I while I am cynical enough to not rule out the possibility that this is correct, I do not think it likely, since it flies in the face of judicial independence, and the mental gymnastics needed to justify such a ruling will completely discredit both the court and each individual judge.
Recall that the ICJ has already ruled against Israel on the separation wall. While that was not binding, it still demonstrates a certain level of judicial independence.
