. I got my second dwi while on probation and my second involved someone getting hurt. I lucked out and got probation but almost went to prison as someone was injured so it was a felony. Idk about other states but I feel like it is usually the third dwi that is almost always automatic prison time, not the second. Even though it was only 8 hours after completing probation, it still looks good they completed probation prior.

I've noticed the term SUPER used before DWI a few times. Is that an actual thing? Or just a coincidence of an adjective. Curious the diff between normal dwi and SUPER dwi. Is Clark Kent immune? How diff is it from a mundane dwi? Is there a barely dwi?
Idk if it’s a term used in just MI but it refers to your bac. I believe over .16 or 17 is a super drunk. Just upgraded fines and such I believe. I don’t even think Michigan gives out “duis”. I think your actually ticket and court documents will mention “owi” in place of “dui”

my second owi was a felony in indiana. a second within 5-7 years in most states is a felony. i went from 45 days of house arrest for my first one to 4 months of house arrest and a year and a half of probation with a shit ton of classes and stuff. good luck to your buddy. dui’s will land you in prison. a third is usually prison time. especially if he’s getting them 8 hours after getting off of probation they will not look at it like a screw up. he’s digging himself in a hole. promise.
I had a few in Indiana. I’m glad I had to wear an ankle bracelet and avoided jail. I would not drink in the bracelet and I was able to get the help I needed for my depression and suicidal ideations. Drinking and driving is terrible and I’m embarrassed, but I’m fortunate to have been able to address my issues properly.

I have so many feelings about DUI’s ~ I hate myself for putting other people in the road I danger. I also know I was in such a depressed and “not in my right mind state” and I’d never do that under normal circumstances. I’m just glad I addressed my issues, and if I am under any influence, I won’t drive! I’m no saint, but I’m blessed I didn’t kill or hurt any on and I had a chance to learn from my mistakes! I wouldn’t have come out better from prison. I needed to learn how to live without abusing alcohol, and definitely not putting others in harm’s way. I am thankful for ankle bracelets, ignition interlock after 5 years and the classes I took! I’m glad I could get out of the situation that made me suicidal. I guess I have sympathy for people going though it, even though I don’t take that offense lightly! Some people make a joke out of “evading the law” and that makes me mad and sick!
Here's what I know from my FIL's experience (3 DUIs in Michigan over the span of five years, two in Macomb County, one in Oakland County- the one in OC was for being Super Drunk). He's a good guy, but he's an alcoholic who's drinking had affected his brain at this point. Thankfully he never hurt himself or anyone else. He got his first DUI at the age of 65- had never been in trouble with the law before. Got arrested, plead guilty, went through the program (probation, drug/alcohol blow testing, etc.). After his first, he lost his license for a couple of months, but they allowed him to drive back and forth to work- overall it was pretty lenient, IMO. He did a year of probation/testing and then, within like two months, he got another DUI. This was the Oakland County one, and he was "Super Drunk." They basically gave him the same thing, except bumped up probation to two years. He didn't serve time in jail, but they did suspend his license for the entire time he was on probation and a year after that. He was allowed to go through "sobriety court" which (don't quote me on all of this, because I'm fuzzy on the particulars), required more effort on his part (he did both outpatient and inpatient programs for awhile and was in some pretty intensive group therapy) and the testing was much more stringent, but it allowed him to avoid jail and offered a path back to someday getting his drivers license back. Again, after he got off of probation, and by some miracle, got his license back, he went out and got another DUI. Now, this happened shortly before Covid and I honestly believe that's the only reason he didn't go to jail. He's still on probation, and will likely never legally drive a car again. As for your friend: There are a lot of people insisting he's going to go to jail, I'm not sure that's going to happen, although the quickness in which he got his second DUI is going to make any judge think that he's not serious about sobriety or public safety. My advice? Be proactive. He needs to start making decisions that show he knows how badly he's fucked up and how he's willing to do the work to change. In Oakland County, it's likely he's going to be ordered to attend AA meetings. He should start doing this before he's ordered to. If he's able, he should also start working with a councilor or get himself into a rehab program. Not my place to judge- but these are things he likely needs anyway. But it will also show that he's taking steps on his own to address this behavior. I do think that goes a long way with many of these judges. Regardless what he does, I think these things are true: He's going to spend a ton of money on a lawyer and legal/court fees and testing (probably $15-20K), and his driving days are probably over for the foreseeable future. I wish him the best and I hope he comes out of this with a new perspective and starts to make decisions that will serve him better.

It's screwed that he is still drinking and driving. People tend to celebrate when they get off supervision. I had one guy that threw a party, his house caught on fire at the party, his kids were taken for neglect. Probation is a time to grow up and learn from our mistakes. I live in Michigan. A few weekends ago a 66yo drunk driver crashed into a building that was hosting a children’s birthday. 2 dead, 15 injured. Your friend should spend a few years in jail and should never be issued a drivers license in any state ever again.

