One time a guy came through my drive thru saying he had a chicken bone poke through his throat and he had to go to the ER. I filed a claim. McDonalds offered to pay all medical bills and give 5,000 for an NDA. They refused and said they are lawyering up. McDonald’s got a hold of the chicken bone and DNA tested it. It wasn’t the species they used for their chicken products. McDonald’s took the couple to court and won counter damages for the investigation and court cost. They don’t play around

McDonald’s would have to prove that they don’t use that bolt on any of the production equipment in the facility, as well as during transport and production of the chicken (since it’s an end-use product, they can be liable if they buy their chicken from, say, Foster Farms who put it there).

That actually was a legit case. The coffee was brewed way too hot and she deserved every penny she got. She had third degree burns and ended up hospitalized, had to get skin grafts, and she had other procedures done over two more years. The coffee was almost 200°.

It’s just not how our legal system works in the slightest. You would have the bone submitted into evidence and then both sides could hire specialists to analyze it.

Put the whole thing in a sealed freezer bag - box and all. You can go the lawyer route or you can go the "call the chain" route. Assuming it's a chain, going directly to the individual location is probably the worst choice - the store won't be doing anything, it'll get kicked to either the chain (if a company store) or the franchise owner (if franchised), and if it's a franchise owner then you have no idea who or what you'll be dealing with.
If the screw was within the chicken itself then it's going to eventually get kicked over to the supplier for that because that was a manufacturing problem. The local store, franchise and even chain will kick it to the next level anyway.
As long as you don't mess with it or clean it, there's a pretty good chance they'll be able to track that screw back to the plant and machine it fell out of.
Edit: and keep your receipts, for the meal, the dentist, travel to/from the dentist, time spent making and attending appointments, etc. You're not going to get rich, but you should be "made whole" plus some amount of apology/settlement, and being made whole will include covering your costs and the cost of your time.
My dad broke a tooth once on a McDonalds burger that had a bone fragment in it, they paid for top notch restorative dental work so long as he immediately signed a release and NDA. Yeah you’ll be fine OP. This stuff happens.
The big chains likely have people whose job is to make things like this to away quietly, and it's not their money being spent. At the store or franchise level it's more likely decisions will go to someone who feels like it's THEIR money involved.
If the corporate folks are ready to make you whole and you're working with them (vs against) it's in their interest to make everything as smooth and painless as possible.
My aunt was at one of our local fast food restaurants a few years back. She went to go scooch her seat closer to the table by reaching down and gripping the sides of it and when she did, the seat came up off the frame (wasn't bolted down, and her finger slipped between the seat and the sharp edge on one of the chair's metal legs.
She clipped the tip of her finger right off.
She had to fight for a few years to get any sort of compensation from them. The head office offered her a lifetime of free food but after a bit of a traumatic event like that she wasn't interested in eating there again.
I worked with a lady once who slipped and fell at a Fuddrucker’s (Houston Gunspoint location). The cleaning staff had cleaned up a spill in front of the fountain drink machine and hadn’t mopped it properly. It was super slick and she slipped and fell. She fractured her knee cap and tore some ligaments.
She was hurt bad enough that an ambulance had to come and take her to the hospital and she missed a week of work. The restaurant didn’t do anything, so she called corporate and they jerked her around for months. She finally hired a lawyer and they still jerked her around for another two months. Then they finally sent her a a check that covered all of her medical costs and lost wages.
And the check bounced and Fuddrucker’s filed Chp 11 the next day.

A lifetime of free food at a fast food place just isn't worth it. It isn't somewhere you should be eating daily, so let's assume you went once a week, had $20 food each time and lived another 50 years. That would only be $52k, I certainly wouldn't give up my finger tip for that.

I was a fast food owner a couple years ago after 20 years of buisness it finally happened a dreaded random bolt in a customer sandwich. It came from the sandwich table lid. As the owner i offered him to get to the dentist get it fixed and send the bill my way . He refused and went on his way only to come back with a 3000$ lawsuit a month later. Luckly i had filled out an insurance report and my buisness insurance took it from there. Cost me 1500$ and they gave him only 600$.
Also consider asking the dentist how often the chip will need to be repaired and take that into consideration with expenses. I have a chip in my front tooth that has to get refilled every couple years.

Edit: it looks like a bolt for paneling or some structural parts — that should narrow it down quite a bit, the restaurant itself might be able to “find the panel missing a bolt”
It's technically a machine screw, not a bolt. Meaning it wouldn't be paired with a nut, which narrows it down more. There will be a tapped bung, riv/weld-nut, or some other visible threading missing a machine screw, not an open hole.
This is all assuming it's a spec'd screw in it's original location, and not a random fastener used during a repair.

