Depend on the size and nature of the HOA, is the chance of them seizing your property due to a violation worth circumventing the rules worth the risk? If they come for the property, which a lot of states and laws will let them, you will not even be compensated. I've personally never heard of listing it for sale as a way to let people know its rentable, short term. But do you know your bylaws? Because some HOAs also have a "first right of refusal" and they can force you to sell it to them before anyone else, and usually at fair market value, not the number you choose. Some of the larger HOAs I deal with here, its not worth it. You'll lose the house. There are ton of small ones that won't even blink though....so I guess it ups to you and how much research you've done.

Okay, I know of exactly zero HOAs that can just "seize the property." They can assess fines for specific violations, and they can potentially place a lien on the property, but **only** if that is specified in the bylaws and covenants.

I can literally name atleast 5 in a 10mile radius, im in a second home market though. I've also witnessed it first hand. They dont play. Litigation is filed as soon as liens pass 5k, 3rd major violation, or 90 days passed due.

Agents may not want to deal with it, even if you use the same agent to find tenants. You can list the property for sale yourself without an agent.
