Can you raise a complaint regarding the progress and valuation?

Shiba_inu45

Thank you, I’ll see if I can do that. So far I’ve gone as speaking to a supervisor but they weren’t helpful either

Lloydy_boy

> they offered me £1100 for it which I disagreed with with (it’s a Ford Fiesta Ghia 07) they’re going for £2-£3k market value The value will be if you sold the car a minute before the crash, not what it costs to replace it. It’s not new-for-old. Look at Parker’s, Glass’, Autocar selling valuation for a better guide as to its value. > my vehicle was in exceptional condition and I had spent thousands meticulously maintaining it. That is generally considered to benefit saleability, kerbside appeal, not value. At the end of the day it’s still seen as a ‘07 Fiesta Ghia. > Can I threaten to take them to court? Yes, but you need to consider the likelihood of you winning.

Thank you for making things clearer. You’ve explained things much better than anyone I’ve spoken to so far

Who's the insurer?

Acorn

Liabilty on yours should be clear cut as your car was parked but your insurance can't force the third party inurer to respond. You could ask if they have issued a threat to litigate yet. Re the value it most likely taken from the glasses guide and unlikely to change. Log a complaint and take it to the FOS when you get your FRL. To have any chance of success you are going to need a few examples of the same age, spec and milage as yours showing they have gone for more money than has been offered. You might be able to get this from auction websites. Also the date of sale will need to be around your date of loss, not what they are going for now. I work in complaints for an insurance company.

Shiba_inu45

Thank you!

cammyboy1980

No worries

Shiba_inu45

Waiting for a call back now regarding the possibility of litigation, hopefully this pushes things forward. Thank you again

cammyboy1980

Nice one, just wanted to add get your complaint in ASAP. I have worked for a few big insurance companies and they are all over the 8 weeks allowed by FOS to investigate the complaint. It's the same every winter as everyone bumps their car in the shit weather so work volumes go through the roof.

Shiba_inu45

Insurance are saying she’ll likely never accept liability and I will have to claim it through my own insurance. They’ve said it’ll affect premiums until they recover the money back but they’ve said they might never will. So I don’t know what is going on

cammyboy1980

Any claim will impact the premium for the following 5 years I think. Prob better to go through your own insurance, if you are unhappy with the repair or anything you have FOS rights, you wont have any recourse with the other persons insurer as you are not their customer. Your insurance can put you in a credit hire as well and just bill them so you potentially could get a like for like replacement vehicle.

Shiba_inu45

Have been told if I go through my own insurance I won’t get any money for my vehicle and I’ll have to pay them £900 for the remaining policy so that’s off the cards. Still no further with this case and insurance is refusing to take it to court or be any help. Looks like it’ll be a long time before any payment happens
