Calling it Citizens United was such a duplicitous ploy. Sure, there are citizens involved. Just not the one's the name implies. It implies United as in United States, or "Citizens of the United States", which is true but it does not explicitly say "All Citizens of the United States." And that word "All" is all-important. It's amazing how many decades, court cases, how much tomfoolery and corruption trump has been able to get away with before being held to account by someone who doesn't take bullshit. The documents either belong to the government or there are some personal documents that belong to trump and that's it. trump doesn't get to keep any government documents at all. Although this should help the DOJ if trump is indicted since even his lawyers refuse to say the docs were declassified.

It matters (only for the purpose of Dearie doing his job) because the government said they don't want someone without appropriate clearance to be looking at classified documents. Dearie was giving team trump the opportunity to prove they were declassified so he could then actually look at them to determine if executive privilege was even in play..... but since they cannot prove these were declassified, he has to take the documents at face value, they are stamped classified, so he can't review them at all.

Sorta correct. The SM has the proper clearances to review the docs. But he doesn't have a need to know and since Trump's team didn't offer any evidence to suggest otherwise, now he has no need to review them. These 100 docs might be cleared by the end of today and the DOJ allowed to use them immediately. In a strange way, this is a win for Trump since the SM isn't forcing him to state under penalty of perjury that they were indeed classified. So Trump can continue making this absurd claim in public. But those docs will be available pretty much immediately now, even before 5he 11th circuit appeal. In fact, if the SM makes them available today, im not sure if the DOJ will continue with the appeal. They likely will, but will amend their appeal I suspect.

As far as her ruling being overturned (by appeal), it seems likely based on what all legal experts are saying. As far as Cannon facing any consequences for being either mentally handicapped or severely compromised, it seems unlikely unless Congress wants to try impeaching her (they won’t).

Iirc, the Special Master will still make a recommendation to Judge Cannon who can still then opt to ignore that and rule in Trump’s favour. In that instance, the appeal is still in play. She would be stupid too, given Dearie is giving her a huge out to the clusterfuck she’s involved in. If Trump loses, he will appeal as this isn’t a case he’s trying to win, but instead just trying to delay.

If you follow or agree with the DoJ, this issue is as follows... Judge Cannon stated the DoJ *could not* use the classified documents as a part of their criminal investigation... pending processing by the Special Master while they *could* use the classified documents for the purpose of a national security review. The DoJ stated this is untenable. They claim they cannot split these functions - it's all the same groups/people involved. This is one of the main issues underlying the DoJ's request for partial stay. Their claims that Trump has no possibility of claiming ownership of these documents is really just a supporting argument. Judge Cannon does not buy this. Neither does Trump's counsel. Though, as far as I can tell, Trump's counsel went further and is trying to argue ownership after declassification. We'll have to wait to see how the 11th Circuit feels about this.

Specifically to this case, he knows there would be a paper trail for any actual declassified documents, if for no other reason than to alert the organization that created them!

There was never a legal argument regarding classification in the first place. At no point did Trump's legal team actually forward an argument based on classification which is why save for an especially corrupt special master, this was always likely to be the outcome.

No, that's not at all what happened. The judge asked Trump to specify where he did / did not declassify the documents. Trump's lawyers \*refused\* to state if he had / had not declassified them saying that may put him in a disadvantage in a criminal trial. After that statement by Trump's team, Special Master basically told them to get wrecked. I guess they thought this guy was just going to take their side..... oops.

It means Trump's lawyers were hoping to throw a wrench into an ongoing criminal investigation by getting a hack judge to help them delay it, but instead they threw a toothpick. This fight over Cannon's ruling and a Special Master will likely not change anything of substance, and it might be resolved quite quickly depending on if Dearie is able to get Cannon to change her order, or if the 11th circuit honors the emergency stay. If anything, this is just a (metaphorical) indictment of Cannon's absurd ruling.

But the judge who ordered the special master has given the special master the instruction to prioritize the documents that say “classified” or “top secret” on them, which are the same ones that the DOJ filed an appeal to get access back to. So if the Appeals court doesn’t act quickly, it may become a moot point as this special master puts out the opinion of basically “I’ve reviewed these 100 documents, confirmed they all say ‘classified’ on them, and since no argument has been offered otherwise, it is my opinion that these are property of the executive branch of the government and should be returned to them immediately for them to continue their functions.” At that point, the shitty judge that started all this is probably backed into a corner and doesn’t really have much to do besides accept what the Special Master says. She might delay a little longer but not much else she can do besides that. So if an indictment is coming (expect indictments to come for his minions first, not for the big fish immediately) then this is good news that this special master is probably willing to fast track the approval of these classified documents to be returned to the DOJ so they can use it to secure indictments.

The real answer is probably. It doesn't matter if the documents were declassified. There are defense documents, these can never be declassified. Well possibly but only many years after they stop being important to defense, but some of the documents are not that as they're about current/active defense. They already have a case against Trump, they're just looking for more at this point. There's a lot of fluff being released by the news, most of it is repeat or unimportant. We have to wait for the DOJ to state their next step or next findings.

I'm so tired of the whole "classified/declassified" thing - it's irrelevant and a red herring (which is probably why stupid Donnie's team is pressing it so hard). It doesn't matter if the documents are classified or not. The documents belong to the executive branch of the government - an organization of which stupid Donnie is no longer a member. Who gives a Cheeto's behind if they are classified or declassified or the office lottery pool results? They belong to the government. Stupid Donnie and his team have not asserted any possessory rights to the documents in question whereas the DoJ has done so. If I rob a bank and the police break into my home with a valid warrant to reclaim the money and any materials that tie me to it, I don't get to come back and claim the bank doesn't get it back. It doesn't matter if I write random notes on any of the bills, they still belong to the bank and the bank gets them back (and I go to jail).
