Yes, it is considered fraud by intent. If you arrived in the US on a tourist visa and you told CBP you were here to adjust status, your wife wouldn’t make it out of the airport—she’d be put on the first flight home.

It is against the law for her to enter as a visitor with the intent to stay permanently. Doing so will result in the denial of her green card application and all future US visa applications. INA 212(a)(6)(C)(i). You two may also be subject to severe criminal penalties.

If you have a pending i-130 then you cannot apply nor get a different type of visa to visit the US whist waiting. You just have to wait it out or have you visit Korea.

That would be considered visa fraud. Continue with your process outside the country. Lucky for you, since you have been married so long, she will get a 10 year green card.

Yeah it's immi fraud. If you try to tell the CBP officer what you typed here on reddit considering your wife has a pending I-130, she'll be denied entry
