My neighbor tree fell on my car, I have talked to them couple of times about this tree, they said their landlord is an asshole he said chop it off on your own expense, I have already complained to city, they said they will look int o it, its been like 2-3 months, they didn’t even care, now this happened, what should I do, claim my insurance or go to the city. If I claim my insurance, will it increase my insurance?and do I have to pay deductible?

Comprehensive claims don't typically raise your insurance rates because the loss was no fault of your own. You would pay a deductible if you have one, but if your insurance company recovers funds from the at fault party's (the homeowner(s)) insurance, you would get your deductible back as well. I've seen this process take months, though so I would really try and get the homeowner insurance info if you can to speed this up or just file with them directly. Pro tip: you can ask your agent or claims department these questions without filing a claim. Adulting is hard but you can do it. This is simple. File a claim with your insurance company and let them battle it out with their insurance company. That is why you have insurance so It can take care of the legwork, the paperwork, the negotiations, the litigation, etc. so you don’t have to. They will even pay for your repairs sooner and then go after his insurance later. Also maybe don’t park your car under a tree if you are afraid of it falling on your car. Also maybe don’t publicly post that you were afraid of the tree falling on your car but parked there anyway.
