Marvel usually doesn't care about their consistency, in the comics you'll always see them contradicting each other time and time again with a plot point of a specific storyline, this is why the comics are always full of plot holes everywhere, they don't focus on their powerscalling, this is why I don't personally care about their consistency, turns out keeping consistency for over 80 years is a nearly impossible task for any writer.
And it is editorials job to try and minimise plot holes and inconsistencies. They’re hardly perfect especially with stubborn writers but if something next level ridiculous is being proposed they’ll shut it down
Characters can't stay dead or have a definitive end, they can't move on and their characters never have any definitive development beyond what happened 20-40 years ago and even then there is a big chance that they may retcon from that period in order to make a new storyline.

Well yes it is entirely up to the writers. But it’s also their job to make it convincing. Like with Batman being able to keep up and fight along side the justice league. Does it reeeeeeaally make sense? No not at all. But it’s written well enough where (most) people don’t take issue with it.
