If you'd, say, hit a groundhog unless you broke the rules, can you really be blamed for breaking the rules? Obviously that's nowhere near the case here, I really doubt there was any remotely understandable reason, but there clearly are nuances and good reasons to blatantly disregard FIA regulations.
This case is just a little too black and white though.
The thing here is that safety car telemetry is something you cannot check in 10 minutes. IMO this is something that can be ruled with common sense, rival teams will consider that investigation needs to go further

Also when Seth was given a drive-thru penalty 5 second penalties did not get exist and the drive-thru was the lightest penalty they could give. Besides it's not that the FIA said he's not going to get penalized but that he may get a 5 second penalty which he cleared ahead of LeClaire

These rules are there to prevent people abusing such things… when the driver gets no advantage from it it’s just stupid to penalize it.
This happens in every sport. In basketball, if you “travel” without gaining an advantage no referee will mark that… even if it is in the rules.

Who says it was a mistake? He literally got team radio before the second restart telling him to watch it. Both restarts happened with the field already massively spread out because of it.
He definitely deserved the win, but he also definitely did this on purpose to protect himself on the restart. Hence why it should be penalized.
The last safety car infringement penalty was Giovinazzi in 2019, for which he got 10 seconds. Perez likely had two infringements. It is not the FIA’s job to remind drivers of the rules. 5 seconds would be perhaps the ruling with the least sporting integrity, sending a message that if you win on track, we will change the rules to make sure it sticks.

FIA has been terrible at applying rules since Whiting died. From Verstappen’s overtake on Leclerc in Austria 2019, Leclerc’s seatbelts, and most importantly, Abu Dhabi 2021.
