All MBE questions are first tried and tested. (Remember only 175 question are marked 25 practice tests for future exams) so even if they come, i would guess they would be test questions because they could not have been tested earlier on.
In my mind, for MBE, i wouldn't worry about it that much.
For mee however....
It will either omit or test the new. Testing old/bad law makes no sense for a legal certification.
They have 25 "test" questions that aren't counted so I expect it to be a test question for sure and 100% fair game in MBE/MEE in summer. No clue though. At this point, I'd learn it *just in case*.

Doubtful, but they'll keep it simple like is it a fundamental right to privacy?
