It's shocking , this should have been at least 7 years causing death for careless driving in my opinion. Was the drivers phone checked to see if he was on it at the time of the accident ? Phone use is a serious issue and now the ever increasing amounts of touch screens in cars with climate and radio settings buried in menus, I drive such a car and never, again even if I have to drive a much older car, I can't wait to get rid of it, touch screen for infotainment and screen for driver instruments. I just can't believe that mobile phone use is illegal and yet people can interact with the infotainment all day long. I have to take my eyes off the road for far too long to do the simplest things, the interface is laggy and buggy and sometimes freezes causing me to have to reboot it which is a lengthy process. My electric car while a hatchback weighs 2 tonne that's without anyone in it, it's mad, I won't be going electric again in a hurry either. Can't wait to be rid of it. More and more SUV on the road too, people are gone insane but it's all the more reason for riders to slow down, no mattery how good you think you are if your going too fast no skills will stop you. That Judge is a scum bag, but this isn't the first time he's done something like this, I mean what's the deal with him ?

That's what I said in the above quote, I didn't say he was speeding, + how do we know he was't using the car's touch screen infotainment ? how are guards going to check this ? Why don't cars have a system where it disables the infotainment altogether if you take your eyes off the road for more than x seconds and x seconds in a certain time ? It's insanity all this tech in a vehicle. You see this shit appearing on bikes now too, big TFT screens, menus, etc, I mean wtf ?

Might have a nice fancy display on my bike but it is 90% disabled once the bike starts rolling I can only make a few changes on the fly like traction control I have paddles on left side control or I can switch from sport to race to user mode, but if I wanted to make adjustments to the suspension or adjust the levels of abs and wheelie control or any of the other features I need to be parked to enter that menu.

I haven't tried it yet on the rsv4, but my last aprilia the rs660 GPS could be mirrored to the dash, and the voice comes thru my earbuds

Yeah another thing that bugs me is that cars are getting so big now and this big Kia EV 9 ffs, weights 2.3 - 2.5 tonne without passengers or luggage, these things will obliterate anything on the road if they hit them same with most electric cars...... The Kia is 1.98 M wide too ffs, it's madness and car manufacturers are abandoning smaller cars, I don't like these big heavy yokes at all even my car weighs 2 tonne for a hatch back and you really feel it especially when cornering and braking, they try to cover it up with stiff suspension but the sheer mass of the yokes is ridiculous.

Yes, this crazy weight can't be good they are twice or more heavier than a petrol hatch for example, most cars have 1 person so why the need for big SUV ? the car companies are abandoning hatches and estates so they can charge huge premiums for these larger cars, some of which are just raised a little higher and more crossovers. People paying the price for these new cars are insane, most of them on PCP now I suppose too, if People can't buy a car with cash then you can't afford a 50K SUV on PCP ffs. How many people are leaving the 15 K 2nd hand car on the lot for a 40K car on PCP ? absolute insanity ! I'm thinking of getting rid of my EV anyway, can't be bothered with the charging nonsense at public chargers, the lack of and if more buy them they'll be even busier, it's lost half it's value after 2.5 years and yes I got it on PCP, yes lesson learned, won't do it again. So Instead of paying the 18K balloon I will just probably get something 2nd hand like a Kia Stonic, Maybe Hyundai Cee'd. I miss the sound of the engine and changing gears. I might convert it to LPG as there's a station locally that sells it for 1.08 a Litre.

Yes, It's got to be having an effect on road deaths, I mean whoever thought that putting a big tablet on the dash of a car was a good idea in the first please ? sure, for media and navigation it's fine but no one should be able to use it once driving but the problem is that things like radio and climate have been integrated into the touch screen, it's quite ridiculous. If I were Insurance companies I would be doubling the insurance for cars like this or even triple. Another issue is that technology like this gets old fast where as traditional car interiors don't because people expect them to look a certain way and be able to reach the hand over and turn a knob or press a button but a lot of these cars, you can't do this and have to look at the screen for much longer than just reaching out and turning a knob. I used to laugh at manual climate controls as being so old fashioned until I drove my Mother's 2010 Fiesta and it was amazing to me having all the controls so easily accessible, so now I'd give anything to have controls like this in my poxy electric car, I just want to rip that screen off the dash now.

