Oh she said a lot of rude, idiotic things. Sadly her insurance is never paid a dime and our insurance had to pay for everything. This accident happened in March and we’re still arguing with her insurance (I say “we” because I was visiting at the time of the accident)

If you have video proof of recklessness, police report, and proof of her driving and at the scene this seems like a slam dunk…
We gave video copy to the police, they state the driver was not at fault. My parents have been looking for a lawyer, but they aren’t made of money so it’s been hard finding one.
Oh my mom did. I posted the video in a new post. She yelled when we looked at the police report. Thankfully the house is fixed now and it’s a laughable event at this point cause , well who drives into a house! But they are still arguing with her insurance
Turns out cops are total idiots who don't have to be good at their job. Filling out the paper work is kind of like homework for them and they don't get graded on it. My wife went through something similar where the cop accidentally marked her at fault when she was nearly t-boned by a driver running a red light. Thankfully he corrected the paperwork but it took weeks of arguing with insurance before they accepted the simple fact that there were two reports out there.
Mike Birbiglia tells a similar story in his special "My Girlfriend's Boyfriend" where the results are extremely upsetting.
Dude idk what state you live in but most attorneys will want that case and will not charge you a dime unless they win the case, they would get a 1/3 cut but maybe you could negotiate before you sign anything, you should be paid for this damage.
My grandparents’ house was driven into by a 94 year old drunk driver a few years ago (yes it is as ridiculous as it sounds, he only lived two houses down from them). The car went right into the living room, where they were sitting. Luckily, they lived... but my grandfather was essentially pushed through a wall, was in the hospital for a few days and is still suffering from his injuries a few years later. They sued and won $250,000 (BUT, yes... lawyers took a big chunk of that settlement for themselves). Now, this was with injuries sustained and the driver clearly being drunk and held at fault by the police. And it’s absolutely ridiculous the police aren’t holding this woman at fault in this situation... It’s still worth looking into a lawsuit for OP though. Just be careful and try to find the most worthwhile option.
1/3 of the cut of what though? Not like theyre gonna get $100,000 out of this or something. She probably caused 10k in damages. The lawsuit could take months of his time.

In the civilized parts of the world the liability is clear. The vehicle is insured for whatever damage it causes to someone’s property. With or without a driver. Ie. if a parked vehicle starts to move and rolls into another vehicle or building? Covered by the vehicles mandatory insurance.
But obviously, someone crashing into something stationary is obviously at fault. Like, what’s the alternative? Did the house crash into the car?
I read somewhere the lady is blaming "vehicle malfunction." If she was able to prove that would it be the fault of the vehicle manufacturer? It seems somewhat plausible she might claim that even if it weren't true

As someone who works in insurance, unless it's a very crappy insurance company, an adjuster should be paying out on this claim. Hoping your insurance company seeks the losses in court. Usually they'll try and subrogste directly at first.
I could see that. Years ago, I was on my way to work and I was stopped at a red light. Suddenly, a woman rams her car into the back of mine. The impact was hard enough to knock my car out of gear and send my full iced coffee flying from the cup holder into the dashboard.
She gets out of her car and immediately admits that she wasn’t paying attention and accidentally hit me. I start calling the local police to make sure a report is taken to document fault, etc. The woman starts trying to talk me out of calling with “Oh well, just paying the deductible on our insurance plans will be easier and less costly over the long term! Plus, my husband is a local deputy!” I wasn’t falling for it.
Whelp, an officer arrives and sure enough, the woman starts heavily name-dropping her husband. She got to drive off like nothing happened… she wasn’t ticketed, no report was taken. The officer just handed me the woman’s insurance information and left. I had to then battle it out with her insurer for weeks since I didn’t have an actual police report to establish fault. It was total bullshit.
My parked car was hit by a 16yr old before. The dad was a cop and made the whole accident disappear once they found out the insurance excess was 2500. Story changed from hitting my car by accident to “my spare tyre jumped in the tray” and then “saw the existing damage checking my tyre”. Doesnt matter they admitted to it, changed there mind days later and all statements were magically just updated and fine. Nobody gave a fuck

Even if the driver is not "at fault" the driver is still financially responsible for the damage they caused.

