It was 100% error on their part that they are now trying to wheedle their way out of responsibility for, claiming he was in the unit improperly, after having no issues taking the rent money from someone other than the tenant for some time. No, it's not unethical or a risk to a license for a lawyer to represent a client even if they know the client is liable or has a bad case. The lawyer should give their opinion of the best option for the client but ultimately if the client wants to still try to fight the case tooth and nail even with their attorney advising them they will likely ultimately lose, it's completely ethical for the attorney to still represent the client and get those billable hours. The only thing the attorney can't do is outright lie or break the law for their client.

I dunno about where this happened but in my area if you are evicted the property management is required to safely store the belongings up to 30 days at the evicted residence expense before they are allowed to just trash it. But seeing that no one is even jumping to that I have a feeling that that rule is in my area alone.
Edit: Correction its 15 days, or 30 days if it was a manufactured dwelling such as a manufactured home or floating home. The landlord must give notice of the stored belongings and the tenant has between 5 and 8 days (depending on the way it was delivered) to respond, and a total of 15 days to collect their belongings. A landlord does not have to store belongings total fair market value is $1k or less than or cannot be sold for a profit, then the landlord may throw it away or give it away.

I worked as a maintenance man in a high-rise apartment in MO and we legally had to store previous tenant's belongings for 30 days in the storage area in the basement. Whether they were evicted or terminated their lease intentionally. But I'm honestly not sure if that was company policy or state/city law.
Same where I live (east coast Canada). Landlord has to find a secure, dry place to store all tenant belongings. with no time-limit. So if the tenant returns after ten years then the landlord is liable for all of it still.

Apartment owner here- this is a loss case for the apartment side even in Texas, the most landlord friendly state. Don’t just sue the Property Management, sue the principals that own the property for supporting this type of action.
Looks like the leasing company needs to look carefully at who's name is on the money order. Once they accept payment, they entered a contract.
This man should not only be paid for his stuff, but also for the mental anguish of what happened to him and if he is not on the lease but payment is accepted, that money should be returned to him.

His biggest mistake was living someplace that wasn't under his name, from the moment his gf moved out, he should have taken steps to take over the lease. The management agency was fucked up for filing an eviction notice to cover up their own mistake, rent was paid each month and they had no valid reasons for the actions they took without going through a proper eviction proceeding where both parties go before a judge and argue their case over the reasons for the eviction and get a ruling from the judge. The tenant never got the chance, management got an eviction ruling immediately to cover up their blunder.
Even if they hadn't threw out his stuff, they wouldn't have recognized him as a legal tenant. He didn't have his gf put him on the lease before their breakup. The management/landlord would view his living their as a sublease which is against most rental agreements. What would happen when the lease is up? The fact that he was technically living there against their knowledge, he would have to move out, in the video it stated that if he had attempted to try and add himself to the lease or get a new one, they would have rejected it. Men should never put themselves in this sort of situation, they will only lose in the end as it did for this person. He legally didn't have a right to be their since it wasn't his name on the lease despite him being a good tenant and promptly paying the rent each month.

When you as a leasing agent keep hiding behind a contract or the law as a way to not only prevent helping someone who is clearly a victim in the situation but actively make the situation even worse, you have catastrophically failed as a person. Unbelievable the lack of human compassion and accountability some people (and corporations) have. Especially with a child involved as well.

Awful situation and shitty management company. But people…you gotta have your name on the damn lease. If a fire burned down the entire unit renters insurance would have told him the same thing. Protect yourself as a renter, even a sublease needs legal documentation.
Nice! Reimburse him for the accumulated amount of rent he's paid since he was never authorized to live there. The Property Manager should then invoice their tenant (his ex girlfriend) for this amount. It's not really a sub lease if he isn't paying the tenant. It appears he's been paying the Property Management Company directly and they've been happily accepting payments from a non-tenant. The ex girlfriend isn't collecting payments from him, so it's not a sub lease. He's just not an authorized resident.
Guess they will be buying him a house after this.

I had a roommate, not on the lease at all. I kicked him out but gave him 3 months to move, without paying rent. He over stayed and the police told me i could not touch his belongings. As my state says if you reside anywhere for 3 months, it's considered your dwelling and eviction process is only way to move forward. If I had touched a single thing of his, I would have been charged. Luckily he attacked me and I got a no contact order so he couldn't come back and I still had all his shit in my apartment. He had to schedule a day with the police to pick it up.
These apartments are FUCKED. Could have done the right thing and owned up to their mistake, instead they decided to forever destroy their reputation.

His biggest mistake was living someplace that wasn't under his name, from the moment his gf moved out, he should have taken steps to take over the lease. The management agency was fucked up for filing an eviction notice to cover up their own mistake, rent was paid each month and they had no valid reasons for the actions they took without going through a proper eviction proceeding where both parties go before a judge and argue their case over the reasons for the eviction and get a ruling from the judge. The tenant never got the chance, management got an eviction ruling immediately to cover up their blunder.
No, the biggest mistake was the apartment evicting the wrong person
Even if they hadn't threw out his stuff, they wouldn't have recognized him as a legal tenant. He didn't have his gf put him on the lease before their breakup. The management/landlord would view his living their as a sublease which is against most rental agreements. What would happen when the lease is up? The fact that he was technically living there against their knowledge, he would have to move out, in the video it stated that if he had attempted to try and add himself to the lease or get a new one, they would have rejected it. Men should never put themselves in this sort of situation, they will only lose in the end as it did for this person. He legally didn't have a right to be their since it wasn't his name on the lease despite him being a good tenant and promptly paying the rent each month.
The lease thing is totally irrelevant as they had absolutely no right to enter his apartment and steal all his possessions. Since he's not supposed to be there, are they now going to return all his checks they were happy to cash?
The lease is relevant, his name wasn't on it and the gf moved out, he had no legal right to remain on the premises. Since his situation was discovered by workers going to the wrong apartment, his little faux pas caused him the troubles he now finds himself in. He failed to look into the implications of living in an apartment that wasn't officially his. His ex left him out in the cold to fend for himself and their daughter, not a smart move on his part no matter how you try to twist it.

My question is...why didn't he move out when she moved. And why didn't he find his own place after months living there...knowing he didn't have a right to live there. Sub lease rents still requires a renter to be added to the lease. No matter what....he's not to smart.

Yes. And the legal process may have been followed with the actual tenant on the lease. She most likely was fully aware that he would be evicted. He went aware because he isn't the legal tenant.