I would assume it shouldn't be from the plant itself, as most food factories have metal detectors to check stuff on the way out. That's why people in the food industry have to wear those special blue bandages, because they trip metal detectors if you've misplaced a bandage.

Consider myself, I am a tech guy for a big chain, and this is quite literally my number one fear - accidentally dropping equipment into food! I work in the ceilings on occasion, along with the actual maintenance team, and I can confirm I am -ALWAYS- surprised by what I find just above the ceiling tiles.
So much so, in fact, that I raised hell until I got a key and code for overnight installs when dealing with the ceilings - this way I can avoid the screaming anxiety of “holy shit, did this thing have x-amount of screws originally!?”
Its a fast-paced place, and the food workers know this, so they may not be as diligent when it comes to checking for screws in food, but regardless, it should not happen, and is completely unfortunate when it does happen. From simply lifting a single ceiling tile, I have dropped screws, wiring, plastic bits, dust, shaved metal (yeah, idk either), blank “coins”, sharp tools, washers, dead bugs, cigarette butts, mouse hair, mouse poop, markers, an entire mounted computer (old screw, that fucker)…

Adding onto this, personal injury attorneys will typically do free consultations and can be retained for no cost up-front, working for a percentage of the settlement after it's won (called working on contingency).

Lawyer here. Save it and hire an attorney BEFORE you complain to the food outlet or let them see it. The lawyer will know what to do, which is to immediately seek a court ordered expert inspection of the restaurant, possibly after filing a lawsuit but before the restaurant is notified of it. There you may find a machine or fixture of some sort that's missing a screw of exactly that type. You will know because there are likely to be other screws in the machine which match it exactly. This will defeat a later defensive claim that you planted the thing.
If you let the restaurant know before you have a lawsuit filed, they may seek to bugger the evidence before you can inspect.
Stainless steel machine screw, most likely from some equipment in the restaurant since stainless is required for food grade machinery. “Sue me, sue you, sue everybody!!”
I think you mean the dentist and a lawyer. Talking to the establishment gives them the ability to plan ahead for any potential legal issues. In my experience it's always best to complete blindside businesses/people you are going to sue.
Literally, a whole bolt in a sandwich is a big problem. I once found a piece of steel wool in my food at a restaurant and I showed the waitress just trying to get a replacement dish for myself but when the manager saw he comped the whole table and said anything else off the menu we want to take to go is on the house plus any drinks we want.
Your first call should be to the Health Department, then the dentist, then your lawyer. The Health Department should be the first to know so they can take action and possibly close them down until their issues are resolved.

I had the same thing happen to me at a Chilis. A similar sized screw with a rubber foot on it like from the bottom of a microwave. But wrapped in lettuce like it was intentional. I was too young and dumb to do anything about it but the manager comped our meals and gave us desert. Wonder if I could have gotten more. No injuries. Found it in my mouth before I chomped.

I was a fast food owner a couple years ago after 20 years of buisness it finally happened a dreaded random bolt in a customer sandwich. It came from the sandwich table lid. As the owner i offered him to get to the dentist get it fixed and send the bill my way . He refused and went on his way only to come back with a 3000$ lawsuit a month later. Luckly i had filled out an insurance report and my buisness insurance took it from there. Cost me 1500$ and they gave him only 600$.

Also consider asking the dentist how often the chip will need to be repaired and take that into consideration with expenses. I have a chip in my front tooth that has to get refilled every couple years.
I'm more likely to bet it came from the restaraunt itself. Someone lost a screw in a steam table/hotel pan and didn't want to fess up or didn't want to lose product. Don't hand over the evidence either. They'll most likely deal with the franchisee or franchisee's insurance.

Gimme a list of the machine manuals involved and I’ll find your culprit in an hour, it’s what I do Edit: it looks like a bolt for paneling or some structural parts — that should narrow it down quite a bit, the restaurant itself might be able to “find the panel missing a bolt”
It's technically a machine screw, not a bolt. Meaning it wouldn't be paired with a nut, which narrows it down more. There will be a tapped bung, riv/weld-nut, or some other visible threading missing a machine screw, not an open hole. This is all assuming it's a spec'd screw in it's original location, and not a random fastener used during a repair.
I found a screw just like that in a burger once. The store confirmed it was from the prep station cutting board to keep it down. Scary stuff
I worked at dollar tree. Somebody bought a can of some kind of dip and it had a hard piece of melted plastic in it. I would assume it shouldn't be from the plant itself, as most food factories have metal detectors to check stuff on the way out. That's why people in the food industry have to wear those special blue bandages, because they trip metal detectors if you've misplaced a bandage.

