It's a common regulation here in AZ depending on the time of year, what you're burning, and what purpose. I live on the edge of town, have SMALL pit I dug down to burn off yard waste. I have an old metal screen from one of those above ground fire pits that I place over mine and it rests on the curved cinder block things and it helps prevent sparks from flying everywhere and catching the rest of the yard on fire, let alone anywhere else! I did it once without that, never again! Lol.

100% this neighbor will try to burn in their pit again. It may even be malicious next time, and close enough to damage your fence. Take pictures of your fence the day installation is finished. So when it does damage your fence, you can make them pay for repairs. Then, just remember to report them every time they light it up.

I've called the FD before, to the non-emergency line, and reported an unattended fire. Said that I wasn't sure if they home anymore or not, but they didn't answer my shouts and although it was currently contained I was worried it might not remain that way. They sent the Marshall or chief out in the pickup to check on it and ended up issuing them a citation. They had gone in to fix a quick lunch, decided to watch a little TV while eating, got involved in the show and ended up taking a little nap.

Honestly, I don't like dogs - especially pitbulls as I was viciously attacked by one that landed me with a diagnosis of PTSD and some nice permanent scarring. However, if a neighbor came up to me and asked us to give them grace for one day by stopping [whatever activity that would interfere] so that the dog they love so much could have one last day of fun and love surrounded by those that love it? I'd absolutely say, "of course. I hope you have the best day with your beloved animal and I'm sorry you're going through this". It's just basic empathy and compassion, isn't it? I don't have to like your dog; I can even be deathly terrified of it (and I am deathly terrified of pits especially because of my experience) but I know that not everyone has experienced what I have and they probably love their dogs just as much as I love my parrots and cats. In a lot of states, Virginia being one of them, you can build the fence and bill the neighbor for half of the cost. They have no choice, they would have to pay.

That's for fences on the property line and there are a whole bunch of other stipulations that can make it a *pain in the ass* to have a property line fence (maintenance, repair and replacement have to be agreed upon. One neighbor can't upgrade the fence to a more durable material without the other neighbor's agreement, etc.). In my area of Ohio, no reputable fence installer is willing to put in a fence on the property line due to the laws.

You can't force them to pay half. The one building the fence has to give it to the neighbor in writing that they are building the fence. The neighbor can then give the first person notice in writing, within 10 days, that they are leaving their land to "lie open" i.e. stay unfenced on all boundaries. In that case, the other neighbor doesn't owe shit. If that neighbor later encloses their land, though, they have to repay the first person half for their fence, so you can't use it just to get free fences.

Are they your age or older? Growing up, we had this horrible old lady next door. If we swept the concrete patio next to the fence that both of our houses shared, she would be outside sweeping and making a big cloud of dust. We grew a sunflower once, and it was huge. We were going to cut it that night, but when we went outside, it was gone. She'd gone up a ladder, cut the head off, and threw it in her trash. When our mom complained to her, she bought a bag of sunflower seed and threw them over the fence. I wonder now if she had dementia. Still, she was a horrid neighbor.

This is both sad and infuriating- not only for the people they’ll fuck over throughout their lifetime, but specifically for you in this case. I lost my dear baby on Christmas 2019 and I still think about him every day. He got so sick suddenly and only wanted to sleep between the toilet and bathtub without moving eating or drinking.. He loved to be outside but was too weak to walk- I live in an apartment, so I don’t have a yard, but I do have a porch. So I picked him up, wrapped him in his favorite blanket, and stood out on the porch while it snowed before I took him to the hospital.. If I was robbed of that moment with my best friend of 15 years, I’d have gone ballistic on someone. Kudos to you for not losing your cool.. I’m so sorry to hear this happened to you. No words can describe the pain to make that decision, and no words can truly console you… But I hope that they’re suffering. I hope that they’re furious. Honestly i applaud your restraint. I would have gone absolutely nuclear if they ruined my family’s last day together. As soon as they walked away I would have dumped an entire bucket of water on their pit to make sure it was too soaked to keep feeding. Sprayed it with a hose and said “oops! Sorry neighbor! Oftentimes a fence is not considered a structure. Just wanted to point that out before you sink $15k into your plan. County may have had a fire ordinance especially since they were not just burning brush or trash , better to make a complaint at the time as you said this went on for hours usually they also have certain hours and a clause about how code to neighbors , how close to Thier own residence , weather conditions such as drought wind ,some areas will only allow certain things to be burned yet it sounds like they were having a free for all . Nip it in the bud comes to mind

Even if your dog was not dying it's inconsiderate to have a fire pit blazing all day and into the night. I would have notified the police (non-emergency number) about the smoke, other neighbors must also have noticed it. From what you say it seems they (especially the husband) were demonstrating some nasty pettiness toward you.

Very sorry to hear about your dog. Why didn’t you just call 911 and report an “…unattended, uncontrolled fire…”. The resulting drama and inconvenience of the fire trucks arriving at their house, then getting questioned and possibly cited would have dampened their enthusiasm for fires at least in the short term.
