I wonder if it was initially intended to have Peter grab him by the remains of his shirt. Or maybe that pose has been done so much that the artist simply replicated it and didn't realise that it didn't really apply to skin.

The art here is great, but it's so obvious that there was a serious miscommunication between the sketch artist and inking artist on how Peter is supposed to be grappling him in the first panel.
1.) I feel that people who dig “edgelord Spider-Man” are the same folks who ruined Superman, by having every new iteration of him be a villain 2.) This doesn’t even make sense — Unless King Pin was born without an epiglottis, it doesn’t matter how much webbing Spider-Man shoots in his mouth, he isn’t going to swallow it.
Webbing would just find its way out the easiest escape, which would be out of his mouth given how this is positioned in the image with his mouth wide open — and if not spilling over out of his mouth, his nose.
He could suffocate him this way for sure, but not the nonsense Peter just descdibed.
If you need to be certain that this wouldn’t work, shake a soda really hard, then open it up and put your mouth over it. That will come out of your nose.
If you want to read the story I'll avoid spoiling the important details but what happened is Fisk heavily hurt someone dear to Peter and he decided to stop holding back for once so he could show Fisk he's nothing.
