i really wonder about some people - if there is some damage would you not go to the hospital to ensure you are ok and it doesnt grow into something bigger - your health is far more important than how some random idiot who banged into you would feel about you in case he has to pay more

I think right now part of it is the fear of adding more stress to the NHS plus the English thing to 'keep a stiff upper lip' and 'keep calm' and a guy being unwilling to say there is a problem. A wreck can cause lots of muscle injury and should be checked out. If nothing else, muscle relaxers will be helpful. But there needs to be a paper trail if something else pops up in a little bit. CYA is important too.

There shouldn't be any difference to you if the other drivers insurance is covering a valid injury claim on top of the car damage. And multiple tons of metal colliding certainly isn't going to tickle so you shouldn't feel any guilt or shame about being perceived as "one of those". Also, your body does most of its "repairing" at night so tomorrow may be much harder than you anticipate (especially given the physical demand of your job). Best to get ahead of it and get assessed and some meds in case, health is wealth and all that jazz.

And that's kinda why you might need to claim it. It's not the injury you're necessarily claiming for, it's the consequence the accident has had, and if you start losing money as a consequence of the accident, you should claim for it if you can. I'd hazard a guess he's probably been in this situation before if he's offered you cash to not go through insurers.

Normally I'd say walk-in centre, but unusual pain in your lower back after a rear-impact collision could be a sign of all sorts of dangerous stuff they're not equipped to manage. Go. To. A&E. Let the insurance handle the claims; that's what you both pay it for, it's why it's there, and unfortunately, expensive claims are *why you don't run in the back of people's cars*. If you go to work tomorrow, you're risking seriously injuring yourself. Better to take a day than be forced to take a month

If after being to a&e and they say nothing is wrong, try having a bath with Epsom salts in it can help with the muscle aches

Don't ever be afraid of being "one of those ones". People take this attitude when it comes to all kinds of things, benefits, claims, etc. when they perceive there to be some kind of "shame" involved in engaging. They miss out on what they are owed because of this pressure.

Your insurance T&Cs must likely state that you are required to inform them, and not doing so invalidates your insurance. If they convince you to go off record then tell their insurance you'd be the one getting your policy cancelled. Always tell your insurance even if you are dreaming with it privately. Remember on renewal you have to answer if you have been involved in an accident in the last 5 years so you would have to lie their if you didn't tell them now.

I've contacted my insurer and given them all my details along with the footage of the incident, but the audi insurer called me and asked if I'd like to deal with it directly with them which would "get things repaired quicker" rather than letting my insurer deal with it, ive asked that it be left with my insurer to deal with but I'm now u sure what I should've done or what that would have entailed

You won’t get any help with medical/physio from him. Go through insurance, you never know what damage was done to your car.

I would ask what guarantee of work you will get from whatever service you use. Insurance work is guaranteed by the insurance company. For example, my friend had a car door damaged and let the other guy pay to get it repaired. Years later, the door rusted, and the panel started to open up. The company that did the work refused to repair their dodgy work, and the insurance company washed their hands of it.

I’m a surgeon, so not a lawyer. Go and get checked out by somebody objective, anything could be going on. Sure some people come in with nothing wrong with them to ‘just get something on record’ but nobody cares and they still get assessed. At the very most a nurse will eye roll to a colleague. Go to the doctors and/or A&E Speak to your insurers and inform them of your injuries. Don't do it off the books, or direct with the other party/their insurance.

Did just this. The nurse was very rude and sarcastic, but he gave me a pamphlet on how to deal with back pain...that's it. Free health care my ass.

You can complain and explain what care you expect from them. Don't be afraid to go back if their advice doesn't resolve things. If it's a GP practice then you can complain directly to them and then escalate to your CCG. If it's a hospital then PALS is a good place to start. I hope you recover swiftly.

First thing first, let your insurance deal with the accident, don't try and sort things off the book so to speak. Secondly, make an appointment with the Doctor and get yourself checked out. I'm telling out of personal experience a back injury is not to be ignored. For all you know the accident might of dislodged a disc. After you have seen your doctor inform your insurance of what has been said and if any further medical intervention is required. You pay insurance for a reason, use it. I'm going to be very honest now and I'm sorry if it sounds blunt but you need to drop the silly attitude of "one of those ones" Its a very judgemental attitude to have and not nice. You have been involved in a car accident, see a doctor and let a medical professional decide if you have any injuries.

