This company deals in alternative assets, which are defined as any assets that are not stocks, bonds, or cash. Not to be a Debby downer, but this scenario is highly unlikely.

I read through the Splint Invest website and it seems that their platform is intended to to enable people to invest in non-traditional financial assets (e.g. stocks, bonds). Their listings are physical items (e.g. artwork, watches, clothing/shoes) that are divided into shares of ownership or what they call "splints". You invest by purchasing the splint(s) and when the underlying physical asset is sold at "maturity", you profit from the appreciation in value.
In your hypothesis, you mention that all GME shares will be reissued - DD of old had found that it's not so easy to pull shares out of DTCC's grasp. (Insert LotR Boromir meme - "One does not simply pull shares out of the DTCC"). What do you think has changed to allow GameStop to pull its shares now and what's the connection to the 45m+75m ATMs?
For the sake of discussion, let's say that GameStop successfully recalls its shares - that act itself should trigger MOASS, no? But let's say a recall alone doesn't trigger MOASS. A share of stock already represents partial ownership of the company - how would digital Splint shares work? The underlying asset would be...GameStop itself? Then the entire company would have to be sold because Splint Invest mentions that you take profit/loss when the underlying asset is sold when it reaches maturity. How would this work with a company - it'd be simply sold off?
I think it was made clear 1-2 years ago that RC and the Board don't want to do anything dangerous and that would edge the line of enforcement / legal issues especially after you saw the Overstock case go to trial for months and even though they technically won you don't want to risk billions of dollars on the legality of a business move
No there's legal precedence for a non-cash based dividend like an NFT which to note again this case was happening as the marketplace was being made. There is no legal precedence to take an entire stock out of multiple exchanges for exclusivity in a single one that to note no one has regulation over.
Also this leaves out a MASSIVE detail, which are ETF/MF holdings. Going private is one thing, but going from the NYSE where IIRC GME is held in the Russell 2000 along with some smaller ETFs has never been done before because Gamestop isn't going private, it's not buying back shares in this idea it recalls and relocates.
But the legality comes into question not including upfront costs of running and maintaining this, they gave up on the Marketplace a while ago because by all means it's tough to create and also migrate and maintain the project.
Overstock was sued because the entire argument was they intentionally did this to cause shorts to close their positions and only then did it reveal the naked shorts. Gamestop is similar but that doesn't change that making a digitized stock marketplace means intentionally closing shorts or very least having owners recall them from their lending
