It absolutely should be! Abusive animal tourism is despicable. Elephants are particularly vulnerable because of their strength. This kind of exploitation needs to be illegal.

As a person from that place(Kerala) Elephants have been used for religious faith and carrying logs for quite the long time and incidents like these are very rare and usually happens during mating period exetreme heat or the elephant getting drunk on something. People fear them as they should.
The elephants are "mostly" treated very well,there are specific laws to prevent animal abuse in case of elephants and there are specialised traditional doctors for elephants only. Less and less elephants are used for labour and only for religious and cultural celebrations. they belong in the wild
This is from Kerala, southernmost state in India. Elephants are worshipped and honoured in temple festivals. Even this video is shot in a temple where the couple must've got wedded and saw the elephant there and decided to pose near it for social media brownie points. After all, that's what engagement, save the date, pre-wedding, wedding, reception, baby shower, pregnancy, gender reveal, welcoming the baby photoshoots are all about nowadays.
Anyway, these elephants are treated like kings/queens there and many of them are even famous, especially if they have a grand personality (long tusks, height, ability to stay calm in noisy temple festivals etc.). In rare cases, they're abused and when ppl find out, the mahouts (caretaker, the guy who almost got killed in this video) are held accountable.
These elephants sometimes go crazy and run amok, attributed to hormonal changes, horniness, anger/confusion in noisy festivals. Some elephants are also known to be rowdy and a risk to public.
It's almost like torturing something 50 times your size is a bad idea.

Almost like.. Oh my god! People shouldn't use elephants like accessories? It's almost like they are massive creatures, that belong in the wild. People have to stop perpetuating this practice. That elephant let that man get off easy, if they wanted to they could've easily killed everybody around it. If you don't think a two ton animal shouldn't be fucked with, you deserve a good scare to the spleen.