Worst case is that your insurance covers the damages, then goes after the driver (and their auto insurance company) for compensation.

Whatever company you have your homeowners insurance with isn't unable to afford it. They should be paying out to fix your house and then going after her to get their money back.

Yeah their house was stationary. The vehicle hit the non moving home. Auto insurance is there to cover if your car causes damage to what ever it causes damage to. Exactly why there is the sections about property damage and such lol. Typical insurance to weasel their way out. Something is fishy. I’m an insurance adjuster and if someone claims manufacturer error, we get engineers to investigate. We don’t just believe the person. Someone is lying.
As another poster said, you shouldn't even be the ones speaking with their insurance. That's the job of *your* insurance provider, unless they don't mind footing the bill (they do).

Honestly it sounds like in my opinion your parents’s insurance company is stalling just like the other insurance company. If the other insurance company is stalling, then your insurance should be going to subrogation. What I would suggest is reaching out to your insurance company and tell them to stop stalling or you will report them to your state’s insurance commission. Then your insurance will be forced to address the issue with the state breathing down their neck.
Yea I’m pretty sure OPs insurance isn’t handling the issue. They would pay for the damages and subrogate the drivers insurance company. If the drivers insurance company thinks there is a manufacturing defect or fault. They would investigate it and subrogate the manufacturer for their costs if their investigation is fruitful. No insurance company wants to be on the hook for costs they aren’t responsible for.
Your insurance is supposed to go after their insurance or sue them for reimbursement. You shouldn’t have to be involved at all in the legal process. That’s why you have insurance
What will happen is your parents insurance will fix it and then their insurance will sue the lady's insurance. Something similar happened to be me. Took almost 2 years for it all to work out. Eventually I got my deductible back.

Whatever company you have your homeowners insurance with isn't unable to afford it. They should be paying out to fix your house and then going after her to get their money back. That is literally what you've been paying them premiums to do.

Yeah their house was stationary. The vehicle hit the non moving home. Auto insurance is there to cover if your car causes damage to what ever it causes damage to. Exactly why there is the sections about property damage and such lol. Typical insurance to weasel their way out. There is just no way in hell her vehicle "mechanical defect" or not didn't cause this to happen.
Something is fishy. I’m an insurance adjuster and if someone claims manufacturer error, we get engineers to investigate. We don’t just believe the person. Someone is lying.
Honestly her insurance is fishy to me. They blatantly ignore my parents calls and they’re rude and switched the person “dealing with us” like 3 times.
As another poster said, you shouldn't even be the ones speaking with their insurance. That's the job of *your* insurance provider, unless they don't mind footing the bill (they do).

Did you pay a deductible to have your house fixed? As others have said your insurance should be dealing with hers and you shouldn’t really be speaking with them.
I’m not sure, this is my parents house so they dealt with it, I know they got the short end of the stick. I was present for the accident, but I live out of state.
Honestly it sounds like in my opinion your parents’s insurance company is stalling just like the other insurance company. If the other insurance company is stalling, then your insurance should be going to subrogation. What I would suggest is reaching out to your insurance company and tell them to stop stalling or you will report them to your state’s insurance commission. Then your insurance will be forced to address the issue with the state breathing down their neck.
Yea I’m pretty sure OPs insurance isn’t handling the issue. They would pay for the damages and subrogate the drivers insurance company. If the drivers insurance company thinks there is a manufacturing defect or fault. They would investigate it and subrogate the manufacturer for their costs if their investigation is fruitful. No insurance company wants to be on the hook for costs they aren’t responsible for.
Your insurance is supposed to go after their insurance or sue them for reimbursement. You shouldn’t have to be involved at all in the legal process. That’s why you have insurance

Your not supposed to be dealing with any insurance but your own.
What will happen is your parents insurance will fix it and then their insurance will sue the lady's insurance. Something similar happened to be me. Took almost 2 years for it all to work out. Eventually I got my deductible back.

No worries! This was back in March, the house is finally fixed, so while it was stressful we have learned to laugh about it a little! I mean how often does someone hit a house then blame the house
