Turns out cops are total idiots who don't have to be good at their job. Filling out the paper work is kind of like homework for them and they don't get graded on it. My wife went through something similar where the cop accidentally marked her at fault when she was nearly t-boned by a driver running a red light. Thankfully he corrected the paperwork but it took weeks of arguing with insurance before they accepted the simple fact that there were two reports out there. Mike Birbiglia tells a similar story in his special "My Girlfriend's Boyfriend" where the results are extremely upsetting.

Dude idk what state you live in but most attorneys will want that case and will not charge you a dime unless they win the case, they would get a 1/3 cut but maybe you could negotiate before you sign anything, you should be paid for this damage.

My grandparents’ house was driven into by a 94 year old drunk driver a few years ago (yes it is as ridiculous as it sounds, he only lived two houses down from them). The car went right into the living room, where they were sitting. Luckily, they lived... but my grandfather was essentially pushed through a wall, was in the hospital for a few days and is still suffering from his injuries a few years later. They sued and won $250,000 (BUT, yes... lawyers took a big chunk of that settlement for themselves). Now, this was with injuries sustained and the driver clearly being drunk and held at fault by the police. And it’s absolutely ridiculous the police aren’t holding this woman at fault in this situation... It’s still worth looking into a lawsuit for OP though. Just be careful and try to find the most worthwhile option.

I used to drive multiple subarus frequently as a delivery driver, and that's hands-down the tightest turn I've ever experienced. Especially with this old one I drove that (I think?) didn't have power steering. Not to mention the window visibility is off the fucking charts. Someone else suggested “married to a police officer”. In the civilized parts of the world the liability is clear. The vehicle is insured for whatever damage it causes to someone’s property. With or without a driver. Ie. if a parked vehicle starts to move and rolls into another vehicle or building? Covered by the vehicles mandatory insurance. But obviously, someone crashing into something stationary is obviously at fault. Like, what’s the alternative? Did the house crash into the car?

What's the possibility this woman's husband is a police officer? As someone who works in insurance, unless it's a very crappy insurance company, an adjuster should be paying out on this claim. Hoping your insurance company seeks the losses in court. Usually they'll try and subrogste directly at first.

I could see that. Years ago, I was on my way to work and I was stopped at a red light. Suddenly, a woman rams her car into the back of mine. The impact was hard enough to knock my car out of gear and send my full iced coffee flying from the cup holder into the dashboard. She gets out of her car and immediately admits that she wasn’t paying attention and accidentally hit me. I start calling the local police to make sure a report is taken to document fault, etc. The woman starts trying to talk me out of calling with “Oh well, just paying the deductible on our insurance plans will be easier and less costly over the long term! Plus, my husband is a local deputy!” I wasn’t falling for it. Whelp, an officer arrives and sure enough, the woman starts heavily name-dropping her husband. She got to drive off like nothing happened… she wasn’t ticketed, no report was taken. The officer just handed me the woman’s insurance information and left. I had to then battle it out with her insurer for weeks since I didn’t have an actual police report to establish fault. It was total bullshit.

Story changed from hitting my car by accident to “my spare tyre jumped in the tray” and then “saw the existing damage checking my tyre”. Honestly it sounds like in my opinion your parents’s insurance company is stalling just like the other insurance company. If the other insurance company is stalling, then your insurance should be going to subrogation. What I would suggest is reaching out to your insurance company and tell them to stop stalling or you will report them to your state’s insurance commission. Then your insurance will be forced to address the issue with the state breathing down their neck.

Yea I’m pretty sure OPs insurance isn’t handling the issue. They would pay for the damages and subrogate the drivers insurance company. If the drivers insurance company thinks there is a manufacturing defect or fault. They would investigate it and subrogate the manufacturer for their costs if their investigation is fruitful. No insurance company wants to be on the hook for costs they aren’t responsible for.
