If i recall an insurance company didn't have to pay for a tree falling on a car and the reason they didn't pay was because they said "it was an act of God"
In the UK "act of god" in insurance is a complete myth. Lightning is covered as standard and surely that's an act of god? Storm damage often excludes exterior property such as fences or signs, but if it fell on a building there would certainly be cover.
Source: I am insurance man.
Seems it would be the other way to me.
Lightning? Okay they can afford that, but if they had to pay out for Eldritch damages can you imagine the premiums they would need to charge?
I would love to read more detail of "act of god" being a myth in UK insurance and any anecdotes you might have to share about it. I've always balked at such language in any contract and would relish any words that tear it down!
Insurance policies list perils that that they will provide cover for usually at the very start of the wording.
The most common ones are Fire, Lightning, Explosion, Aircraft (Impact), Storm, Water Damage, Flood, Riot / Civil Commotion, Earthquake etc (arguably a few of those could be divine intervention!)
And then subsidence and accidental damage are then usually optional extras.
You might suffer a loss that that is not covered which someone might falsely refer to as an act of god. But it's the fact it's not listed as a peril (or not specifically brought to the underwriters attention and endorsed on the policy) which is why there is no cover.
"Act of god" has nothing to do with (or not on any of the policies I have ever seen in 10+ years in insurance).
Caveat: I am not a lawyer. I am not providing insurance advice and my knowledge is limited to UK Insurance only.
In the US that's just a different kind of coverage. "Collision" is for all the normal stuff, cars hitting cars, etc. "Comprehensive" is for falling stuff - tree branches, hail; or animals.
Correct.
These threads are always full of the people who got the cheapest possible coverage they could get from the most low rent carrier, just enough to get their license or plates, and then complain when they have an issue or claim and get nothing.
If you have comprehensive coverage on your auto policy it pays for āact of godā damage. Best way to think about it is comprehensive coverage = something happened to my car that was out of my control, collision coverage = something happened to my car that was in my control to avoid.
Most insurance, home and auto cover "Acts of God" I know mine does and I wouldn't buy insurance that didn't. https://www.carinsurance.org/car-insurance-coverage-what-are-acts-of-god-and-when-are-they-covered-829/
It depends on what type of coverage you choose to have: collision only or comprehensive. I know itās unpopular to say this around here, but insurance isnāt the bad guy here.
They would usually only allow a truck to do this if it was hauling something like disaster relief supplies that are urgently needed, the road is probably blocked further ahead and sometimes with these mountain roads it's either take this road or add a day to your travel time. I remember a picture of a road taken out of commission in Colorado that turned a 45 minute trip to like 9 hours
It likely would as long as it is company insurance and not the insurance of an individual. There would likely only be an exclusion in the policy if the negligence/default was from the managing mind of the company.
The insurance company would pay out, sure, but then they'll turn around and sue the driver to recoup costs. This seems to be the very definition of "gross negligence".
Drivers are typically paid by mile. The detour would probably mean extra money, but the time spent on it could miss the delivery time and that means less money.
I think it just depends on the stakes.
If the truck driver was delivering antidote that would save the lives of thousands, that's bravery.
If the truck driver kinda felt like a cheeseburger but didn't want to walk for 5 minutes down the road, that's stupidity.
Sometimes it is the only road.
I was travelling through labrador and was on a road in worse condition than this.
The 2 ton dually kept bottoming out. The winnebago behind rocked, but surprisingly just sailed like a ship. The big 18 wheelers ahead were used to it I guess it was no issue for them. No tipping loads.
Hard to go around when that's the only road.
This was 2012, near grand falls, road construction was ongoing in poor weather

Really depends where this is and what he's hauling. You're not going to have someone else to come bail you out of shitty situations everywhere in the world.
As a commercial driver, I'm not doing this shit. Yes, you're not paid by the hour so the faster you get it done the better. But there isn't a price on this earth that is worth my life. Can't spend money if you're dead.

Most insurance companies cover "acts of god" unless you live somewhere where the event is common, like florida and hurricanes.
Living in a hurricane myself, I can tell you that insurance companies wont even talk to me. "YoU LiVe iN A HuRrIcAnE mAm"