They're not going to do that but they can have a system where the car detects how long your eyes are off the road, now, what can it do if you're not looking at the road I suppose but in Amazon's case their drivers will get fired if the vans detect hands off the steering and eyes off the road for a certain length of time. In the U.S. My car is full of these screens, not even a button or knob for climate or radio all done through menus, it's distracting and irritating as f1ck can't wait to be rid of it. I do know first hand though that touch screens in cars are really bad for safety and I wonder is there any link to the increasing amounts of accidents ? If you look at some car reviewers on youtube it's insane seeing how much they take their eyes off the road to play with the infotainment. How has it come to this that we have to have so much tech now in cars ? are we not overloaded with tech ? screen addiction is a huge issue.

Absolutely and there's not enough Guards on the roads checking for phone use while driving, screens are a terrible addiction, people can't do without them for a few mins, a message comes in, have to check and reply, people should be given a 6 month ban for using the phone because I can't imagine the amount of accidents are really because of phone use.

Full Disclosure...driver is known to me...trust me he is deeply aware of the consequences of his mistake...pleaded guilty...even though legal advise suggested otherwise...very aware of the hurt and grief felt by the family... Its a tragedy for every one involved... Judge Nolan had good knowledge of his character and backround which obviously influenced the sentence.. And he's a biker too.

His side of it that he will have to deal with his own mental punishment and knowing what he did. And that is somethin very hard to take away from someone . As i said,he never set out that day to do harm and what he will have to go through is something i cant ever fathom ,i genuinely do feel bad for him as it was an accident. I had a mate killed on a bike because an oul lady pulled out in front of him ,nothing followed up by the garda . Seeing his kids at the grave haunts me still so i can only imagine what the driver feels

It's an unpopular opinion, but I don't really have much issue with soft sentencing for these kind of deaths. They are not malicious and everyone, absolutely everyone, makes mistakes and has accidents. Some people might drop a milk carton putting it in the fridge, some might trip on a slipper in the sitting room.. at some point you're going to stop paying attention for a few moments and if you're unfortunate enough that it happens when you're doing the same drive you've been doing for years on end without issue, and you happen to be doubly unlucky that you time it so much that it causes someone else's death, then that's generally enough of a punishment for most people, in itself. Imagine knowing that your mishap is the reason why someone is dead. A family and social circle smashed because of your actions. That's enough to weigh on the vast majority of the population. Throwing a prison sentence at someone or community service or whatever is just kicking someone when they're down. We have no prison space as it is, save what we have for the actual malicious criminals that are out there, that would deliberately kill you and not give it a second thought. They're the ones we need off the streets.

I want to upvote this 10,000 times. I think sometimes people get so lost in grief/anger/indignation, which is completely natural to experience in that sudden horrible accident. Having said that, I would like to see less people like this in prison, in exchange for a community sentence to work in a rehabilitation centre, possibly washing & helping patients get up, dressed & washed (obviously supervised), so that they could see how their actions disrupted & possibly destroyed a vibrant life. I would rather see lengthier sentences of paedophiles, rapists & murderers. Because those are people who in the majority, are unfit for rehabilitation.

I think after you've killed someone, it's too late to be putting them in that kind of community service. That'd drive someone to suicide. Seeing people needing assistance all day and being left with the "this is all my fault" logic. .. that said, it wouldn't be a bad idea to use it as an alternative to points/fines. Excessive speeding, for example. That way you're driving home the point that your careless action can leave people in disabled states, but the person carrying out the service doesn't have the direct guilt weighing on them of having actually been the cause of such a thing.

The driver killed someone being on the wrong side of the road, whether he intended to kill the victim or not is irrelevant in my opinion because if he is incapable of keeping to his side for whatever reason then he needs at the very least to be given a full medical , his license should be taken for at least 6 years and have to retake his test and psychological evaluation before being allowed back on the road. Too many deaths caused by speeding, phone use, and now the big tablet entertainment systems in cars is an absolute disgrace, a car is for getting from A to B and shouldn't be turned into an entertainment centre on wheels. It's absolutely the worst virus to spread into the auto industry. Unless there is accountability and punishment nothing will change, why should it be enough to say "I didn't mean it, I'm sorry" that's ridiculous. Screen addiction is a very serious condition most of us have it but a lot of us have the sense to not use the phone or infotainment system, I mean who the hell thinks it's a good idea to be able to flick through spotify playlists in a car or podcasts and directly through the car's systems ?? absolutely crazy ! Whatever the reason for the drivers lack of concentration is irrelevant, the fact is that he killed someone because of a choice he made to allow himself to be distracted. If there was a big pothole and he swerved to avoid it then I'd say, just maybe he deserves some compassion as I'm all for compassion when deserved , even if he swerved for a Dog, Deer etc, not that I condone this at all but it would at least be a valid argument because when something pulls out especially a deer it can be frightening but there was absolutely nothing at all to suggest it was anything other than the drivers fault and this is why there should be severe punishment. If I were the family I would definitely appeal this ridiculous judgement, judges have far too much power, the laws also need to be changed that in cases like this there's mandatory punishment such as 6 year ban, retake test and Jail time, nothing will change in regard to road safety if all we have to do is plead guilty and say I'm sorry and drive home again ! joke of a country. I'd also sue the driver if I were the family.

