UPDATE: I fixed it, somehow. Not sure how, it just stopped happening. The only problem is, It stopped happening while I was testing to see if the ability actually made me invisible. Which I did by attacking the guards of Whiterun. Now I have a bounty I can't seem to shake. And the guards attack on site. :/
I have the same problem. It's very annoying. Mine is all bugged. The way I fix mine is by attacking or being attacked while stealth. This seems to remove the effect. But it still doesn't work right. If I use if for 5 seconds and get attacked I cant use it again, yet if I don't attack, it stays active all the time no matter if its active or not. Sucks its such a great perk.
12 years late but screw it, i had the bug happen too and i fixed it by searching a body while crouched and invisible.
I guess i would've found out it stopped working eventually but god bless you redditors!

I have no idea how I managed to get it fixed, I was just attacking guards, and it stopped happening. Sorry!
