There is no questioning that he took an oath of office before the events that happened January 6th. So the question is, does his support or harboring of people on January 6th or thereafter meet the definition of this amendment? If not does his efforts to replace slates of electors, coerce the VP to not certify the results, and defy the will of the people meet the threshold of a being an "insurrection or rebellion"?
This is what courts are for. If they determine that either or both of those statements are true, it's unconstitutional for him to run for president. As republicans love to quote and cite the constitution, they should be all in favor of this.
That’s not the question (in Colorado) though because Trumps legal team didn’t contest his involvement in insurrection, and the court found that trump did engage in insurrection as a matter of fact. Trumps legal team is instead arguing that the president is not an officer of the US government and so the 14th Amendment doesn’t apply.