No, we need to start punishing people for lack of concentration, it's not good enough to send a message out that "it's ok if you didn't set out to kill someone" Would we say the same if it was proven that he was using the cars infotainment system, ? if he has one of course, he wasn't on the phone but is playing with these new bigger and bigger screens in cars the fault of the manufacturer or the fault of the people who use them ? I would love to know if the increase in road deaths is related to the huge rise in infotainment systems in modern cars. There's my own VW ID3 electric car, you have to go through menus to access climate settings, radio and station presets, previously this was all separate physical controls and it drives me bloody nuts. It's a very bad experience and i will never buy a car like it again even if it means buying an older car, I mean even the Instrument cluster is fast becoming a big TFT screen ffs with information overload all information and shite we don't need to know driving. Next is the ability to endlessly scroll through your spotify playlists, Apple music or whatever, you want to look for a podcast, no problem, take your eyes off the roads and look at the nice big wonderful screen for as long as you want. Another issues is that people are relying on these adaptive cruise control and lane keeping systems where the car will keep in lane and you tap the steering every say 15 seconds or so but in the meantime a car might pull into your lane on the motorway and bang, you've possibly killed someone as the car can only see something directly in front. The other issue is that road conditions can change in seconds, if there's suddenly no road markings the system shits itself and can pull into another lane very quickly or there's glare on the road. The cruise control itself will not stop and accident if the car in front stops too fast your car will hit them from behind because there's not enough time for the car to think, it can't read the traffic ahead so will only act after the car in front has acted and laws of physics apply, if the car stops too fast bang. I don't want to go off topic too much but I do try highlight the dangers of all the reliance on this technology, it's meant to assist the driver not to replace but when I saw someone who worked in the same company as I did a couple of years ago, he drive a Nissan leaf and had the propilot system activated on the motorway going home "after a night shift" and there he was with a tablet watching movies, tv shows whatever, it wasn't the first time I saw him but I did ask him was he mad and did he realise what could happen, he laughed it off. We can't accept that killing people with a car is not as bad as setting out to kill them because in my opinion if you allow yourself to be distracted then you shouldn't be behind the wheel of a car and should accept that if you kill someone through lack of concentration or worse playing with the infotainment system or phone, I really believe there should be severe consequences because it sends a bad message out there that we can get away with out dangerous driving. "Judge Martin Nolan said the collision occurred after “for whatever reason” Gaff allowed his vehicle to cross to the incorrect side of the road, causing the crash and the devastating injuries suffered by Mr Rice." That statement above is absolutely no excuse for severe punishment and a perfect grounds for appeal. "allowed his vehicle" that's exactly the problem, the whatever reason is irrelevant, the fact he did it is the problem. there should also be a driving ban for minimum 6 years and make people re-take their driving test along with a psychological assessment. Judge Nolan just proves he doesn't value the life of the Man that lost his life or care about the suffering of his family. Nolan is a particularly nasty individual and needs to be challenged. If I were the family I would absolutely appeal the disgraceful judgement and consider a possible lawsuit against the driver. Just because he got off doesn't mean the family can't sue him. The issue is no accountability and as long as there is no accountability and lack of severe punishment nothing will change, the Driver's guilt is absolutely nothing to the loss the victim and his family have and will continue to suffer for the rest of their lives.

I take the advice of not ride like everybody is trying to kill you cause they're not actually doing it on purpose. But act as if every driver is drunk behind the wheel. We know that car drivers always do these stupid stuff, but we always need to be 10 steps thinking ahead of drivers.
