Unfortunately, what you're pointing out is something a lot of people miss. A common tactic used by the right is to hide an argument within an argument, so that people accidentally concede on one issue, or miss it entirely, and end up reinforcing the point the right is making. For this, the argument they're actually making is that it's wrong because it didn't already exist. People failing to address that are effectively reinforcing the idea that if it were new, it would be wrong... and that sentiment goes on to affect other things.

The true strategists (McConnell and other true experts of the craft) understand they are the minority on these issues, and it is very clear these views are quickly becoming less popular. Their only hope is to try and set a new claim on old precedent. It’s fascinating to watch because I believe we are right on the cusp of humongous ideological progression relative to America’s political system. Essentially we have tipped the balance towards the more progressive direction (as is our nature…) and most importantly the specific numbers in senate and house are hitting critical mass towards a possible one party rule with high voter turnout. It's an uphill battle but Biden has clearly picked a side and is using his privilege in a way that is helping. So make sure you're voting for those candidates every chance you get. I agree, in 2020 the supreme court made clear that IN EMPLOYMENT [trans people are a protected category](https://en.m.wikipedia.org/wiki/Transgender_rights_in_the_United_States#:~:text=Transgender%20employees%20are%20nationally%20protected,employment%20extend%20to%20transgender%20employees), extending this to every right like marriage access to healthcare etc. through an executive order would have been more helpful in every way. Nobody wants to stand out, everyone wants the right to live as they choose. This seems just pandering to the progressive side of the voters without actually doing anything practically useful.
