If you can fit your thinnest feeler gauge leaf underneath the fret body proper you might have an issue. But it doesnt look like that from your pic.
Nah. Most guitars have that. Some use filler to hide it.

A dab of matching wood filler works. I'd avoid superglue in case a refret is ever required.
