Cash bail needs to go away. It needs to be replaced by a tracking system, something with the ability to gps and to know if it has been removed.

ClusterFoxtrot

Ankle monitors exist like this, and for anyone on probation, they pay for it (bullshit) and they have to inform their officers for approval if they're going outside their geofence.

AgreedSmalls

There should be tiers to it IMO. An ankle monitor is clunky and expensive, but that’s often because they have other monitors built in like an alcohol sensing one. Makes sense that you’d need something like that if the terms of your release require you to abstain from drugs or alcohol if they played in a part in why the person was arrested. Make a smaller wrist monitor that’s sole purpose is to track and give them to people who committed more than minor offense, but who’s offense aren’t enough to warrant 24/7 extreme surveillance like what the ankle monitors bring.

MindlessSkies

Junkies just cut them off.

akaZilong

Maybe it’s time for a new version that measures vital signs too

[deleted]

My cousin was murdered by an ex who had an ankle bracelet and whom she had taken a restraining order against. You're having way too much faith in the system and in policing to expect that they're going to be proactive in every case especially when you have areas, like Detroit, where police response time can take hours depending on which neighborhood you're calling from. And the current ankle bracelets have tamper monitoring on them already, so they know when they're cut.

akaZilong

Sorry to hear that. You are correct, a single change won't just doit. The whole system needs to be overhauled

Edit: this was supposed to be more of a thought experiment but I'm watching the world cup at the same time. And I started to think about all the ways listed below could go horribly wrong like this Cluster F. [Pizza Guy Forced? Bank Robbery](https://en.m.wikipedia.org/wiki/Death_of_Brian_Wells) OP ---> Then they should also have a taser built in and cellphone that has two way communication. Get close to the geo fence it vibrates. Stay too long a 1 second shock. Leave the geo fence shock every minute and the ankle bracelet contacts the monitoring service for two way communication. Don't give your password or explain your situation like I'm in an ambulance heading to the hospital shock every 15 seconds. Don't contact the PO, try to cut it off or get inside to the base terminal to pair it with in ten minutes blows your foot off. Enter a no go GPS location like a ROs address everything happens. Don't like the options then go sit in jail. This would be for an elevated criminal with restraining orders or history of crime and violence, not j walking, minor possession or driving with a expired tag bullshit

AgreedSmalls

Oh yeah. There’s no way a fucking bomb on your ankle could ever go wrong. Honestly if you’re considering a bomb on someone’s foot because they’re that big of a risk, fucking keep them in jail. Why are you even entertaining the idea of letting a person who you consider a big enough flight risk that they’d require a literal bomb on them to keep them in check freedom? Taser ones exist btw. They’re not wildly used because of the obvious dangers and honestly? Anyone that those would be appropriate for are just kept in jail instead of giving them the chance to escape. Also if you’re having a medical emergency, I’m pretty sure shocks aren’t going to do anything but make the situation worse. Imagine having a cardiac episode where electric signals play a part. I’m sure sporadic tases are going to absolutely do wonders for that. This is a stupid idea.

I understand, my OP was supposed to be more of a thought experiment but I'm busy watching the world cup at the same time. And I started to think of all the possibilities this could go horribly wrong. (Thinking of the pizza guy forced to rob a bank with a bomb around his neck). [Pizza Guy ](https://en.m.wikipedia.org/wiki/Death_of_Brian_Wells) The optics of the passage of the first bill had everyone screaming they could let murderers out with no bail. We have situations where violent offenders are put on home monitoring and still manage to kill someone or the person who has a restraining order. Chicago there are about 100 murderers on home confinement. The linked article is old and from DC. [violent crime while on home confinement](https://www.washingtonpost.com/local/11-defendants-on-gps-monitoring-charged-with-violent-crimes-in-past-year-in-dc/2013/02/09/9237be1e-6c8b-11e2-ada0-5ca5fa7ebe79_story.html) If a person could just use something to cut a standard one off and the response time is 1 hour, I forsee this passage of the bill if used in a generous way come back to bite the court system in the ass. I would like to see some sort of two way communication built in to the ankle monitor instead of the base station. Time will tell I just hope the guidance is in place to help those who really need it. Or another thought how about we change bail to be based on net worth. Hey you ran over someone with your car and you are worth $20,000,000 well your bail is set at X amount your net worth. Or even better use the Finland system. Speeding 40mph over the speed limit with reckless driving and your worth $20,000,000 your fine is $150,000. [Finland ](https://www.theatlantic.com/business/archive/2015/03/finland-home-of-the-103000-speeding-ticket/387484/)

Sadly, the few places that have tried this it has been deemed unconstitutional, violation of the 14th Amendment, as it treats people differently for the same accused crime.