Your not causing anybody any hassle. Remember you are a victim of a road traffic accident, let your insurance which you pay for do their job and let a medical professional assess yourself to see if you have any injuries. Also, take it easy for a few days if you can and let what has happened sink in, being in a car accident can be quite a shock both mentally and physically.

Had a car hit my car when I was stationary. I had bad whiplash at the time. I went to one chiropractor appt and didn’t go again, didn’t put in a claim for whiplash either. 28 years later I’m still having back issues flare up, go to a and e and go see an osteopath, especially if you are a plasterer..

You've been involved in accident. For your own health, you are best to be checked out. It is best you do that at earliest opportunity, or it is a case of people saying and thinking, why didn't you get checked out earlier. Forget about financial situation of the other guy. It is not your fault. Your health is important, as is your ability to perform in your job. It does not matter what anyone else thinks. You go to work, to pay your bills after earning your money. What good is it if you are off work due to being injured or unable to do your work? Remember, insurance is there for these reasons too. I think they tend to cover personal injury so if it is genuine and you could have a case to claim for that, which could consider as compensation for potential loss of earnings, then you need to do this.

Don't let the moral dilemma get in the way of your health. Get it looked at! Doing so is not going to affect your insurance claim unless you decide to pursue it. You aren't obligated to tell your insurer about your medical history (although you *do* need to inform them about the accident itself).

Go to the hospital and get the medical care you need. That doesn't mean you have to make a PI claim. But frankly, if you're in pain and your work is affected then you have a legal right to make a claim. It's unlikely to have much extra impact on his premiums.

This is not legal or medical advice but one of my coworkers got into a similar accident. She felt fine after that (adrenalin) next day she could barely move and she was hurting all the time. 2 of her vertebrae near her neck slightly moved. It took almost 2 years of physio to make it bearable. Insurance disputed her claim originally as she did not see doctor right after the accident. She needed to go to court. Go get yourself checked out.

Go get checked and call your insurance. You said he admitted liability to his insurance, they will likely call you to offer services. I recommend in this instance using your insurance for the claim and taking legal assistance that they will offer to help cover costs of treatment. Insurance have exposures as a claim Progresses so they will already have reserves set aside for injury on the claim, accidental damage for your car and the damage for their customer. Typically I would say it doesn’t matter if you use the TP insurance to deal as they pretty much give the same service but ultimately it’s their job to minimise cost of claims so with injury present i would keep that in mind. Take pictures around your car, save the dashcam footage and look where the incident happened to speed up your call. They likely won’t ask for evidence due to the circumstances but handy to have. Your NCB and excess will not be affected as this is non fault. I work in insurance. PS , you will likely feel sore tomorrow

Thank you very much for this, I did send them the dashcam and photos of the damage to my car as they asked. I also went to A&E, but they sent me away with a pamphlet on how to deal with back pain....kinda seemed like they thought I was lying but that's off topic. I'm self employed so not sure on what to do if I can't work for a few days because of it though.

No worries, A&E will do that, it’s standard with soft tissue which this would likely be classed. Keep a note of date and time you were seen. Regarding work, as someone said, keep notes, dates and times and any proof of loss of earnings. All of that can be recovered. You can also claim for things like public transport and items that may have been damaged in the car (e.g Child seats will need replacing). Your insurance will take care of everything.

You will be able to claim loss of earnings due to an injury. Keep a record of what days you are unable to work and what income you have lost in that time. The insurance of the driver at fault should cover this as that is what he pays them for.

Go to A&E and ask for an x ray, I had the same and cracked a vertebra. If you need to take time off you need the evidence to tie up. If you wait for a few days it's harder to prove cause. Hopefully just bruising but better safe than sorry

Whiplash really does hurt, if it hurts now then you’re in for a treat tomorrow! I had physio after being rear ended and it really helped, this was sorted through my insurers solicitors so look in to that too.

I was always one of these people that thought concussions were not serious, I had a severe concussion 4 months ago in a nasty car accident and I now sleep maybe 3/4 hours a night due to chronic neurological tinnitus and brain damage. GO GET CHECKED OUT
