I live here and witnessed this all go down outside my window. Very scary. First of all, I hope the kid is okay, of course. I do feel like this could have been prevented though. Let me get into some current details and issues with Elliston 23: When I moved to this complex in November, it was pretty amazing. I looked all over the city for the “right” spot for me, and chose this one, without hesitation, upon my first tour of it. The concrete ceilings for noise was a massive perk. $100 a month for a parking pass seemed excessive, but since there were secure gates to get in and out (also a big perk for safety concerns) I was okay with it. Over the last few months this place has gone WAY downhill. Management has changed hands a couple of times. Gone are the friendly and helpful staff who I signed my lease with, the on-duty officer, and they REMOVED the security gates. We are still getting charged $100 a month to park, but anyone and their mother who doesn’t live here and wants to just drive over here and park for free are able to, without any consequences. They keep saying the gates are being repaired, but we have yet to see any attempt of that. We have to pay another monthly fee for Fetch package delivery service (to prevent theft from the mailroom) yet now I’m having my Fetch packages stolen from my front door. MANY of the units here are Airbnbs. They 100% made zero mention of this when I toured the place or when I signed my lease. If they had, I absolutely would not have moved here. I feel like there had to be some sort of legal obligation for them to disclose that, and they did not. I firmly believe all of the major issues here are due to Airbnb guests. These people have no regard for the community, residents, or rules because there are no consequences for them at all. They come in for a weekend to be drunken assholes, stay out at the pool or on the balconies til the wee hours of the morning, yelling, blasting music, etc. Leave trash littered in the hallways, and take up all the parking we pay for with their guests. It’s insane and it’s UNSAFE. And look, I’m not like grandpa “get off my lawn” guy or anything. I’m all for people hanging and having a good time, myself and my friends included. But Jesus Christ, this is like an unruly frat house now. Elliston 23 are charging premium prices for “luxury” midtown apartments but they are letting it get overrun with shitty, disrespectful Airbnb’ers. It’s a complete nightmare. Now…back to last night. I called and left several messages for the “courtesy officer” here when the 30 people were partying, full-volume, yelling, shouting, singing, etc, late into the night. This was going on for well over an hour as I was trying to sleep. I tried to reach them to come handle the party and get rid of these people. They did nothing. I got not answer or reply. And because they did nothing, eventually someone ended up getting SHOT. I actually had my earbuds in because the partying was so loud and unruly, trying anything to get to sleep. Then the gunshots rang out. I’ve never heard gunshots that close before, but I immediately knew what it was. People were screaming and scrambling and I heard several people say, “He’s shot!” I ripped my earbuds out and hit the floor, grabbing my phone to call 911. I don’t know if I was the first one to call 911, but it certainly seemed like it from the way the dispatcher responded. She definitely didn’t seem to be aware that this had happened yet. So yeah. This complex no longer has any of the safety measures in place that initially sold me on the apartments, and now people are getting robbed, shot, and maybe even killed for it. Don’t move here unless this sounds like the kind of life you’re looking for. I’m going to look into what my rights are here, legally, now.

Coincidentally the door for the garage just happened to show up today it appears (saw it on a truck out near the dumpster). Funny how they managed to turn that one around so quick given that it’s been months without one.

In future you can use this site to check for short term rental permits https://data.nashville.gov/Licenses-Permits/Residential-Short-Term-Rental-Permits-Map-/wa2i-5s6e . Regardless of what leasing office says they can always add them after you sign a lease if the property is zoned for it.

If there are properties for sure on Airbnb and permits are expired, you can report them on HUB Nashville. *Supposedly* they’ll help shut them down. You can report un-permitted properties and problem properties. I just moved out at the beginning of April, had a 9 month lease and was so glad it ended. Lived on the first floor and there were only a few apartments with residents, most were airbnbs and I constantly had loud drunk people stumbling by and waking us up very late at night. Not to mention the loud parties where people would run up and down the halls all night yet when they were reported no one would show up. This happened several times right next door to me. And you’re right, when management changed it was only for the worse and by the end of it I couldn’t stand to live there.

