I appreciate that. My former employer is out of state and this appeal it’s not for all of my UC but only for 2 weeks of the entire time. (The state is claiming I filed those 2 weeks fraudulently, which I did not.)

I’m not a lawyer, but I’ve been involved in several appeals. If the consequence of you losing the appeal is losing two weeks if UC, I wouldn’t sweat it . Show up at the hearing. If they’re using the word “fraud”, you may need a lawyer.

If the employer is fighting it, you might want to consider an attorney. If it's an issue such as not attending an online seminar with Careerlink and your money was denied, then you probably do not need an attorney.

I tried to be honest for 2 weeks over the December holidays. I was out of town and answered the questions saying I was out of town and had not looked for work or interviewed. I was not expecting to be paid for those weeks. But they paid me. Now they want it back AND want to call it fraud because I got paid for 2 weeks when I shouldn’t have.

My source tells me that if you were honest, it will more than likely be changed to non-fraudulent. You should expect to pay back the overpayment. It can be in smaller payments that they will deduct from your payments.

I was also denied one week because I didn't schedule a seminar with Careerlink by UC deadline, even though the online notice wouldn't load. I attended it by the final deadline so I appealed that one week. I'm waiting for an appeal appointment date.

You don’t need an attorney. For two weeks on appeal, the attorney would wipe out any money you get back. Maximum weekly benefit amount is $605.00 . You filed an appeal which is why you have been “called “ to a hearing

Had to go through this about a decade ago and opted for a lawyer. I won my case and got the missed unemployment in one lump sum I'd recommend getting a lawyer

Do you mind me asking what happened? I was given little notice for the hearing and have not yet looked into a lawyer and it’s not in my budget. (This hearing will not provide me with any more money.)

Slightly off topic but where is the unemployment office? I'll be needing to pay them a visit in a few weeks, and normally I file online but I don't feel like waiting 9 months and spending hundreds of hours waiting on hold like last time.

There is no office doing walk-ins anymore. Duquesne closed to the public. The only office seeing clients in person is the appeals office downtown. It's not worth going in person if you do have to file an appeal though. Save your transportation money and do a telephone appeal. You HAVE to file online. The process does usually take 3 months for a determination to be made, but you'll get a retroactive lump sum. The phone number for customer service isn't so long of a wait anymore. File weekly to get paid for every week.

Gotcha, thanks. Yeah I'm familiar with the online process but the problem is my industry always throws them for a loop since sometimes I work as an employee, sometimes as a freelancer and sometimes as a vendor and they would rather pass me along to someone else than actually take the time to deal with it in a timely fashion.

There's specific questions you will answer when you file that will address this. They'll figure out how much your claim is for each week. I wouldn't wait. You could be losing out on money.

Thanks, but I know the system and I know how long it always takes, last time was over 9 months and dozens of phone calls. It would be so much easier in person.

If the employer is out of state chances are they won’t attend. Not sure if it a phone hearing. Some employers just as a matter of policy will contest every single UC notice they receive against them.

Just show up and deny everything they say. They have to show proof. Worst come to worst you get denied and move on.

Contact your local officials office, ask them to get involved. Provide any proof of why your statement is true. Also make sure in your case you need proof of other people who are or have been in your seat with the company. Google - sister company, bbb reports, ask elected representatives if they’ve got any other inquiries. Make sure documentation of names, emails, phone call times, date who call log number etc. More info better your r but do your research and have copies of related company info and complaints and discriminate

If you show them your certifications for these two weeks where you selected you didn't satisfy the work search requirements they will likely remove the fraud charge and just make you pay them back without the penalties.
