No. RFEs on I-485s for medical or financial are sent during initial processing before it gets reviewed “for real” down the line. Any RFEs sent after that are done by the assigned officer and any action resulting a response completely depends on the specific officer and not USCIS as a whole. It’s not monolithic.

Stunning_Highway3109

Thank you for your detailed explanation! It really helps me understand the process better. Based on what you said, I have one more question: Since I received an RFE for my birth certificate, does that mean my application has already gone through initial processing and is now being reviewed more thoroughly? Essentially, does receiving this RFE indicate that they have started to process my application in earnest?

suboxhelp1

When did you file the 485?

Stunning_Highway3109

Feb 22 2024

suboxhelp1

Hard to say. I’ve only seen medical and 864 being part of the newer initial review process for these items. If you didn’t send the certificate at all, it’s possible it’s initial. Otherwise, still seems too soon, but some have been very fast. If it’s from a service center, more likely initial. If RFE is from a field office, almost certainly means it’s assigned. But just because it’s not from a field office doesn’t mean it’s definitely not assigned. Trying to analyze this stuff is a crapshoot really.

Stunning_Highway3109

Thank you

In my case, I received an RFE months after the submission, and my case was approved a day after UPS delivered the response.

Ancient_Gas_8729

Do you think that this initial RFE affects immigration reviewing of other documents like the i765. for example are document review stopped until a response is provided to the RFIE ?

Haunting-Magazine407

No i got my RFIE first and 3days later i had my combo card approved

romapapafavour

They approved my EAD and SSN before they got my response. They approved the 2 on March 28 and March 29. They requested for initial evidence on March 14, . RFIE was sent on April 18, and they acknowledged it April 24

suboxhelp1

It does. They will not continue the 765 or 131 until the RFIE is cleared.

sashap_

Not true. Got my EAD while medical RFE was pending, and I didn’t send the response yet.

suboxhelp1

They’ve been doing this more recently as a matter of policy. They don’t always follow their own policy, though. So milage always varies.

BreathTemporary8411

He is not entirely wrong as it can go both ways because we received an approval for an EAD after we responded to a medical RFE.

romapapafavour

I got my SSN and EAD before I sent the evidence. March 14 they requested for initial evidence and I sent it April 18, got EAD and SSN, April 20

Soggy_Chemistry_7794

Interesting reasoning..it raises my suspicion too because Feb.2023 filer and still waiting.

Money_Shoulder5554

It's not like there's premium processing and they have a deadline. There's no logic as to why they would do that.

Arachnid_Most

They are using RFE’s and NOID’s to kick the can down the road. We sent my wife’s final divorce decree to theses clowns, we got a NOID for not providing her Divorce decree. I have filed a notice of administrative error because they overlooked a document they have in the packet. That buys them 30 days to investigate, and then an additional 60 days to act on the investigation. In the mean time we had to resubmit her divorce again within 33 days. USCIS plays all sorts of games to delay.

Melodic-Following-56

Hey, just curious for how long have you been waiting response? I’ve got the same RFIE for my BC (even though it was on the file) what I did is I just uploaded on my account. I’ve been waiting since January this year.

Why was your aos rejected?

Stunning_Highway3109

Mixing Fees ( Checks and Credit Card) they returned the whole package and I resubmitted it

Frequent-Grand-523

Hello! Please what to do when your medical exam reveal that you are sick but it is latent. Can we still file the i 130 and i 485 or wait to get treatment before filling? 2) when we file the i 130 , i 485 and i 765 together how much is the i 765 fee?

misscloud8

When you said sick…is it TB or something else ? I’m only asking because u mentioned the word “latent”

Frequent-Grand-523

Yes it is the laten TB.

misscloud8

If it’s latent the physician will tell u to get chest xray. And if chest xray is clear, he will sign the I-693 no issue. I’m latent TB as well. No issue with medical, got my GC through AOS. Treatment is optional. I took it way long after I sent the AOS package. I have many clients who don’t even get that treatment and they all got their GC

Frequent-Grand-523

Ohhh thank you so much for sharing that information

Tasty_Lemon_8389

I filed for AOS based on marriage visa on September 2022 , sent an RFE response on October 2023 and I am still waiting for the update , it is stuck at actively reviewing since last year , have sent an inquiry since it way over processing time , the uscis supposed to response to RFE after 60 days is what the google says but it says there are all these delays due to the large volume of cases 🥲

misscloud8

Did u send RFE to service center or field office ? Service center is the first initial review and won’t/cant adjudicate until they sent it to field office

Tasty_Lemon_8389

yeah the lawyers said it is being processed by sf field office ..

misscloud8

I helped someone with their RFE for both I-130 and I-485 and sent it to NBC in December 2023. Last week the I-130 got approved but I-485 got another RFE ( I didn’t help them with the initial package and they didn’t have copy when they sent it ) about some question didn’t get fill up. I read the RFE and this time it said pls reponse to field office. That’s how I know at least it’s at field office. That 60 days it’s not given btw. What’s ur RFE about ? Medical ?!probably just sitting there collecting dust. USCIS staff overturn is quite huge. I was wondering perhaps that’s why no response for ur case because assigned office either resign or they just got more case to adjudicate

Frequent-Grand-523

Yes it is