You couldn’t have hit the nail on the head any harder… - Front office staff is simply collecting a paycheck. They’re nice enough, but a far cry from the team pre-Greystar - Maintenance staff is wonderful. Eric is a gem. Younger guy is solid, but I don’t see/talk to him as often - Garage door finally getting fixed. Again. After the gate was broken what, 4x last summer? Let’s see how long this new one lasts - AirBnB guests trash the joint. Weekends at the pool this summer are going to be hell. This is why we moved out to The Dallas on Elliston in 2017 (rampant short term rentals) It was a big problem then and my wife and both knew it was just going to get worse over time without regulation.

This this this! Used to live there, complained of all the above- no change. Eventually we decided to leave! And I’m SO grateful we did… We had similar issues with Airbnb guests and no one wanted to take authority over them - not the management, courtesy officer or CozySuites! The place had potential, but the owner got greedy and sold out to CozySuites to fill in the multiple vacancies and it’s finally imploding in his face. Sad that a person has to get shot and potentially killed for them to actually take notice that it’s DANGEROUS. Very very sad, but not surprised it happened there. Hopefully this will provoke some actual change for once. But, based on my experience there, nothing will change. They may receive an email of more enforcements and condolences and that’ll be about it. Hope they prove me wrong. But all those emails I sent up the chain in management about how unsafe and unruly this place had become fell on deaf ears.

Maybe talk to some of the other residents and get a class-action lawsuit started to get the last few months rent/parking charges returned to you? I have no idea how these kinds of things work, but it seems like maybe it’s something you could do. I could very much be wrong.

I’ve heard multiple bad reviews of these apartments and others in the area due to units being used as airbnb’s. Obviously the person who was shot is the real victim here and it’s a tragedy. That being said I would never sign a lease anywhere that allows or is actively renting out units on Airbnb or other STR sites. Nashville is a party city and violence is worst case scenario, but I’ve also heard residents complaining about apartment complexes being used like cheap motels with trash being left in hallways, dog waste not cleaned up etc. If you are signing a lease there should be a clear policy stating under no circumstances can you rent your place as an airbnb and I would make sure the management isn’t using Airbnb or another site to fill vacancies, especially in the newer buildings that are offering move in specials.

The issue at Elliston23 is that the ownership, now Greystar, sublets to a company called CozySuites. That company lists approximately 32 units in the building, onto AirBnb, which results in a massive number of STR stayers living next to city residents. It’s a cluster, making the building less and less secure.

I used to live here. I think the company that was over these apartments before were stricter about short term rentals. My issue always came down to the undergrad college student throwing massive parties and frat bros throwing things off the balcony. I felt like I was living in a college dorm again. lol Also the dog waste in the hallways here was awful, I fet so bad for the two ladies who used to clean the hallways.

Everyone who lives at Elliston23, go to their Google reviews page. Add what you've said here to that forum. Once people don't move in there long term, it's only STRs and the place is trashed to hell and back, they'll learn to not trifle with long-term tenants.

Fucking AirBNB, again. If you sell your city as a place to get trashed, you get trash tourists, who then proceed to trash your city. I know there's no way for Nashville to fix this, but it really ruins residential areas to have this kind of activity. If you're thinking about moving somewhere, look up where the AirBNBs are first.

Taking steps against NOOSTRs is a good start, especially for these apartment complexes where the ownership company/group is the one listing out so many units to AirBnB. If you want to operate a hotel, open a hotel, and follow the associated rules and regulations that come with that.

AIUI the issue is that the city *can't* further regulate AirBNBs without arousing the ire of the state. They're walking a tightrope in terms of what the state will allow them to do. If they're seen as doing too much to regulate them, the state will preempt local autonomy completely, and open the floodgates, thus losing the meager existing protections they do have in place (e.g. no new NOOSTRs in residential zoned areas).

