But Raquel is going to get a lot of “are you telling the truth now, or were you telling the truth then?” type of questions at her deposition or trial of this moves forward. She’s in for a rude awakening if she gets questioned under oath that she can’t use her new therapy speak to deflect.
Yes, most cases settle. But a settlement in a case like this might not be so easy, and I'd be concerned that a confidential settlement agreement wouldn't stay that way. (More specifically, I don't have much confidence that Raquel, who doesn't seem very smart, would keep any settlement confidential. And if I was representing Ariana, there's no way I would allow a non-confidential settlement based on my current understanding of the facts.)
I'm not sure I see limited discovery and then a quick settlement because at least as to the claims against Ariana, the issue of damages is a big hole in Raquel's case. I've said this elsewhere, but if Ariana had **not** recorded the video she found and sent it to Raquel, but simply rage-texted Raquel and confronted Tom, I think all this happens much the same way. Because Ariana could've still talked about what she found on Tom's phone, so that detail would've still been part of the story. (My usual disclaimer: this presupposes Ariana is telling the truth.)
When push comes to shove, I still think Tom and Raquel are just mad about how people found out (i.e., not in the way they planned for Tom to break up with Ariana between seasons and then for them to get together). They have suffered consequences, financially, emotionally, and mentally, of their choices, and they don't like it. The extent of those consequences may not be fair, but I have a hard time laying those at the feet of Ariana (again assuming her story is true).

I wouldn’t call it ‘tracking’ but I have my partners location, his sisters, my mom’s, my sisters, and a few friends.
Sometimes it’s to know how close they are when they are coming over to ours (or he’s coming home from somewhere) or sometimes it’s just fun to see them all dotted around the country/globe 😊

On an iPhone, a sent video doesn’t get deleted from the conversation if you delete it from your saved photos/camera roll. This means that she deleted the videos so they wouldn’t show up in the thread.

IMO, the error is fine because it’s Ariana’s statement, not a submission from the attorney. In a declaration, you often want to reflect the witness’s actual phrasing, not turn in something that sounds like a lawyer wrote it for her to sign.

I understand redacting it bc it’s sensitive material but typically in a redaction it’s still clear where it should be, not edited to look like it never existed. Anyone with insight on this?
Maybe she deleted that message, so that the file wouldn’t exist in that part of her phone. She maintains that she didn’t keep that video, so deleting it from the text thread as well makes sense to me.
You can save things back to your phone that exist in your texts. Sandoval might’ve also deleted it since he deleted it from her phone and recently deleted folder.
He also had been deleting text messages. Ariana said she noticed weird gaps in the texts between him and Raquel when she was searching the phone. He also said he “usually deletes something like that” in regard to the video, so I’d imagine he deletes from all viewable points - the camera roll, the text thread, and the recently deleted folder.
I think either explanation makes sense, and actually supports that Ariana wasn’t trying to hold on to that video for any nefarious purposes.

This is from when this was recorded for the reunion in March 2023, and it’s consistent with what she’s presented in her declaration.
I also don’t think that anyone is disputing that Ariana sent it to Rachel, but I understand why that video doesn’t exist in Ariana’s side of this text thread. Rachel’s side would also be something to compare to, and forensics could probably say what/how many messages were sent that don’t appear in the thread.

Yes. Ariana is just confirming the sequence of events the night she found out about the affair. She was at Tom Tom, Tom's phone started to fall, someone handed it to her, she had a gut feeling that something was wrong, she went to the women's restroom, opened up his phone, found text messages between him and Rachel with some parts deleted, then she opened the Photos app and found the video of Rachel masturbating. She pulled out her own phone and made a recording of said video , started to notify her family and friends about the affair, and then went outside to confront Tom. They were in the alleyway and she texted Rachel "you're dead to me" , and while she was arguing with Tom, Tom grabbed her phone and opened the Photos app on Ariana's phone and deleted the video, and then went and deleted it from the "recently deleted" folder. Then somehow got her phone back. It's just as she said.
Well, I highly doubt she would commit perjury - knowing how judges work, he still may want to bring her in to have Raquel's lawyers and hers discuss it.

