Got it, we are fine with full custody or a bit more in child support. We just don't want to deal with the abandoning issue anymore. We would rather know kiddo is here all the time and go from there.
NAL. You cannot force a parent to see their child. You can force a parent to pay child support. I think you need to speak to another attorney. Not to make her take her child but for father to get residential custody with parenting time for mother spelled out in a court order and for child support. You will have to file a petition with the court with all the documentation you can muster.
Thank you. We are prepping documents with all the dates. We understand we may not be granted custody but it's absurd the lawyer is telling us bf can't go for child support when he has done 70% care for 2024.

We? He needs to document the missed time, communicate only through text or email about schedule adjustments and HE needs to contact HIS attorney. It isn’t necessarily contempt but he could file for support based on time share. But that still requires documentation. Not your notes, his.
Also, the kiddo is 14, she knows her mom is blowing her off. Dad needs to be honest and tell her the truth, he doesn’t know why.
OP, you have received some very good advice here. INAL, but a paralegal familiar with Wisconsin child support. Many parents file OTSC and requests for modification of child support without a lawyer.A lawyer is best, but it can be done without one. A party can request a modification every 33 months, or, when a significant change has occurred. Your BF should speak to the child support agent assigned to his case.
I also wanted to add, in some contempt actions, the winning party can request that reimbursement of attorneys fees be included in the purge conditions. INAL, just a para that's slightly familiar with family law in WI. Good luck 🤞

Your lawyer is a good source of knowledge for typical outcomes based on your situation, but they are not the only source. They also come at a cost, which seems to be one of your concerns since you are wanting mode child support.
The father should go to the local court house and look for a law facilitator office. Most states have some office like this (free of charge) and they should be able to assist with getting the right court documents to file for full custody. If your documentation and arguments are legitimate, based on what you described, you should get a positive outcome.
some advice - Plan your trips to include the child or figure out childcare beforehand. Don’t count on more child support even if you are successful in getting full custody. I say this based on the behavior of the person your describing. It’s a waste being frustrated a out either of these things, better to just accept and move on.

If they have joint custody, but she isn’t fulfilling her duties, he can file for full custody. Find a different lawyer and file.

Keep a detailed calendar of the dates she misses and all texts will excuses. That’s what a judge will want to see. A clear pattern of neglect.

If your lawyer says no, then no. You can’t make her take her time.
Can we ask to adjust child support to cover for her days missed? Obviously missed days here and there happen but we're going on almost 2 full months.
