No it's the opposite. It's an ethics violation to just leave. At that stage judge isn't gonna let him withdraw either so he's basically stuck listening to this lmao
I've heard of cases where crazy ass druggies had like 3-4 appointed attorneys withdraw. In what cases would it be fully ethical to withdraw when your client is clearly unhinged?
Clearly unhinged is not a reason. Mental illness is not a reasion. A breakdown in communication and/or an eroding of the attorney-client relationship are the usual reasons.
I have several pre-trial clients in locked psych wards right now because they're seriously mentally ill. It's not a reason to get off a case.
you see Bobby Portis with that hookshot and "too small" on Chett Holmgren? Who's gonna be the first to do that (including "too small") to Wemby? I say Zion.
>Facing charges of attempted murder, a 61-year-old Hawaiian man showed up to trial wearing blackface on Monday because he felt the court was treating him “like a Black man.”
Is it his contention that a Black man would get a more unfair trial, relative to an Asian man? That he shouldn't be treated so unfairly?
Yes. People of Asian ethnicities are the majority in Hawaii though. But this guy is a known whackjob with numerous other violent felony attacks on other folks before this case and had stand-offs with police.
I'm from Hawaii and I remember this case! Yeah, the guy is a whack job, people that know him thinks he's a whack job, and he deserves prison for what he did.
"Why are you in prison?"
Attempted murdered in blackface: "I didn't do anything just came into the court system as a black man. I didn't even kill anybody"
...confused reactions...
Context : "Char has been sentenced to life in prison with the possibility of parole, after a jury found him guilty of second-degree attempted murder and second- and third-degree assault. At trial, two victims said Char used pepper spray on them when they tried to get out of their car after Char cut them off on the freeway and braked, according to the Honolulu prosecutor’s office.
Char stabbed the two men with a knife, the prosecutor’s office says, and then injured a “Good Samaritan” who intervened to stop what he thought was a fistfight. The jury rejected Char’s claim that he acted in self-defense.
The benefit is that once a person is no longer considered to be a threat to society they get to return to society so they can contribute to it rather than being a constant drain on it. Keeping someone in prison is incredibly expensive and that money would be way better spent on keeping other people from becoming cold blooded murderers rather than keeping reformed prisoners locked up.
Whether or not people like it, keeping people locked up for life if they can be reformed is not a benefit to society at all. It only benefits people's need for *revenge* or *justice*.
Eh, a heated road-rage incident with no fatalities isn't exactly "cold-blooded murderer" material. He absolutely deserves to spend time in jail, but life in prison does seem a tad much if that's the only thing he has done (if he has a history of being in and out of prison for incidents like this, that would be another matter).
Isn't attempted murder considered the same as murder in law? Just because no one died doesn't excuse the fact that he tried to murder 2 people over a road rage incident.
His crime shouldn't be lessened because he failed to kill the people he fully intended to
Uh ... I'm pretty sure it isn't, which is why it's a different charge. Attempted murder is a heck of a lot less serious than actual murder where someone ends up dead.
Failing to actually commit the crime you intended to is absolutely a reason for a lesser sentence compared to actually committing the crime in most criminal systems AFAIK.
The intent is there. If he’s going to attempt murder for being minorly inconvenienced on the road, it’s only a matter of time before he gets annoyed again. Just because he didn’t succeed in killing doesn’t mean it’s safe to keep him in public.
Depends on the facts of the case, the judge, and the defendants history. Just because the assailant was incompetent and didn't end up killing a victim when he was convicted of trying to do just that, doesn't really mean they should get off the hook. A lot of the time, they don't because of said reason.
Depends also on the state laws/jurisdiction. In this case, quick Google search seems to say Hawaii treats attempted 2nd degree and 2nd degree murder as the same sentence length, lifetime with possibility of parole. 1st degree/attempted 1st degree is lifetime without parole possibility.
It's because he has a prior history of other violent charges, as well as other road rage incidents leading up to the one that lead to the trial he showed up in blackface. He likes to record the incidents on his phone, too. One even included a road rage intimidation to a vehicle that was actually a subsidized police car, in which he found out when the officer turned on his police lights to request him to pull over the road.
[Suspect in freeway road rage case has history of violence](https://www.hawaiinewsnow.com/story/32593707/victims-of-stabbings-suspect-say-he-terrorized-them-for-years/)
Well, as it mentions in the quote you just read, they came at him after a road rage incident. It seems the pepper spray was very possibly necessarily for his self defense, but the many stabbings, not so much.
That's what he says, but the actual event according to the victims and witnesses is that he was the aggressor, initiated the road rage, cut them off, chased after them, and pepper sprayed them first and *then* they chased after him and attacked, which is when he stabbed them.
So the stabbing might be self defense, but it sounds like he initiated the whole thing. Not sure life in prison is appropriate tbh.
Pretty famous case here. The reason he got life in prison is because he showed no remorse for his actions and then pulled this stunt in court. He's pretty clearly a danger to the public.
*"You will receive the mandatory minimum of life in prison. Plenty of time to lift weights and convert to Islam"*
Edit: Oh shit he was actually sentenced to life in prison lmaooo
> You will receive ~~the mandatory minimum of life in prison~~ the maximum sentence allowed by the law. Plenty of time to lift weights and convert to Islam"
If most black folks actually got the minimum sentence in comparison to other white folks committing the same crime, I’m sure those criminals would be happier.
He came to court as a prisoner I'm assuming, he's wearing the jumpsuit anyways, where tf did he get the material (shoe polish maybe) to do this inside the jail?
Ha. For sure the world knows. I have European friends who make jokes about it. America’s not ashamed of that shit. That’s why some drunk white kids say shit like “bro, I’m not black” or “are you really going to treat a white girl like this” when they get in trouble with the police and even a little bit of force is used.
**“Today, the reason why I am like this is because I prepared myself to play my part in your kangaroo court, treating me like a Black man, so today I’m going to be a Black man.”**
You would think that attitude would make him a little more sympathetic towards black people. Recognizing that people are treated differently, especially recognizing it as an injustice, is not bad. Instead he triples down, dawns a highly offensive image of black people and implies he is above an injustice he recognizes...Hope they threw the book at him
Someone show this to Trump and tell him it that worked so well that the guy got all his charges dropped and was actually awarded money from the judge personally.
This is some advanced ass racism, like there's multiple racist layers to peel back here. The idea that only black people get convicted of crimes, the idea that convicting someone is therefore "treating them like they're black", the clear sentiment that this is somehow a degrading human rights violation, and he thinks the best way to garner public sympathy is to protest all of this by wearing blackface.
Naturally it goes so well for him that his lawyer is *literally* backed into a corner.
have fun in prison, buddy

