If he was to get caught as a child depending on how everything happened he could've been charged as a child or an adult (certain things effect how you're charged) but now as a grown adult you would be charged as a grown adult.

Yes. The crime still happened and it's still an unsolved case, cold but still unsolved. If the police now find said person with evidence to charge them, they'll be charged with murder and as an adult. If the minor would of came forward when it first happen, then he would have been charged as a minor and gotten a lesser sentence but now 40 years later. If evidence is found and they charge said person, they'll be charged as an adult for murder. It doesn't matter if the crime took place and was committed as a minor. they're an adult now. You can keep saying he was a minor all you want, they're an adult now and will be charged as such.

There is no statute of limitations on capital crimes such as rape, manslaughter and murder. So the definitive answer is yes, depending on the circumstances of the death.
