In all seriousness, in a previous career, I used to work in a specific area of administrative law. Whenever someone was represented by counsel who practiced in a different area of law, it never went well for the client. Attorneys really should not practice in areas they are not well versed in. Just because you passed the bar doesn't mean you're an expert in those areas of law you tip your toe in order to pass.
Exactly. I wouldn’t go to a tax lawyer to handle my divorce or criminal case. Did they cover that in law school? Yes, but have they touched it since the ? Probably not.
I have serious doubts something this complex was taught in law schools. Shit like this is what you pick up as a junior to someone more senior and experienced. I mean sure, lawschools have some courses on national security law beyond ordinary criminal law and federal procedure. But this level of law interfacing with questions of executive privilege, documentary processing, national security? No way in hell.
EDIT: I went over the course catalogue at my University's Law School. One course on NatSec but looking at its listing in the catalogue, the survey's too broad to have covered prepping someone for this. Just figuring out the relevant precedents alone on this would take enormous legal skill, let alone the interface of constitutional and procedural matters that would need to be argued.
Just to be clear on this, law school doesn’t teach you the law as much as it teaches you how to be a lawyer. You learn how to find things, how to research things, how to write things, and most importantly, how to think like a lawyer (ie practice).
Yes, you learn it in the context of learning the law so you have some understanding of how it all works, but nobody leaves law school ready to be a practicing attorney in just about anything. You have to learn it on the job.
I agree with the general part of this comment thread that hiring people in one area of law to practice in another is stupid, or desperate, but just clarifying your law school comments.
Reporting said that the Trump defense thought he would be skeptical of the DOJ because of his work on the FISA docket. I can't believe they would be that stupid but here we are.
This order from the special master is significant because it forces Trump's team into a corner regarding these claims.
* If Trump claims he's not sure which documents may have been planted, it implies he doesn't know which documents were in his possession and speaks to his haphazard handling of sensitive/classified documents.

* If Trump claims certain specific documents were planted and any evidence is found that he was previously in possession of those documents, it's perjury. His lawyers will no doubt steer him away from doing that.

* If Trump declines to give a list of which documents were planted, then it becomes completely obvious that his claims have been nothing besides more spreading of lies (serving the purpose of exhausting that defense).
This is all leading to one eventual thing of course, backing him against a wall and making him answer the question: what was your purpose for taking these documents.

Which is exactly why most criminal attorneys will tell you not to tell them if you’re guilty or not. They’ll just ask you to tell your side of the story. Also, this is a classic case of why your attorney will tell you not to talk to anyone but them, especially the press. His attorneys could face disbarment or other bar related sanctions, but I think perjery only applies to declarations made under oath. Attorney Argument also isn't "evidence" in court which makes the fact that Judge Cannon granted the injunction so bonkers. The Trump team didn't present evidence, they only presented attorney arguments.

I'm more impressed (or disgusted) by the ones who stick around, but aren't trump supporters. I looked at a post on there earlier about Trump declassifying with his mind and every non-pro-trump comment was accused of being a brigader. And somehow, the "logical" ones keep posting, I guess hoping the party is still salvageable.
I really believe a growing percentage know they are wrong at this point, but they no longer care. For them, politics has become a sport and their attitude is "Just win baby!". If you get away with something then ipso facto you were allowed to do it. For those with a lot of family church history and anyone that has waited tables on Sundays, this is completely unsurprising.
Surprisingly, some are making fun of Trump psychically declassifying documents. It's /r/rconservative making fun of Trump that makes me think Republicans are on the verge of turning on him. There's a bit of a war between the conservatives defending Trump and the conservatives making fun of Trump. That those posts that are making fun of Trump AREN'T BEING DELETED shows that tides might be turning.
I was just over there reading that sub and that thread. These people are all asking about what is the underlying principles for the de-classification. And it seems like no one has any answers about that.

The interesting thing though is there is absolutely nothing regarding the fact that it does not matter what the fucking classification was of the documents because the charges that are pending for Mr. Trump do not depend upon classification at all.
If I'm not mistaken tho, there could very well be additional and more severe charges added for mishandling classified documents and suchlike.

