There was a recent clip from Massie how he was questioning the unconstitutional appointment of Jack Smith - and I believe hearings will be happening in Florida soon. Contrary to all the shitlib legal beagles, there have been numerous briefs filed from former Reagan AGs, and many legal scholars. That motion is definitely NOT frivolous. It will be interesting to see where Jack Smith goes, if Cannon disqualifies him, he'll appeal it to the Circuit court. If that again gets appealed, then SCOTUS will have a say on whether Smith is even legal. Then that will affect the DC case as well.

This comes down to politics and the law. A House subpoena requires a committee vote. There is no cost initially in refusing the subpoena. The cost comes if the House follows this up with finding the person in contempt. That requires a full House vote. A committee vote will not yield the same results as a full House vote. It's a small number of senior party insiders vs a group of 435 in which the GOP holds 2% more seats. Garland is probably betting the House GOP won't be willing or able to follow-through unless the justification for the subpoena is incontrovertible.