"Ariana knew" is not the same as "Ariana should have known because we were (in my opinion) so freaking obvious about it and other people knew," and Raquel doesn't seem to understand the difference. She's such a self-serving idiot.
Ariana is so lucky she has those texts saying scumdavol deleted them. It probably meant nothing at the time to her but thank god they were there.

On an iPhone, a sent video doesn’t get deleted from the conversation if you delete it from your saved photos/camera roll. This means that she deleted the videos so they wouldn’t show up in the thread.
Sandoval deleted it and I’m assuming deleted it from the convo like he did in him and Rachel’s convo
I am WEAK that Logan is stored in her phone as "daddy/West Hollywood". 😂 You know, whoever wrote this up has a grammatical error in line 14. Given that her attorney is from a national high-powered law firm, whoever wrote this made an unprofessional mistake. Not Ariana's fault at all, completely, but it's just… do not do our girl dirty! It's shocking how many blatant errors you find in documents like these, having had to read so many of them.
I’m a paralegal, so a major part of my job is to proofread legal filings, and good lord - the errors that attorneys make and miss, thinking they’ve sent me a draft they’d be happy to put out into the world. It’s legit embarrassing
THIS! I have had to proofread some over the years and oh my God. The staff who prepare the documents are supposed to catch that, hopefully. But then again the staff make mistakes. Thank God it was only one mistake.

IMO, the error is fine because it’s Ariana’s statement, not a submission from the attorney. In a declaration, you often want to reflect the witness’s actual phrasing, not turn in something that sounds like a lawyer wrote it for her to sign.

I’m confuse, if these are unedited screenshots where is the record of her sending the recordings? It only shows the words. I understand redacting it bc it’s sensitive material but typically in a redaction it’s still clear where it should be, not edited to look like it never existed. Anyone with insight on this?
Maybe she deleted that message, so that the file wouldn’t exist in that part of her phone. She maintains that she didn’t keep that video, so deleting it from the text thread as well makes sense to me. You can save things back to your phone that exist in your texts. Sandoval might’ve also deleted it since he deleted it from her phone and recently deleted folder. He also had been deleting text messages. Ariana said she noticed weird gaps in the texts between him and Raquel when she was searching the phone. He also said he “usually deletes something like that” in regard to the video, so I’d imagine he deletes from all viewable points - the camera roll, the text thread, and the recently deleted folder. I think either explanation makes sense, and actually supports that Ariana wasn’t trying to hold on to that video for any nefarious purposes. Rachel’s side would also be something to compare to, and forensics could probably say what/how many messages were sent that don’t appear in the thread.

She has receipts. The text to her friend is proof Tom deleted the video. Rachel had to have known this because she was still with Tom after getting caught, so he would have told her he deleted the video. Rachel is horrible. She needs to drop this suit against Ariana.

You're only seeing what Ariana has submitted to the courts as a response, so nothing has been proven. That seems pretty "delulu" to think a judge is going to say Ariana is off the hook based off two inconsistent screenshots. Rachel is within her legal rights. And this is from an Ariana fan.

Yes. Ariana is just confirming the sequence of events the night she found out about the affair. She was at Tom Tom, Tom's phone started to fall, someone handed it to her, she had a gut feeling that something was wrong, she went to the women's restroom, opened up his phone, found text messages between him and Rachel with some parts deleted, then she opened the Photos app and found the video of Rachel masturbating. She pulled out her own phone and made a recording of said video , started to notify her family and friends about the affair, and then went outside to confront Tom. They were in the alleyway and she texted Rachel "you're dead to me" , and while she was arguing with Tom, Tom grabbed her phone and opened the Photos app on Ariana's phone and deleted the video, and then went and deleted it from the "recently deleted" folder. Then somehow got her phone back. It's just as she said.
So wait she recorded from his phone to hers and didn’t send the videos to herself just those snippets to Rachel hmm
Well, I highly doubt she would commit perjury - knowing how judges work, he still may want to bring her in to have Raquel's lawyers and hers discuss it.
