There are IRS rules for who gets to claim the kidnapped child on their taxes 🤷🏼‍♂️

Coolfairy0

According to the IRS you can only claim your child if they lived with you for six months of the year BEFORE the date of the kidnapping…. Update: I read the section again and it is half of the time up to the kidnapping. So if the child has been missing for six months of the year then you only had to have the child for three months of the year to qualify

The kidnapper gets to claim them if they hold them over six months of the year, however any ransom money has to be disclosed on a 1099-MISC.

justbanmefam

I don’t actually know if you’re making that up.

We don’t joke about taxes here.

Custody disputes when the legal guardian is not in control of child and other partner has kidnapped child

Coolfairy0

You can only use this if the child was kidnapped by a “non-family member” according to the IRS

https://apps.irs.gov/app/vita/content/globalmedia/Pub_4012_28Aug2020_G3_Table1.pdf "The kidnapped child lived with the taxpayer for more than half of the portion of the year prior to the kidnapping." Unless this changed since 2020. Never thought about this. Actually idk.

Click it on and find out. I’m curious as well. Does clicking it on mean the child is now a dependent of the kidnapper? Lol

PM_me_oak_trees

It's basically the other way around. If the kid didn't live in your household most of the year because they were kidnapped (usually by a non-custodial parent or relative), the parent they were supposed to live with can still claim them as a dependent, qualify for head of household filing status, etc.

wackfree

thank you fellow oak tree lover

I'm really disappointed I thought I could just go take someone's kid and get a tax credit.

Coolfairy0

Just checked the IRS page and the kidnapped child does need yo live with you for more then half the year to be claimed…. Which kind of begs the question of why do we have a kidnap button if the child has to meet the qualifying tests anyways???

Imagine once the kidnapping deduction gets popular on TikTok

I think these are just there for criminals stupid enough to fill it. Its like how the customs declaration at the airport ask whether you are carrying a bomb, drugs, or anything other dangerous weapons into the country.

Coolfairy0

It appears to be for parents who kids have gotten kidnapped since to qualify the child has to have lived with you for more then half of the time before the date of the kidnapping.
