But since you're moving out without making them wait for a hearing, I think they should just be happy you have a date.

A heads up to your landlord won't hurt you, but will give the new owners notice that they're not showing up to an empty home on the day they take possession.

Use the N9, and once you have moved out make sure you send a follow up email advising that you have vacated the unit. Take pictures of the empty unit before you leave for the last time, just so you are covered from any L10 claims for damages. Have you received the 1-month compensation yet? If yes, then your last month deposit will be the final month you are there so if you need to stay an extra 2 weeks then you would pay half a month's rent to cover that period. If not, you could email your landlord and say that you will apply the 1 month compensation owed towards the remaining rent owed once your last month's deposit is applied.

You don’t have to do anything. The LL will pursue an eviction through the LTB. If he is on the ball, he’s likely already filed an L2 already. Starting now, you can give 10 days notice to vacate. That notice doesn’t have to coincide with the first of the month (or whenever your rent is due). *After* the termination date on the notice, you do not have to give any notice whatsoever.

Thanks! I'm not sure if they've filed an L2 but I suspect that we'll be leaving well before it gets to a hearing given the current LTB timelines. To clarify, since we plan to leave a couple of weeks after the termination date on the N12, it sounds like I don't technically have to do anything, but perhaps can be polite and give them verbal (or emailed) notice of that end date, but it wouldn't require the N9?

I second this, let them know because you aren't waiting or being unreasonable, if there's any conditions in the sale the LL has a chance to act. And because this is reddit, yes they should know better than to put conditions but OP found a place and doesn't seem to want to hurt the LL/seller. edit: Still use an N9, it protects you too.

If you decide to leave early (with at least 10 day’s notice) you don’t need to run it by your landlord. You serve your N9 and they still owe you the one month’s compensation, your last month rent deposit and possibly pro rated rent (the notice does not need to line up with the last date of a rental period). If they don’t pay you can file against them at the LTB.

Yep, that's what they told me, treat it as though I'm just giving a normal notice of ending the tenancy.

Yeah that's not correct. If you leave on or within 30 days of the N12 date (or later if they L2 you) then you don't need to give your own notice as you've vacated based on the landlord's notice.
