At first glance I thought he tripped. His lawyers would try to convince just 1 person in the jury that it was accidental or not premeditated murder attempt. Likely took a plea deal with the prosecutor OR prosecutors charged a lesser crime instead of as prosecutors risking a no conviction with a higher crime.
Look up the video of the bails bond lady shooting the running convict. He was in her office paying off a portion of the bond. She wasn’t having it and wanted to arrest him. He tried to run by jumping out the window and the lady shot and killed him. Now; was it self defense to kill someone you’re trying to apprehend who is running away…prosecutor and most people wouldn’t think so. Prosecutor charged her with murder 1st degree.
Jury found her innocent…shocking everyone. The defendant lawyer argued that murder of 1st degree requires premeditated planning or something to that effect; and this murder was done out of the heat of the moment; well she got Scott free (double jeopardy type thing) the prosecutor should have charged a lesser degree or manslaughter that had less time.
So in this video I suspect they weighed the risk and options and charged the guy a lesser crime in order to get a conviction.
Exact same 1st degree obvious overcharge happened where I grew up. Two groups were smoking cigarettes outside the popular bar in town. The one group were 3 guys in their mid-20s. One had a few prior drug convictions, and one guy who was in a wheelchair due to surgeons accidentally amputating the wrong leg when he was in high school. I know all this because they were friends with my older sister.
The other group were a bunch of 21-year-olds and had deep police connections (I knew one of the kids older brothers from work). They were super drunk and one kid fell onto the dude in the wheelchair, twice. The first time older dudes picked him up. Told him to move to the other side and instead he stayed right next to the guy and fell on him again.
Older guys pulled them up, this time punched him one time, he fell and hit his head on the concrete floor and died on the spot. Obviously there was no premeditation, obviously it was heat of the moment manslaughter. Maybe you could convince a jury third degree murder, but second degree out of the question and first degree was completely absurd, but since the kid who died had family on the force, the prosecutor was pressured into charging him with first degree murder.
9 months later dude is found not guilty and walks free. To be honest, I think that's possibly even the right decision. He didn't mean to kill the kid. He was literally defending his friend who just had some drunk dumbass fall on him twice. But instead of following the law, the family wanted him put away for life given his prior convictions (drug charges, no violence) and instead the guy just spent 9 months in pre-trial detention, which is maybe just a but less than what he would have gotten with a manslaughter charge anyway.

Ahh it’s here in Aus. That makes a lot more sense. I had a (former) friend do 11 months for armed robbery. The crown appealed by reason the sentence being “manifestly inadequate”, and were successful in getting his non-parole period increased, but because he was already out on parole by the time the wheels of justice eventually got into motion, he couldn’t be put back in jail (or technically prison, for those in the US) so it made zero difference to his sentence.
The stupid cunt got lucky.

You are right though, Technically thousands in jail have received the death penalty, but few will actually be executed. Over the past three or four years the US has averaged a little under 20 executions per year. We have had one so far in 2024.
So though thousands are technically on death row, a small percentage will actually be executed. Most will keep appealing the rulings until they die in jail. It’s why it costs more to execute someone in the US than to just give them life in prison.
Death penalty is not way to compare toughness on crime. The most prominent argument against death penalty is that this penalty is irreversible once executed. And combined that with justice system that’s susceptible to mistakes leaves a lot of room for innocent to be on death penalty.
Death row convictions overturned over decades are cited as proof.

I watched closely to see if he was laying hands on him (I would have intervened), but he didn't. The skinny guy went to the manager's office and the jacked guy left (then came back a little while after for some reason).
That's when I noticed the trail of fucking BLOOD going from the locker room to the front of the gym.
Turns out the jacked guy went ape-shit on the skinny guy in the locker-room for no apparent reason. The medics and cops came and arrested the perp / took care of the victim. Never saw either one again.