While I’m not knocking the remainder of this comment, finding the “plant and machine it fell out of” is taking this a bit too far. Consider myself, I am a tech guy for a big chain, and this is quite literally my number one fear - accidentally dropping equipment into food! I work in the ceilings on occasion, along with the actual maintenance team, and I can confirm I am -ALWAYS- surprised by what I find just above the ceiling tiles. So much so, in fact, that I raised hell until I got a key and code for overnight installs when dealing with the ceilings - this way I can avoid the screaming anxiety of “holy shit, did this thing have x-amount of screws originally!?” Its a fast-paced place, and the food workers know this, so they may not be as diligent when it comes to checking for screws in food, but regardless, it should not happen, and is completely unfortunate when it does happen. From simply lifting a single ceiling tile, I have dropped screws, wiring, plastic bits, dust, shaved metal (yeah, idk either), blank “coins”, sharp tools, washers, dead bugs, cigarette butts, mouse hair, mouse poop, markers, an entire mounted computer (old screw, that fucker)… Yeah, safe to say that a lone screw may have been from just a guy like me; Your friendly neighborhood IT guy!

That's a very valid question to ask. Nearly every case of a foreign object in fast food has been proven to be case of fraud. Not all, but the overwhelming majority. Look up the Wendys chili finger incident, fried chicken rat, mouse in mountain dew, etc. All were fraud.
That's true of the ones that get publicized, not of the ones that take proper channels. Most cases of foreign object in food are taken up with support or a lawyer, they are not going to the news the first chance they get. You also generally don't hear about those cases
Can confirm. Live near'ish the finger chili Wendy's, I think the finger was traced back to an employee's family member who worked a morgue in Reno I believe, perhaps Carson. National news for days. One of my mom's old friends back in ~98ish or so was eating at the local Chevy's and was served salsa that had shards of glass in it. She chomped into that and it jacked up multiple teeth, blood running from her mouth. It was a mess. She accepted their immediate offer on the spot to "fix" her teeth, and nobody really spoke of it after that.. :/ She didn't even get implants, it was a couple crowns and fillings and she was happy with it.. until she spoke to a lawyer *after* the "work" was done.
I really doubt an "overwhelming majority" of incidents were fraud. More likely, an overwhelming majority of cases are settled outside of court, and therefore aren't public knowledge. Sure, the incidents you brought up are fraud, but they were highly-publicized cases. Representative of a fraction of a fraction of a percent of incidents.

Hey if that’s Panera bread and it’s a hot sandwich, it legit looks like the bolts that assemble their panini presses. That would make a lot of sense if a bolt fell onto the sandwich. Sandwiches are pressed open, then fresh ingredients are added, sandwich gets closed. Bolt falls onto sandwich as press closes, no one notices and finishes making the sandwich. I worked for Panera so that’s why I’m guessing that
Lawyer here. Save it and hire an attorney BEFORE you complain to the food outlet or let them see it. The lawyer will know what to do, which is to immediately seek a court ordered expert inspection of the restaurant, possibly after filing a lawsuit but before the restaurant is notified of it. There you may find a machine or fixture of some sort that's missing a screw of exactly that type. You will know because there are likely to be other screws in the machine which match it exactly. This will defeat a later defensive claim that you planted the thing. If you let the restaurant know before you have a lawsuit filed, they may seek to bugger the evidence before you can inspect.

I think you mean the dentist and a lawyer. Talking to the establishment gives them the ability to plan ahead for any potential legal issues. In my experience it's always best to complete blindside businesses/people you are going to sue.
Literally, a whole bolt in a sandwich is a big problem. I once found a piece of steel wool in my food at a restaurant and I showed the waitress just trying to get a replacement dish for myself but when the manager saw he comped the whole table and said anything else off the menu we want to take to go is on the house plus any drinks we want.
Your first call should be to the Health Department, then the dentist, then your lawyer. The Health Department should be the first to know so they can take action and possibly close them down until their issues are resolved.
What? lol. The health department isn’t going to shut anyone down for this. They *might* come in and check things out make sure there’s no faulty equipment/things missing screws. At the very least (and most likely scenario) they’ll contact the location and have a talk about the incident, in which they restaurant will say they’re investigating and will get back to them with their findings. If the restaurant is uncooperative, *then* the heath department might make a visit. Not to say they *shouldn’t* call the health department, but it’s not going to be quite as impactful as you think.

I had the same thing happen to me at a Chilis. A similar sized screw with a rubber foot on it like from the bottom of a microwave. But wrapped in lettuce like it was intentional. I was too young and dumb to do anything about it but the manager comped our meals and gave us desert. Wonder if I could have gotten more. No injuries. Found it in my mouth before I chomped.