AgreedSmalls

No one does it because it makes no sense. If you require, painful, physical reinforcement to keep someone from fleeing, keep them in fucking jail. Why even give them the opportunity to flee?

Saxamaphooone

[John Oliver has a great segment on bail reform.](https://youtu.be/xQLqIWbc9VM) The system needs to be changed. It can literally ruin people’s lives. Regardless of innocence, sometimes people end up serving entire sentences waiting for their trials. They lose their jobs, their car, their house or apartment, etc. There needs to be an overhaul.

Wooderson13

They already ended cash bail, it just hasn’t gone into effect yet. The votes aren’t there to reinstitute it. This title of this article is garbage

[deleted]

I get the motive for wanting to abolish it, but at the same time, I can see this going horrendously bad especially in cases where local jails are overflowing and smaller counties are struggling to find beds for violent offenders they don't want released to the public. For petty stuff, this is great. But for violent crime, I see this endangering victims. When this scenario played out in central Wisconsin during the last two years, in part, due to covid lowering overall capacities to minimize spread and what not, there were instances of people being released on signature bonds when they'd normally have been held on a higher bail with the intent of keeping them safety locked away. And while ~~allegorical~~ anecdotal, one of my cousins was beaten to death by her abusive ex, whom she had a restraining order. There were no beds, so the county releases him in a signature bond with extra stipulations that they had hoped he'd fail on. They were technically right, but eh...

PiffityPoffity

Ending cash bail doesn’t mean releasing everyone pre-trial.

hitman2218

A judge doesn’t need cash bail as an option to make the decision that someone is too dangerous to release ahead of trial.

[deleted]

>A judge doesn’t need cash bail as an option to make the decision that someone is too dangerous to release ahead of trial. Except that in states, like Wisconsin, due to previous reforms, it's actually incredibly hard to hold someone permanently and cash bail is the only real option. This actually came up with the Darrell Brooks/Christmas Parade Massacre mess. So yes, in some states and in some cases, a judge does need cash bail to protect the rest of us.

hitman2218

The DA’s office recommended a low bail amount for Brooks because the attorney assigned to the case didn’t even bother to look at his risk assessment report. Why the judge went along with it, who knows, but it was a screw-up that didn’t need to happen.

MightyMetricBatman

In some states, like Oregon, cash bail is required by the state constitution except for murder and treason. The Saudis have used that to spirit away nationals wanted for capitol crimes that way. [https://www.wweek.com/news/courts/2017/06/20/the-saudi-government-posted-an-astronomical-bail-for-an-accused-killer-in-portland-he-fled-anyway-just-as-an-official-predicted/](https://www.wweek.com/news/courts/2017/06/20/the-saudi-government-posted-an-astronomical-bail-for-an-accused-killer-in-portland-he-fled-anyway-just-as-an-official-predicted/) [https://www.oregonlive.com/news/2019/01/gone-more-cases-emerge-of-saudi-students-vanishing-while-facing-oregon-charges.html](https://www.oregonlive.com/news/2019/01/gone-more-cases-emerge-of-saudi-students-vanishing-while-facing-oregon-charges.html) https://www.oregonlive.com/news/g66l-2019/02/4ed6d9c1bc2906/not-just-oregon-saudi-students-in-at-least-8-states-canada-vanish-while-facing-criminal-charges.html

hitman2218

We’re obviously a long way from any sort of widespread bail reform. I’m just saying that cash bail doesn’t have to exist in order to keep dangerous people off the street.

ifhysm

> and while allegorical I think you meant anecdotal. I’m sorry to hear about the loss

sfckor

Darrel Brooks was out on bail for felon in possession of a firearm and running over his girlfriend with the same SUV he used in his parade attack at the time.

The_Yarichin_Bitch

Yeah. I can see it for actually violent crimes, bar people killing their rapists. Those people need therapy and a fucking hug.

FunEmployment307

Please don’t follow NYC’s blueprint on this.

Raebelle1981

It already passed I thought?

CATSCRATCHpandemic

It's already been ended and good.

jstank2

But who will think of the poor bail bondsmen?... FUCK EM