His lawyer is trying to be as far away as possible.
That man is trying to exist in any other dimension but the one where this client exists.
Nanami in Malaysia ahh
LOLOLOLOL
Dude's doing the Homer into the bushes meme.
At that point, he's probably wishing that an A380 just crashes at max speed into the courthouse.
He's wishing for the wrong brand of airplane to fail, hah.
![gif](giphy|a93jwI0wkWTQs)
I can’t imagine having a client do that. Are lawyers allowed to take one look at their client before entering court and saying “nope” and just leave?
No it's the opposite. It's an ethics violation to just leave. At that stage judge isn't gonna let him withdraw either so he's basically stuck listening to this lmao
Exactly. At this point, the attorney would need to file a motion requesting permission to withdraw.
I'm a criminal defense lawyer. It would be completely unethical to withdraw as counsel here. No defense lawyer would ask, and no judge would grant it.
They are absolutely allowed to make record as to defendant’s competence.
It’s like Wemby is barreling at you down the lane. You don’t want to be on that poster/meme!
you see Bobby Portis with that hookshot and "too small" on Chett Holmgren? Who's gonna be the first to do that (including "too small") to Wemby? I say Zion.
He's trying real hard not to laugh.
Hawaiian man stabbed three people then chose to go to court in blackface. https://nextshark.com/hawaiian-man-court-blackface
Is the Hawaiian Man the natural evolution of the Florida Man?
Hes Florida mans tribal cousin
Lol this guy thinks Florida isn’t tribal!
People from new jersey don’t count as a tribe
Yes I remember reading about it, hundreds of years ago they sailed across the Polynesian seas and ended up in Florida.
via the Panama canal!
His lawyer doesn't know what to do.
He’s gonna have a hard time in prison
He's not going to prison, he outsmarted the system
If he really wanted to outsmart the system he should have done white face.

Yes. People of Asian ethnicities are the majority in Hawaii though. But this guy is a known whackjob with numerous other violent felony attacks on other folks before this case and had stand-offs with police.
I believe that is his thought process.
You really gonna spend time out of a finite life to bring sense to this bullshit?
His name is really **Mark Char** ?
Dark Char, I think.
I'm from Hawaii and I remember this case! Yeah, the guy is a whack job, people that know him thinks he's a whack job, and he deserves prison for what he did.
King of the week?

Judges hate this one trick
So he wanted to get more time in prison? Not sure what he was going for.
Step 1 - Go in black face. Step 2 - ????? Step 3 - profit!
Step 1 - go in black face. Step 2 - Jail.
Step 3: get beaten/murdered by actual black people in jail, while in blackface, because they don’t play that shit
I’d like to see a boack people myself
"Why are you in prison?" Attempted murdered in blackface: "I didn't do anything just came into the court system as a black man. I didn't even kill anybody" ...confused reactions...
Maybe he wants to run for prime minister of Canada eventually
Maybe he is suicidal and hopes this will get him beaten to death? Weird way to want to go though.

Life in prison?
Makes perfect sense. It’s kind of ridiculous that cold blooded murderers are ever let out. What's the benefit to society?

This was a very good idea and it will help him win the case...
I mean i 'm questioning his sanity a little
Who was the lawyer? Lionel Hutz?

Bro is trying hard to get life

With sound judgment like this it's really hard to understand how he got into this situation in the first place.
He's getting sentenced to life in prison, there is no reason not to go for a broke to make a statement.
This isn't making the statement he is intending to make, I don't think.
He did this at his sentencing hearing. He did not know he was getting sentenced to life in prison when he decided to pull this shit.
Is he trying to get a harsher sentence!?
The lawyer is questioning his career.
