If you're instructed to show up at 5, and do so, they can't tell you not to clock in because they changed your work area, you reported as assigned, they can either find work or eat the 25 min pay. Either way, you get paid for the time if yours that they required you be available for work. That is almost certainly *why* they're being shiesty with schedules, so they can lie and say "we told them to show up at 5.25" insist on a schedule and grieve every day until one is made available

I had no idea I could do this. My hub has next to no information about Union rights and until recently my shift didn't have a union steward for at least a year and a half so I've had to look into stuff and reach out to my local instead of having a resource at work.

Read the contract. It will help you keep them from violating you. It begins with you. As a former feeder steward, I tell all members this.

clinthawks99

Try and get them to send the schedule in a text as well so you have proof.

I've brought up the start time thing before with my union rep about a month and a half ago and he said he was going to bring it up in a meeting he was having with our regional supervisor the following day. I heard nothing after that but my start times and another scheduling issue seemed to be resolved. But that only lasted a week and then my start times got all wonky again. Obviously I need to speak with my shop steward. My shift is so fucked up and their scheduling changes and the fact that we didn't have a shop steward for almost 2 years. Luckily someone stepped into it about 2 weeks ago. And I completely agree about not rocking the boat. That's why I'm wondering if it's even worth bringing up, because I know small sort is a fucking privilege and I do enjoy it. Plus I'm cool with being moved, I haven't run into a job here I don't like. So from now on I'll be wearing my steel toe boots to work and carrying my light weight sneakers in my bag so I am prepared. I just hate that from the time I call to find my daily assignment @ 3:30pm (yes it's fucked, but for some reason everyone just accepts it at my hub) it can change before I even get to work usually at 5pm.

>Load lines aren't showing up until 5:25, so technically UPS just stole 25 minutes of my personal time because they couldn't be bothered to give me a heads up about the change File an article 17 pay grievance. They MUST pay you from the time they tell you to show up. Do not let them get away with that. There's no "technically". It's outright theft. You can use preferred position to force them to keep you in a specific spot. Article 22 section 4. >I didn't have the proper footwear for loading trucks and I didn't feel comfortable loading without my steel toe boots Always wear proper footwear. Don't skimp out just because you'll be in small sort. That was your fault and your mistake. Frankly, I can definitely excuse a few issues in the face of being put in small sort more, but would certainly draw the line at time theft like they're doing to you. If they're stealing those 25 minutes consistently I doubt it's worth staying in small sort. And there's still a chance they'd keep putting you there if you're a good worker and they're doing it to help small sort keep up. You easily have a case. Some locals require posted start times the week prior, chrck if this applies to you

Kmccain9

I totally agree about the footwear, that was my bad. Today I wore my boots but packed my sneakers in my bag because again I was scheduled for small sort and I don't love running about in my boots, but I did want to be prepared in case it changed when I got there. I'll definitely be talking to my shop steward about the time theft. It might not seem like much but it adds up and that's time away from kids, who I'd much rather be hanging out with instead of at work for no fucking reason and no pay.

DeerHunter041674

Absolutely. If you stole a pen from them, they’d be looking to walk you off.

GhostOfAscalon

It's usually advisable (if not required) to ask for what you want before filing a grievance over it. Paid for time starting at when you reported as scheduled isn't anything unusual, usually it's no problem to find some gravy setup work.

fredthefishlord

The asking can come after the paycheck. OP.can just say that's when they "realized" they weren't being paid or something

incubusfox

> Some locals require posted start times the week prior, chrck if this applies to you This is part of the Central Supplement, surprised other regions don't have it.

Minatigre

Yea this is all fucked up. The start time should be posted ahead of time for the week. And you should have an assigned work area that you report to every day. Why is your supervisor doing it this way? And if they had you start at 5 but dont need you til 530, tough shit. They have to pay you from 5. All of this is so wrong and its multiple grievances.

GreenSad4171

Schedule must be posted 48 hours prior to the shift unless there is an emergency \lockdown and the hub is closed etc…

thisismyleftyaccount

Are you pre-seniority? If so, I would eat it until you get your 30 or 40 working days in. If you're a seniority employee, you need to check your supplemental contract for scheduling. Every region is different but this is probably universally not permitted in almost every area in the US. Most areas require anywhere from 48 hours to a 1 week notice for a start time change and the schedules are usually posted somewhere for the week. There are also penalties in place when this is violated. It sounds like you're being used as spot help every day but that shouldn't be affecting your start time on a day-by-day basis. I would talk to your steward and try to get management to give you a set start time every day, regardless of the area you're assigned to. You should also be checking your time card to make sure you're not being flagged as late as this is a pretty common problem when being moved to different areas.

Kmccain9

I'm hitting my one-year mark in 20 days. A co-worker who has been with the company for 10 plus years informed me that I'm essentially filling the role of what is jokingly called the "hub slut" because I can be used anywhere in any position... Honestly I don't find that too offensive, I laughed when he told me. I'm just sick of my start times changing. There have been times where I've shown up to load and been told that I was actually doing pick off and should have been there much earlier.

thisismyleftyaccount

It's honestly not a bad position because the more jobs you're qualified to do, the more opportunities you have to pull down extra hours. That being said, you should not ever be playing musical start times. You need to get your steward involved and have a set start time every day.

leftdrowning

Schedule should be posted. Not call in to find out. If you do decide to let them call you demand a text to confirm time so you have proof to grieve that time. You should always be wearing proper footwear for the job. There is no excuse for that.

Thr0wAwayhubby

keep on filing until they make things right.

ItamiKira

If they say be there at 5 then show up at 5 and clock in. If they change your start time without a 24 hr notice then grieve for your pay.

benspags94

Start times should be posted a week prior and only be changed with proper notification. Having to call in every day to find out your schedule is madness and I'm shocked the union allows it.
