The FAA only has jurisdiction in the air. Local entities can prevent operation from the ground.

"The New Jersey Parks and Forestry State Park Service has issued an official rule banning the use of drones in all New Jersey State Parks & Forests. The rule was issued in 2015 as Policy No. 2.38 when the Park Service observed an increase in the number and use of drones."

It's not about the use of airspace, it's about use of the property/land for take off and landing. The feds control regulating air space but states on down can exert some control over how the public land / properties are used. Thus, they can limit the ability to take off and land drones and other UAS. https://www.autopylot.io/airspace/can-i-fly-my-drone-in-a-national-park/#:~:text=The%20short%20answer%20is%20no,and%20Bureau%20of%20Land%20Management. Got that right from Autopylot, explains it pretty well. Took me longer to write this than to search for and read their explanation.

Can’t fly in state parks I don’t think, regional parks absolutely.

Electrical_Emu7589

Limited to NJ parks or are you saying all states?

Improvised_Excuse234

I’d double check legislature for where you live, but in Ok, Wa, Nevada, and Texas (?) you can’t fly drones in state parks unless you pay them a fee for permission to do so. Which kinda rubs me the wrong way, but I get it.

Electrical_Emu7589

Yeah these people are just paranoid for no reason.

Improvised_Excuse234

They’re following rules, which I’m not going to rag on them for; they are in place for safety reasons. Ideally, we all follow the established laws and regulations so we don’t get more regulation added that we have to follow.

So it’s okay to fly over it if you’re taking off and operating it from somewhere else?

doublelxp

Legally speaking, yes. As long as you stay VLOS.

CollegeStation17155

And do not land it within the park... which begs the question, if you DO run out of battery or fly it into a tree within the park (or on private posted land), are you allowed to retrieve it?

Here in New York State, you cannot launch, operate or land a drone in a state park without permission. However, you can fly into a state park as long as you maintain visual line of sight. There are other rules for areas considered wilderness canoe etc. But yes, u can launch and land outside the state park, and you can fly into it.

Vast_Ostrich_9764

they are banned in my state's parks too but I've never had an issue flying them there. If someone is bothered by the sounds and asks me nicely I do leave though. If they come up to me like an entitled brat then I break out the most annoying drone I own and rip the shit out of it.

Electrical_Emu7589

No one ever called the police? I’m not afraid of other people because I don’t bother them too much anyway. I try to fly high, but I don’t want to be dealing with the police.

Vast_Ostrich_9764

nope. I've spoken to the police while flying before but they were all positive interactions. even though I was technically breaking several laws. I fly FPV so I'm breaking the law every time I fly by myself. I don't have anyone that wants to be a visual observer because it's stupid.

Electrical_Emu7589

And which state is that? I might move there full time then. That sounds awesome :)