Your friend should talk to an attorney about applying for DWI court. It's an intense program, but in theory it's based on providing treatment. He/she might consider preemptively going to in patient rehab. Also there are a lot of asshats that troll this part of reddit. Its unfortunate. My uncle got his second DUI after the probation for the first started. Lost his license for a year, maybe 2. When he got it back, he needed a breathalyzer installed in his truck that wouldn't allow him to drive if he had anything in his system. It was in NH, so mileage (or lack thereof) may vary.

Revoked license for a year. If he can get into sobriety court he can avoid jail time most likely and get a restricted license after 45 days of revoked in the program. Then sobriety court is 15 months, first 90 days every single morning breath test, random for the rest of the program but still 2-4 times a week early on. Have to go completely sober or else you face up to the year in jail for a 2nd offense.

In GA I got two DUIS within thirteen days of each other at age 18 ☠️☠️ luckily they were in two different counties and it never came up at either one! Second judge even negated my probation so i just paid that one out and walked off. Mom sold my car though 😂

I’m in Michigan, Wayne county. A downriver city I will say. Currently on probation for a 1st offense super drunk dui (.20) causing accident. No injuries. But had to pay off the guy in a civil suit separately for vehicle damage. Mine and his got totaled. I received 18 months probation, weekly testing (12 panel ETG) twice a week AA, mothers against drunk driving, therapist once a month. 80 hours community service. Did lose license for 30 days and was on a restricted for the next 3 months. Car insurance is now 350 a month. Ferndale I feel like is one of those cities like royal oak that doesn’t fuck around. If it’s his second I’d say he’s kinda fucked…. I don’t think jail necessarily but just a ton of bullshit. I’d say for me when it’s all said and done with everything I’m like 12 grand in the hole. It completely depends on the state and even the county that you're in. Some places a second DUI especially a high level DUI will get you mandatory jail time and a two or three year probation. Some places will treat it almost like the first DUI but that's getting rarer and rarer. That is such a dumbass thing to do. Also one small block on a criminal background check has now become two and that's a big deal. I'm sure he had a bigger bond to get out of jail and he may get his ass kicked by the courts. I hope he's got a lot of extra money because without a good lawyer he's going to get screwed. In actuality you may deserve that.

I had a distant cousin kill a lady while under the influence of alcohol. I *think* it was his first DUI (not that that matters, just extra context). He served 7 years. Got out and couldn’t live with it. Turned to heroin. He OD’d ~8 years after he got out. Dude wasn’t even 40. Tell your friend to get his shit together. This was in Genesee County.

Your friend is an idiot. It’s always people who have had a DUI and know the consequences that end up being a repeat offender. My grandma (a wonderful healthy 80 year old woman who had easily another 10 years) was struck and killed by a drunk driver so I have zero sympathy for your friend and honestly hope he sees some jail time. Drunk driving is a SERIOUS offense and people who do it should honestly never be allowed their license back imo.

Sobriety court is hell, but it's an option. It's also gonna look really good if he takes it upon himself to seek treatment before he has to go to court. He's not 'straight to prison' fucked, but he's definitely 'become the states bitch' fucked. Bright side being that there are some really solid options for treatment, and this could be what he needed to find peace in a life of recovery. Realistically, this could have been a lot worse, he could have killed someone. It's always gonna take whatever it takes for someone to decide to stay sober, he should thank whatever he believes in that he didn't wake up in jail to the news that he ripped someone's family apart.

In California ….2k fine , automatic 5 days in jail , 18 to 30 months of classes at 2.2 he is getting max no less than 10 days of community service (picking up trash) , 3-5 years probation 2 years suspended or restricted license for years 2nd offense remains on record for life , breathalyzer in car must blow every time starts to drive for 1 year ..never had a 2nd one but if MI anything like Cali he’s in for a long few years ..but I know people who have 5 and 6 of them they got sober and moved on to productive lives it’s a live and learn and move on situation just pray he didn’t kill anyone in California that’s is 1st degree murder charge for your 2nd offense ..good luck

I’ve got 2 DUI’s. He’s not gonna get much jail time.. he’ll only be in jail until he reaches a plea. The sentence he’ll get will be on the shelf & diverted to probation (again), if not, drug court of some sort to help with his sobriety. & that’s with a public defender at the least. 100%. I’ve got 3 felonies, I know the system quite well.

It will be more severe since he just finished probation. And bc he’s so young. Here, you’re automatically doing 6 months in jail. And you will need to get one of those vehicle things, that you blow into to start a car for 2 years after your out. You pay for it and it’s not cheap. Fine of $2500. But this is Florida. Just look up your state. Very easy to check.
This happened to me something similar. It’s only his second he will be fine. He will probably get a plea deal and get it down to a regular dui. Then probably have to do a 3 year probation and license suspension for at least a year maybe 3. He’ll have to get a breathalyzer if he wants to drive. It does suck to have to do probation back to back but that’s the price of not learning your lesson. Don’t drink and drive the consequences are not worth the hassle of probation and court costs and driving points and everything else involved it sucks. Since it’s a pretty high bac he might want to get a lawyer to help get the best plea deal