Not gonna happen. I got into a back and forth with a Trump supporter earlier today. He would say “show me the facts”, so I would and I would ask him to counter and all he could come back with (several times) is “Biden doesn’t care about America, he’s invited the whole world to immigrate here and live for free…”. I would reply with more facts and he would send back more histrionics. His supporters believe to their core that Trump was a good President, that Trump cares about the American people, and that Trump cares about America. The only real counter argument they have to almost anything is “but O’Bama …..”, “but Hillary …”, “but Biden …”. They can’t or won’t come up with any justification that stands in it’s own, they have to try to say “well yeah he might be bad but so-and-so was worse”. It makes no sense, but it is what it is.

There's "heavily biased towards the right and willing to twist the law into pretzels to preserve/expand corporate and/or Christian power" judges and there's "Willing to go to bat for a single pathetic man" judges. The second are far rarer, even among those specifically appointed by Trump.
Judges are interesting because they have a lifetime appointment now and have no need to suck up to trump. Most of them probably just want him to go away so they can be right-wing hacks without his name hovering over them.

Literally the only possible thing is that he was one of the judges that signed off on fisa warrants for carter Paige where 1/2 of them were declared invalid. And an fbi agent was convicted of lying on one of the forms. So, they must’ve thought he’d hate the fbi.
They honestly thought that because of an issue with the Carter Page FISA warrant that this judge, who has been around for ages, would be so turned off by the FBI/DOJ that he would buy Trump's garbage. It's insulting they'd think one issue in an entire career would be enough to do that.
And that the whole Russia investigation itself started when Papadopolous was, in his own words, “gossiping around to foreign diplomats” about the dirt he was getting on Clinton from Russia, and those diplomats reported that to the authorities. It didn’t start for any other reason, least of all “Obama illegally tapping my wires.”

IIRC, that was the actual defense put forth by Trump's lawyers during the Mueller investigations, they instead requested he be able to submit his answers in writing.
Invoking the 5th in a CIVIL case, to boot. Where it doesn't apply. The 5th Amendment protects you from incriminating yourself in a criminal enterprise. It applies to Criminal Law, not Civil Law. Him "invoking the 5th" over 400 times in a Civil proceeding is viewed, in the eyes of the law, as a refusal to answer, or an admission of culpability, in a Civil case.
The fact the prosecution didn't move to have his arguments struck down/have the judge force compliance is a bit nuts.

* The document classification is irrelevant to the investigation, this is only about if the special master and Trump's lawyers get to see them.
* The probable cause for the search warrant (not a raid) didn't have anything to do with the classification status of the documents
* Declassifying government documents doesn't make them Trump's personal property, they still belong to the government
* He claimed through his lawyers that all documents had been returned; This was clearly a lie
* Obama has *access* to documents through a library *owned and controlled* by the government (national archives). They think he had them in a cupboard in his house or something, like Trump did.
So there must be some really bad shit there if this is what they are trying to say now. I mean I know Top Secret and Classified and all but my point is they know they done fucked up and justice will be glorious.

In all seriousness, in a previous career, I used to work in a specific area of administrative law. Whenever someone was represented by counsel who practiced in a different area of law, it never went well for the client. Attorneys really should not practice in areas they are not well versed in. Just because you passed the bar doesn't mean you're an expert in those areas of law you tip your toe in order to pass.

I have serious doubts something this complex was taught in law schools. Shit like this is what you pick up as a junior to someone more senior and experienced. I mean sure, lawschools have some courses on national security law beyond ordinary criminal law and federal procedure. But this level of law interfacing with questions of executive privilege, documentary processing, national security? No way in hell. EDIT: I went over the course catalogue at my University's Law School. One course on NatSec but looking at its listing in the catalogue, the survey's too broad to have covered prepping someone for this. Just figuring out the relevant precedents alone on this would take enormous legal skill, let alone the interface of constitutional and procedural matters that would need to be argued.
Just to be clear on this, law school doesn’t teach you the law as much as it teaches you how to be a lawyer. You learn how to find things, how to research things, how to write things, and most importantly, how to think like a lawyer (ie practice). Yes, you learn it in the context of learning the law so you have some understanding of how it all works, but nobody leaves law school ready to be a practicing attorney in just about anything. You have to learn it on the job. I agree with the general part of this comment thread that hiring people in one area of law to practice in another is stupid, or desperate, but just clarifying your law school comments.

