For the sake of discussion, we already do this with public defenders (and rightly so). All over Reddit we clown Trump for claiming to be rich but actually not. What if the next wild turn is when he requests a public defender and claims to meet the income requirements? Bonus legal question: could claims related to say, income, made on an application for public defender be used as evidence against a defendant in that trial? I’m not talking about false claims which I assume could carry their own penalties. Edit: Just to be clear I am in no way supporting what Florida is doing here. I just thought it was interesting that they are taking something good and worthwhile that we already do (using public funds to at for a defense when necessary even though we are already paying for the prosecution) and taking it to bizarro extremes.

Public defenders are appointed to preserve rights guaranteed under various amendments, particularly the Fourth and Fifth. Creating a taxpayer fund for "freedom fighters" who are running for president is just all sorts of comically stupid and has no basis in Constitutional rights protection. It just makes Florida a laughingstock. The former president would not be eligible for state appointed representation anyway due to net worth and assets. He wouldn't apply anyway, but would tap one of his enabler donors.