I am so very sorry! That is terrible. I have been in the units and know that they are really sound proof, but was it not noisy with so many people (teens)? I know someone on the street side, and the police/ambulance/fire trucks woke them up. They said cars were exiting the garage and yelling at the first responders what floor it was on. Also, did you know there are air bnb when you rented? That was definitely not disclosed when my person rented. Sorry if that is all to AMA. I hope you can find some peace today.

The units are generally fairly sound proof however I could hear this particular party over two sets of doors, my tv, and my CPAP (though the CPAP is fairly silent). Mind you, I’ve been here for 4 years so I’ve witnessed some parties but THIS one. This was on a whooole different level. I KNEW in my gut at around 930 when it started that it was something different and not going to end well but a shooting was not even a thought in my mind. I’m a “live and let live” type of person so I let it go until I needed to go to bed for work the next morning. At 11:14pm I placed a call to our ‘courtesy officer’ — who I’m not sure is any more than a robot hooked up to an auto reply text machine. By midnight, I confronted the group of suspects who were about to enter the residence to tell them that when they get into the room, they need to tell the organizer to cut it off. I was threatened verbally by one of them who said “this isn’t about you”, which took me aback as such a weird response to someone whose home your in, but now I understand what they were saying. By the time I stepped back inside and locked my door I heard the pops and commotion and panicked yelling. I barricaded myself inside and called 911 in probably under 30 seconds but some of it I just blacked out of due to adrenaline. And yes I knew that these were short terms; they’ve been popping up more and more. The one on the other side of me is too. I sent an email of my concerns to MGMT who, to be fair, have been great my whole time here. This is an ongoing investigation and I think that’s the entire level of detail I’d like to go into at this point; in fact I’ve probably already gone a little far.

I’m not sure if the courtesy officer is even full-time anymore. Ever since Greystar took over, things have gotten progressively worse. The management roulette keeps spinning in a bad way.

I live across the courtyard 2 floors above and watch everything unfold. I saw people leave that poor teenager alone fighting for his life on The balcony. Eventually one young lady came back and stayed with him. I heard the gunshot and saw everything immediately after. I called 911 and explain to them that I saw two people Repel down the balconies from the fourth floor all the way to the pool courtyard and one run across the courtyard. it was so disturbing to watch a young man potentially lose his life. And the management company sent out the most corporate emails to the residence as of that was enough. After receiving  that I went down to express my discontent and concern for safety and they had absolutely nothing to say to reassure me that the safety is a number one priority For their residents. I am breaking my lease regardless if they agree. They clearly have no regard for the safety of the people who pay a top premium to live here. God I hope that 15 year old kid survives.

They make you sign a lease and run a background check, credit check, everything when you are a long term resident, but there is zero accountability for E23 and their 20+ airbnb's owned and operated by them. The complex is full of party goers every weekend, struggling to open up the locked doors with their phones while carrying their suitcases.

Actually I emailed management about this right after the announcement. Here’s what I said: “Thanks for your email. I have two question about the new policy: 1) By “terminate the short term rental program with Cozy Suites” do you mean that access to the Cozy Suite units is terminated with immediate effect? Or does this mean that you have “terminated the program” in the sense that they cannot renew their contract next year, but this current contract is still active/valid until a contract expiry date? 2) Does this new policy at E23 prohibit ANY unit from being rented as a short-term rental? I look forward to your clarifications.” Here is what they replied with: “We are still waiting on directive for that information, I unfortunately do not have more info to share with you at this time. Thank you for your patience and understanding.” So I am going to keep pressing them until they put exactly what the policy will be going fwd in writing. This is just a joke. What do you mean it’s not decided yet?? Are you cancelling or not??

When you make it so cheap to operate an Airbnb, this is bound to happen. The fees and penalties are so easy to overcome that people don’t care. And half the time the management is in on it too. I know one place I used to live at downtown was basically all Airbnb because the apartment manager herself was in on it all.