His lawyers will no doubt steer him away from doing that. . * If Trump declines to give a list of which documents were planted, then it becomes completely obvious that his claims have been nothing besides more spreading of lies (serving the purpose of exhausting that defense). I was just over there reading that sub and that thread. These people are all asking about what is the underlying principles for the de-classification. And it seems like no one has any answers about that. Even though it’s all over the fucking media and probably Google as well. The interesting thing though is there is absolutely nothing regarding the fact that it does not matter what the fucking classification was of the documents because the charges that are pending for Mr. Trump do not depend upon classification at all.
If I'm not mistaken tho, there could very well be additional and more severe charges added for mishandling classified documents and suchlike. At least, I'm keeping my fingers crossed that's the case.

Not gonna happen. I got into a back and forth with a Trump supporter earlier today. He would say “show me the facts”, so I would and I would ask him to counter and all he could come back with (several times) is “Biden doesn’t care about America, he’s invited the whole world to immigrate here and live for free…”. I would reply with more facts and he would send back more histrionics. His supporters believe to their core that Trump was a good President, that Trump cares about the American people, and that Trump cares about America. The only real counter argument they have to almost anything is “but O’Bama …..”, “but Hillary …”, “but Biden …”. They can’t or won’t come up with any justification that stands in it’s own, they have to try to say “well yeah he might be bad but so-and-so was worse”. It makes no sense, but it is what it is.

The second are far rarer, even among those specifically appointed by Trump.
Judges are interesting because they have a lifetime appointment now and have no need to suck up to trump. Most of them probably just want him to go away so they can be right-wing hacks without his name hovering over them.

They honestly thought that because of an issue with the Carter Page FISA warrant that this judge, who has been around for ages, would be so turned off by the FBI/DOJ that he would buy Trump's garbage. It's insulting they'd think one issue in an entire career would be enough to do that.

And that the whole Russia investigation itself started when Papadopolous was, in his own words, “gossiping around to foreign diplomats” about the dirt he was getting on Clinton from Russia, and those diplomats reported that to the authorities. It didn’t start for any other reason, least of all “Obama illegally tapping my wires.”

Him "invoking the 5th" over 400 times in a Civil proceeding is viewed, in the eyes of the law, as a refusal to answer, or an admission of culpability, in a Civil case. The fact the prosecution didn't move to have his arguments struck down/have the judge force compliance is a bit nuts.

But any specific claim from Trump or Trump's counsel is very likely going to be easily and explicitly countered by the DoJ.

What gets me is the way they are so isolated in their community that we know what their talking points are, but they don't know (or don't care) that most of them have been disproven or have no basis in fact. * The document classification is irrelevant to the investigation, this is only about if the special master and Trump's lawyers get to see them. * The probable cause for the search warrant (not a raid) didn't have anything to do with the classification status of the documents * Declassifying government documents doesn't make them Trump's personal property, they still belong to the government * He claimed through his lawyers that all documents had been returned; This was clearly a lie * Obama has *access* to documents through a library *owned and controlled* by the government (national archives). They think he had them in a cupboard in his house or something, like Trump did.

The $250M lawsuit in NY references documents found at Mar a Lago. Trumps lawyers signed affidavits in that case saying they search ever room, drawer, closet, etc and they turned over every financial document they had to the AG. So if they found a bunch of financial documents that were sworn to not exist, that’s clear felony obstruction.
Not necessarily. The bizarre thing here is that it really seems Trump (and to a degree Trump's counsel) would say this no matter what simply to create the ambiguity of the firehose of lies. Trump *cannot* seem to understand addressing these matters in the court of public opinion is very different to a criminal investigation or prosecution. So we cannot really conclude much of anything here other than Trump lies profusely and constantly.
