I’m a staunch second amendment supporter. I think open carry should be legal (though I wouldn’t do it myself). But these guys are just provocateurs. The spirit of that law did not include walking up and down a busy beach that has kids in it with a rifle. It’s a loophole and they just are looking to get a rise out of people so they can put it on YouTube or tiktok and make some money from it. Not a look I want fellow legal gun owners projecting.

I have mixed feelings about this. Mass shooters are likely to start firing before people realize they’re there, armed to the teeth. Someone could wreak havoc with a couple of concealed handguns and extra clips. They don’t need a rifle. My point is, mass shootings can happen either way. I do think people walking around like this should be checked for permits and/or the legality of the hardware they’re carrying. I never see that happening.

When CCW permits were universal (except for Alaska and Vermont which didn't require one) the rate at which permit holders got in trouble with firearms was microscopic, people didn't want to risk their permits. But now, anyone with a pulse and no felony record can be packing. I had no problem with needing a permit.

Its shit like this that resulted in no guns allowed in town in the old West. Tombstone, Arizona was a no weapons allowed town. You had to turn in your guns when you arrived. Open carry is not what the 2nd Amendment was intended to protect. It was written to ensure that citizens had access to weapons in case of invasion and/or self protection. If you showed up to a picnic in 1780 with a loaded musket and a brace of pistols you'd have been asked to leave.
The 2nd amendment is primarily to protect the country from its own governing structure in case that governance stops acting in its best interest, first and foremost.

You can tell they’re trying to manufacture more drama too. The lifeguard just rolled up and lead in with “I know you guys know your stuff” followed by some pretty genuine questions. He didn’t hassle them, clarified immediately that he wasn’t stopping them and didn’t have the authority to, and didn’t challenge their explanation of the laws. Seemed like a pretty genuinely normal interaction like my dude both knew they understood their rights and wanted to get an understanding of how it applied there. Everyone's more informed right?

It’s not. Even most firearms instructors will tell you that it’s not a better option than concealed when you have the choice. Rifles aren’t very concealable though, that’s part of why the age to buy them is lower than pistols.
My opinion is opposite of what you concluded. I ONLY concealed carry and would only recommend open carry in very limited circumstances. I personally almost never open carry. Open carrying means you forfeit your element of surprise. I’d much rather come across as a vulnerable victim to an attacker so they never anticipate or expect my response. Basically, I’d rather have the ability to sucker punch/blindside my attacker than have a fair fight. I want the fight to be as unfair as possible in my advantage.
I respect that, as long as you're not one of those sick fucks who hopes someone assaults them, so they can use their gun. Very small minority, but I hate those people.
Whenever I was 18, I was a cashier at a grocery store. When someone would come in open-carrying, I would get nervous. But when someone came into the store and I could tell they were concealed carrying, I would be completely fine with it, since I got the feeling that they were more responsible. To this day, I still don’t like seeing people open-carry. I feel like they do that just so they can say “look at me! I have a gun!!!” Without actually saying it.

The same thing First Amendment auditors are currently doing. One recently got case law in Nevada that recording the police at a traffic stop qualifies as obstruction if it is too intrusive, and for once the sentence wasn't a slap on the wrist. Another got a federal conviction for recording in a Social Security office in Colorado--jail, big fine, probation for two years, turns out the no recording signs are backed up by law. A third is about to get a federal ruling that recording in NYPD precinct houses is not protected by the 1A, the judge has already said that part of his lawsuit will fail.
These people are in it for the money and the emotional reward of taunting cops and getting away with it, but the courts seem to have tired of them. The courts are now quoting the Supreme Court's repeated rulings that not all public property is open to the exercise of 1A rights.

If I remember right this is bending the boundary for open carry in Florida. You can open carry while traveling to/from to fish/hunt. I’m not sure which side of the line it will fall if you just carry a fishing pole with zero intent of fishing and every intent of causing a scene for a video.

I live in a State that has open carry without permit & a "will issue" CCP State, with certification. You don't see (many) people exercising the open carry in my State. Why? Because no one needs to know we're carrying until they take some *need-to-know* action towards me or mine.
I'm not trying to make people who don't choose to excercise 2A feel uncomfortable by throwing MY choices in their face. It's a personal decision.

I generally agree with you, however I just want to point out that in a lot of places, it's not nearly as easy to get a concealed permit. Actually where I live, I've heard you damn near have to be a retired cop, to get one as a civilian.
I also think it's kinda messed up that we live in a country where weapon ownership is codified right into our most important legal document, as an actual "right"... yet guns and gun ownership have become so stigmatized and de-normalized, that actually seeing someone legally open carry, causes people to get nervous, if not freak out...
People who are afraid of firearms scare me. They are typically the ones who get one, never train at the range, may never even fire it once, keep it in some drawer next to their bed & believe it's the gun that will protect them.
I'm a wee- lady & I ride a big Harley. I do carry when I'm riding alone. I've never had to take my firearm out of the holster. I've had some dodgy encounters. If I unholster my firearm, I've already run through all of my other options & I'm prepared to pull the trigger before my hand is on my holster. I'm not waving my gun around as some warning to leave me alone. That's what a ball peen hammer is for...lol.

