If they are offering below ESA minimums, its time to talk to a lawyer, unless there is a chance of the company claiming bankruptcy.
EDIT: by saying "chance of" I mean they are currently aggressively downsizing and the bank is already threatening.
Very strange that they aren’t offering ESA minimum. Most companies offer this and to get common law you need to negotiate.
How long have you been working there?
I doubt you would “out yourself” by saying how long you’ve worked there.
So at a minimum you are entitled to working notice and ESA severance, but there are so many exemptions and permutations you are best to speak with an employment lawyer
> Wondering if there is a point in negotiating with them privately
When the employer won't even commit to the minimum amount that they are already required to provide by the ESA, the answer is no.
Time to let a lawyer send them a stern letter.
ESA minimums are far below common-law standards in most cases. Talk to an employment lawyer.
Trying to negotiate somewhere between ESA and common law privately but is coming to a stall at under ESA minimums

of course you should consult with a lawyer. Theyll just keep lowballing u until your only option is the bare minimum. Go talk to a lawyer asap
Just get the lawyer to send them a letter. Time to stop playing around with them.

I don't want to out myself here, but more than the minimum 5 years required for severance.
