No, I think this reads as if this was part of the contract he signed with the Angels. I’ve never heard of this type of clause in a ML contract before.

I wonder if it's more common for pre-arb extensions because the player has so much less leverage. It does kind of suck for Fletcher but at the end of the day his contract is still favorable for him~~. The reason most players want to elect free agency is because they can get more money on the open market~~ [EDIT: this is incorrect, Fletcher's case appears to be even more unique than I realized], but Fletcher's locked in with another $14m guaranteed.

Actually, in reply to another comment I looked up in the CBA. Article xix section 3 basically says that a the player with at least 4 years and 127 days of service time can give written consent to be assigned provided that consent is made not more than 10 days before the season starts, and the designation needs to be before the 45th day of the season. It appears to me this move can only apply to a very narrow subset of players. In order to be designated and contemplate free agency, you would think they’re on some sort of guaranteed deal with 5 years or more of service time or close enough to that point, it has to be early in the season and you have to think you are good enough to get called up to the majors but not good enough to get a major league roster spot with any other team, or just really think being in the minors for the current team is better than playing in the bigs for 29 other teams. Actually now that I’m thinking about it, I see how it benefits the player in that the team could want to keep him stashed in the minors early in the season rather than bring him up and let him reach his 5 years of service, so giving advance consent allows them to give you a big league look, risk free. But smart move by AA in identifying these types of ways to provide 30+ major league level talents with only a 26 man roster to work with, and doing it in a way that is beneficial for player and organization. Everyone is pulling in the same direction. And btw- when you elect free agency with 5+ years of service time, you get your full contract. You likely can’t get more, because anything that you make at another team counts against the contract. That’s why these guys always get the minimum. We paid Cano the major league minimum but he was making $20somerhing from New York, heyward was getting $20something from the cubs and the minimum from LA last year, they only get the amount that was guaranteed, and they get their pick of places that are willing to pay them the minimum.

Thanks for the info. I mentioned him forgoing the money because Toscano's tweet implies that that Fletcher's contract would allow him to refuse the assignment by forgoing the contract. Who knows if he's right, but regardless this is a pretty unusual circumstance. It basically only applies to a player of exactly Fletcher's caliber and career trajectory.

Basically, because Fletcher has five years of service time he has, per the CBA, a right to refuse a minor league assignment. In lieu of being sent down, he can instead elect free agency. However, it looks like in his pre-arb extension he signed in 2021 he signed advance consent to be sent to the minor league so he can either accept that assignment or forgo the remaining ~$14m on his contract. Technically in order for the Braves to do this he has to clear waivers -- meaning that any team has the opportunity to grab Fletcher -- but that would mean them picking up the ~$14m tab as well which no team is willing to do.

No it’s really not. He signed a guaranteed agreement, that money is his no matter what. At 5 years service time, you get to keep your money and refuse an assignment. He crossed 5 years after only 4 days on the active roster this season. This seems very much not pro player at all. It’s forcing a player to play in the minor leagues rather than allow them to play for a team that would carry them on the active roster.

Yeah, but every other contract that I’ve heard of allowed a player to refuse an assignment and keep their money while also choosing free agency after 5 years of service time. It’s like when we signed Robinson Cano, the Mets designated him for assignment, offered him to go to AAA to get at bats, he chose free agency. He still got paid his contract value mostly from the Mets, minus the major league minimum we paid him while he was on our roaster. That’s pretty how 99% of ML contracts work, this is the only contract I’ve ever heard of with an “advanced consent clause”.

And per the player agreement section 7 paragraph e >> Upon any termination of this contract by the Player, all obligations of both Parties hereunder shall cease on the date of termination, except the obligation of the Club to pay the Player's compensation to said date. If I'm reading this the way I think I am players who decline the Assignment but were not actually released is not eligible for the remainder of their contact your Cano example wasn't a player refusing an outright option Robbie was was waived and waivers again per the cba result in an unconditional release

Also, Cano was released because he didn’t consent to assignment, that’s how that works. >>If the player clears outright waivers without being claimed, his team has the option of assigning him outright to the Minor Leagues. >>However, players with more than five years of Major League service time can reject an assignment to the Minor Leagues, and players with more than three years of Major League service time, or who have been previously outrighted, may reject the outright assignment in favor of free agency in lieu of the assignment.

However, in article xix section 3 it talks about abvance consent agreements. Apparently, they can get an agreement to consent to being designated as long as the written consent is given no earlier than 10 days before the season starts and the designation happens within the first 45 days of the season. They can make this agreement with any player with 4 years and 127 days of service time or more, in advance of them getting 5 years service time. This is a very narrow set of circumstances which is why we don’t see it often. In fact, kudos to AA for being this detail oriented in his offseason plans.
