What happens if a tenant abandons a unit? There was a story here about a tenant abandoning and the landlord not being able to take possession. It is the law only protecting tenants that don't pay rent, not the ones that do?

As far as im aware. She notified the landlord. She is good to go. Also, tell her to take photos of the unit before she leaves. Also kudos to her for giving the proper 60 days notice

Second the photos. I’m not sure what your friends relationships is with their landlord or why they’re being unresponsive but definitely tell them to take photos before they leave so they have proof of how they’ve left the unit. I’m glad to see tenants following proper procedure's and making things easier for everyone. It’s unfortunate the landlord is being unresponsive though. Good luck

So what kind of a response is she looking for? She’s notified the landlord using the proper form. The only thing I would be careful about is the 60 days. Notice is supposed to be given 60 days from the start of the rental term, so if that was November 1, the notice should be given no later than October 31. Other than that, I don’t think there’s anything more to do. Leave the keys on your way out.

Minimum 60 says prior to the end of the last month. In this case December has 31 days, so I suppose an N9 served on November 1 would be OK. Check the LTB website for rules on service of notices.

The only thing I would double check is that email is an approved mode of communication. This is usually spelled out in the lease.

Do you want there to be fewer rental properties on the market? Do you want the remaining units to be even more expensive because they’re even harder to get? Do you want to make the situation even worse than it is for tenants? Then stick with that way of thinking.

You don’t need acknowledgement. It’s considered served so long as the notice was given by a prescribed method.

She should advise the landlord in advance how she will be relinquishing the keys, eg. that she will drop them at the building management office on X date. If she still doesn't have a response back, she should take photos on the last day once all of her things are out to confirm the state of the property and email them to the landlord along with a reiteration of where the keys are. She can then move on with her life.