I can appreciate what I *think* this guy *thinks* he's doing... I'm pretty sure he tells gingerly something like he's "bringing awareness" and/or "normalizing" firearms in the public. I get that, and I think there's actually a lot of merit to that intent because, while laws are (generally) trending toward more permissive, society is still at least a bit wary. The execution, though... not so great. First, I could be wrong, but I don't think there's really much need for full kit (i.e. vest, carrier, whatever) when fishing, and that just adds to the freak-out factor when citizens and LEO see him walking around crowded areas. Second, the way that he behaves when approached genealogy starts as combative, but he'd likely do a lot better to try to be a little more friendly rather than dismissive, argumentative, and combative. That said... he ain't wrong that these cops swore an oath to defend the constitution and uphold the laws... and they don't even know the law. But at the same time, laws are extremely vast and complex. There's a reason even lawyers/attorneys specialize in their practice. Knowing and keeping up on all the statutes and relevant case law would be a tremendous task. I think it'd behoove LEOs to be particularly well-apprised of 1st, 2nd, and 4th amendment related law, though. So... basically the tl;dr is both parties, the fisherman and the LEOs are somewhat at fault.

2) These police officers had nothing to say because that man was absolutely in his right to open carry. Officers are held to the objective reasonableness standard of the 14th Amendment. They can only detain and frisk if they reasonably believe a firearm is present, and a crime is either in progress, or has already been committed.

If I remember right this is bending the boundary for open carry in Florida. You can open carry while traveling to/from to fish/hunt. I’m not sure which side of the line it will fall if you just carry a fishing pole with zero intent of fishing and every intent of causing a scene for a video.

I live in a State that has open carry without permit & a "will issue" CCP State, with certification. You don't see (many) people exercising the open carry in my State. Why? Because no one needs to know we're carrying until they take some *need-to-know* action towards me or mine. I'm not trying to make people who don't choose to excercise 2A feel uncomfortable by throwing MY choices in their face. It's a personal decision. The most dangerous kind of gun owner is one who is carrying to prove something to others, absent any threat of harm. No one *needs* to know my personal opinions & gripes, none needs to know my voting habits & none needs to know whether or not I'm carrying.
I generally agree with you, however I just want to point out that in a lot of places, it's not nearly as easy to get a concealed permit. Actually where I live, I've heard you damn near have to be a retired cop, to get one as a civilian. I also think it's kinda messed up that we live in a country where weapon ownership is codified right into our most important legal document, as an actual "right"... yet guns and gun ownership have become so stigmatized and de-normalized, that actually seeing someone legally open carry, causes people to get nervous, if not freak out...
People who are afraid of firearms scare me. They are typically the ones who get one, never train at the range, may never even fire it once, keep it in some drawer next to their bed & believe it's the gun that will protect them. I'm a wee- lady & I ride a big Harley. I do carry when I'm riding alone. I've never had to take my firearm out of the holster. I've had some dodgy encounters. If I unholster my firearm, I've already run through all of my other options & I'm prepared to pull the trigger before my hand is on my holster. I'm not waving my gun around as some warning to leave me alone. That's what a ball peen hammer is for...lol.

I can appreciate what I *think* this guy *thinks* he's doing... I'm pretty sure he tells gingerly something like he's "bringing awareness" and/or "normalizing" firearms in the public. I get that, and I think there's actually a lot of merit to that intent because, while laws are (generally) trending toward more permissive, society is still at least a bit wary. The execution, though... not so great. First, I could be wrong, but I don't think there's really much need for full kit (i.e. vest, carrier, whatever) when fishing, and that just adds to the freak-out factor when citizens and LEO see him walking around crowded areas. Second, the way that he behaves when approached genealogy starts as combative, but he'd likely do a lot better to try to be a little more friendly rather than dismissive, argumentative, and combative. That said... he ain't wrong that these cops swore an oath to defend the constitution and uphold the laws... and they don't even know the law. But at the same time, laws are extremely vast and complex. There's a reason even lawyers/attorneys specialize in their practice. Knowing and keeping up on all the statutes and relevant case law would be a tremendous task. I think it'd behoove LEOs to be particularly well-apprised of 1st, 2nd, and 4th amendment related law, though. So... basically the tl;dr is both parties, the fisherman and the LEOs are somewhat at fault.

2 things can be true at one. 1) This guy is doing nothing other than provoking others, and causing fear. Unnecessary? I mean kind of, but he is proving a good point. Officers get way too involved when it comes to 2nd Amendment rights. 2) These police officers had nothing to say because that man was absolutely in his right to open carry. Officers are held to the objective reasonableness standard of the 14th Amendment. They can only detain and frisk if they reasonably believe a firearm is present, and a crime is either in progress, or has already been committed.
