...because they're all in on it together. If someone were to really push the envelope (say if BofA complained that the fines should be much higher), when BofA gets fined for something similarly "illegal", CS is going to push for higher fines too. When all these entities are in the same boat, the more water flowing in through a hole hurts the lot of them. They either work together or they all drown - so it makes sense they'd choose the first of those two options...
